As you said, the fire is about 60 contad news for everybody. The road closure will be here at least until morning. John carlson is relieved firefighters are keeping a close eye on things. His home faces the hill, where it appears the fire started. Tired of fires. Weve had last three years weve had a lot of fires. Were fortunate we havent had any fires on our property, but theyve come pretty close. Reporter the socalled wragg canyon fire started this afternoon. Nine homes were evacuated. Youve got to be prepared, i guess. Ready to go when they tell you. Reporter the fire quickly grew to 55 acres. Very dry right now, very you know, the humidities are low. With the terrain the way it is and the wind, it can push the fire around a little bit. Reporter the wragg canyon fire very close to the 51,000acre atlas fire in 2017 that left six people dead. Hundreds of homes destroyed or damaged. Fire Officials Say fire season is not only in the summer months, its a concern all yearround, especially for people like michael miller. Burnt down to the road on this side. And, yeah, its a fact of life but its scary. Reporter its scary because its a jump start on this fire season. Today the 40yearold comedy club secured a lease to stay at its San Francisco location. The agreement comes less than two weeks before the club was duossible eviction sparked a campaign to save the historic venue. All raise questions about the policy, procedures, training and the culture at palo alto pd. The video ends in a confrontation and use of force that was never officially reported. And it was all over a misdemeanor traffic incident. Tucked in among the upscale homes of palo alto, Buena Vista Mobile Home Park stands out. Residence here are more diverse and less affluent than the rest of the city. Gust Gustavo Alvarez have called this place home since they moved here. Two years ago he installed this Security Camera outside his front door. I put the camera for people who steal, its for police. Reporter thats right. Gustavo alvarez says he installed the Security Camera because he doesnt feel secure when the police come knocking, something he says theyve done many times over the years. Alvarez does have a history of arrests, including several duis, a burglary and an old grand theft charge. But he says recently his treatment by Palo Alto Police has escalated beyond anything he could imagine. They start harassing me anywhere i go. Reporter in february last year, his camera caught this. Reporter alvarez says he was standing in his driveway when palo alto Police OfficerChristopher Conde approached telling alvarez he was being detained for driving with a suspended license. I know youre driving with a suspended drivers license. Reporter the camera seems to capture officer conde admit he never saw alvarez driving. He goes inside and shuts the door. Officer conde calls for backup. Come out. Come out or were going to break down the door. Come out or were going to kick the door in. Do you have a warrant . We dont need one. Come on out yeah. Im coming out. Come out. Im coming out. Come out come out. [ bleep ]. Reporter one of the backup officers to arrive is Palo Alto PoliceSergeant Wayne benitez. An open blow to the head. 15 seconds later hes clearly shown on the videotape lifting alvarezs head and slamming it into the windshield. My face went to the windshield. Youre going to be bleeding a whole lot more. Reporter alvarez says the blow split his lip and broke his tooth. Its honestly shocking. Reporter cody salfen serves as alvarez he says offs Gustavo Alvarez to begin with, let alone break down his door, rough him up and lock him in jail for two weeks. Remember, this all stems from charges of driving with a suspended drivers license. At the time officer conde initiate the the detention, he did not know if his drivers license was suspended and he did not know whether or not he was driving the vehicle. Reporter in criminal court, a judge agreed and later all charges were dismissed. Attorney salfen says even more troubling is the Police Report does not allude to any force used during the arrest. It does not show anything that alvarezs Security Camera shows. No use of force mentioned. Thats dishonest and its a lie. Reporter theres more that was said off camera. Listen to what Sergeant Benitezs bodyworn microphone captures right after the arrest. See how quickly they behave talking to, but his message seems clear. Going to get [ bleep ] on out here by these low lives. Reporter the bodyworn microphone shows Sergeant Benitez mocking alvarez for being gay. He ran inside and then stood at the door. Hes gay. That is not how things should happen in palo alto. Reporter retired santa clara judge cordell is also an independent Police Auditor and also happens to live in palo alto. When palo altos own Police Auditor turned down our request, she agreed to review the case for us. Everything from the hollering, the yelling, the violence, the use of force, the failure to report it and then the audio in the aftermath that showed absolute explicit bias, every bit of it was bad. Reporter nbc bay areas Investigative Unit reached out to Robert Jonsen as well as attorneys for each of the individual officers to get their side, but they declined comment, citing the pending lawsuit. Im calling on the chief of the Palo Alto Police department to stand up, address this issue and let us know, particularly those who live in the trailer park, they are palo alto residents. Let them know they are safe in this community because from what i saw, i dont think thats it at all. In a response to the lawsuit filed in court, attorneys for the city as well as an attorney for Sergeant Benitez denied most of alvarezs claims. Palo alto city manager released a statement to me late today saying, quote, while the city does not comment on matters and active litigation, the public should know that the Police Department has procedures to investigate allegations of misconduct thoroughly and to hold officers accountable, end quote.
