Well check back new at 11 a surfer survived a suspected shark attack today at linda mar beach in pacifica after he reportedly was knocked off his board and dragged into the water. Now we do have a picture of his injury to his leg. Its a bit bloody, so we are blurring it. The man didnt see what bit him, but there is a clear bite mark and the surfer was taken to the hospital. Warning signs are now posted at linda mar beach, telling people there was a shark in the area within the last 48 hours. It also has scribbled at the top the words someone got bit. Sure did in the south bay. Police have arrested the mother daughter owners of a san jose daycare facility. A two girls, sadly died when they drowned in a backyard pool at the happy, happy home daycare. And a two year old boy survived. Investigators say the children were left unattended in an outdoor play area. They then walked through a pool gate that had been propped open. Abc seven news south bay reporter Loren Martinez asked a legal expert to evaluate the case. The owners of a san jose home daycare where two toddlers drowned are facing felony child endangerment charges. The Santa Clara CountyDistrict Attorneys Office says criminal negligence led to the fatal drownings of two one year old girls in the backyard pool. Many times, prosecutors dont want to compound a tragedy like this by filing criminal charges. But this is very different than the backyard accident that happens with a drowning. What you have here is the highest duty of care to these children because they were at a daycare. The das office says a mother and her adult daughter owned happy, happy daycare. Detectives outlined a timeline of events on sunday, october 1st. An employee called out of work on monday. The daughter was the only caretaker since her mother was at another daycare. According to the investigation, the mothers husband normally waters plants by the pool. While it stated, quote, while doing so, he propped open the pool gate with a clothes hanging rack. He failed to close the gate after watering the plants. The allegations say while the daughter was making breakfast, she let the girls and a two year old boy into the rear patio play area unsupervised and out of her sight and with access to the open gate. At least five minutes later is when she discovered the boy unconscious in the pool and then called for help for the girls. So its not just one violation, but a number of problems at the daycare that compounded this tragedy. And i think that will be key. Its possible the das office could look at filing homicide charges. Pool Safety Advocates say better state regulations are needed. The license requirements for daycare or home daycare operations with pools or open water are are nominal at best. Parents should take a really good hard, long look at what happened here because, again, this is not just about the daycare operators. This is about a system that enables these daycare operators to exist in the first place. The two women are due in court in december for in san jose. Lauren martinez, abc seven news. A water main break caused a large sinkhole in pinole tonight. Officials blocked off the area near buckskin road that was also experiencing some flooding. As you can see, residents in the area are without water service, which is a hassle. The Fire Department and east bay mud crews responded to the scene. Officials say they expect to be there until the Early Morning hours, working on repairs. Oakland is one step closer to getting a new police chief. The deadline for applicants to submit their application was tonight. Thats according to the east bay times. So Police Commission hired an outside firm to lead the search for a new chief after the firing of former chief leronne armstrong. A publicized list of candidates this week included armstrongs name, along with and six other unnamed candidates. That number is subject to change as more applicants join the running. New developments. A woman accused of killing an elite cyclist from San Francisco attempted to escape this week. Kaitlin armstrong is accused of fatally shooting Mariah Wilson in her austin home, then fleeing to costa rica in 2022. Now this week, the sheriff says armstrong ran from Corrections Officers when leaving a doctors appointment on wednesday. She was captured shortly after armstrong, whose trial is scheduled for later this month. Happening now, a stretch of highway 101 is shut down for the entire weekend. So be warned, this affects only the northbound lanes of 101 between the whipple avenue and britton avenue exits between redwood city and san carlos. The closure will last until monday at 5 a. M. In time for the morning commute. They intend to get it back open. The weekend closure will allow caltrans to finish repairs facing the Cordilleras Creek bridge and another project to talk about, caltrans says repairs to the richmondsan rafael bridge toll plaza damaged canopy and safety components will take about three weeks. That means the three far right westbound lanes at the toll plaza will remain closed to traffic through october. This is due to a big rig crash and fire on monday night that we reported. In washington, liz landers, abc news. Californias newest senator, laphonza butler, made her First Official appearance in los angeles today. Shes finishing out the term of late dianne feinstein. Butler was at the royal school of film and Television Production magnet, which teaches students from underserved communities about jobs in hollywood. The school was founded by George Clooney and is backed by some of the biggest names in the entertainment business. Young people. I stand before you as only the third black woman ever to serve in the United States senate. Butler has remained silent on whether she will enter the senate race to replace feinstein at the end of next year. Three big names have been in that race for several months. She has until december 8th to file for the march 2024 primary. The department of health and Human Services has reached an agreement with pfizer that ensures Patient Access to paxlovid even when the drug hits the commercial market. Paxlovid is the go to treatment for covid 19 and has been available for free thanks to a government deal. Next month, pfizer will begin transitioning the drug to a commercial product, but theyve let the government build up a stockpile and will update the inventory through 2028 and have a program for uninsured patients, employees have reached a tentative agreement with Kaiser Permanente after seven months of negotiation and a three day strike. The deal includes higher wages with a 21 pay increase over the next four years. Minimum wage is set at 25 in california, with 23 in other states. Theres a commitment to on the job training so employees can advance their careers. People under this tentative agreement can rightfully expect to make real economic progress in real terms, which is really important right now. This new contract will actually help us continue to have some of the best employees in health care. Acting us secretary of labor julie su was at the bargaining table. The unions represent 85,000 workers. They will vote on whether to ratify the contract next week. And just tonight, Governor Newsom signed into law the nations first statewide minimum wage of 25 an hour for all Health Care Workers. Todays action comes after years of lobbying and protest by labor unions. The wage increase will go into effect over the next decade. Uc Berkeley Labor Center says about 455,000 workers will benefit from this increase. Three out of four are women and 76 are workers of color. In the north bay today, a late season effort to prevent wildfires in sonoma county. Firefighters conducted a controlled burn to reduce fire risk in a rural area near forestville. 11 acres of dry fuel were burned under a program called fire forward. The program has been helping hundreds of north bay residents keep their communities safe. This is the first fire, to my knowledge. Thats happened here in the last century. So its overdue for sort of a fire cleansing. What that means for you is that youll just continue burning and segment de. We cant always just be on the reactive side of fighting fire, but also we want to do our fuels management and reduce fire loads. In this season, firefighters across the bay area have conducted dozens of prescribed burns to reduce wildfire risk. Well, and so far, so good. Weve really been very fortunate.
