Clayton street, we met a San Francisco resident who was attacked by several sideshow participants. First he woke up to this at 2 00 a. M. Then he was attacked by several sideshow participants right outside of his house. I was hit so hard, i was hit at least ten times in the same spot that i thought my skull was going to cave in. This San Francisco resident who preferred to remain anonymous in fear for his life said he walked outside of his cleveland suite apartment thinking he was safe after seeing a Police Vehicle down the block. He made a comment about the sideshow, and several people turned around and chased me to the entryway of my building, and he hit me two to three times in the face, broke my nose in two places, and then i crouched down and he proceeded to hit me at least ten times in the become of the head. Reporter sfpd confirmed there were no arrests and no citations at any of the side shows reported. I wanted to make sure the Mayors Office and the city of San Francisco is aware that these are not nonviolent offenders. They had rage and a veracity which i have never encountered. The fact is the sfpd is ready for it. Part of the challenge is we need to strengthen our laws like oakland did and have the ability to confiscate the vehicles that are involved in these sideshows. I spoke to a member of the San Francisco Police Department who confirmed theyre working on finding solutions, but its a question of resources Public Safety and officer safety. A chp plane helped arrest four people last night after a police chase that started in napa county. The suspects were tracked to a neighborhood in rodeo. They ran from the car, hid in a backyard. Contra costa sheriffs deputies and chp officers then moved in to make the arrest. It was all intense for some time. But as you can see from these picture, it worked out in the end. Laura anthony is in the newsroom with more. Laura . Hi, dan. Unlike virtually all of oaklands recent chief, this one is not going away quietly. Ann kirkpatrick is fighting back, including potential legal action against the city of oakland, and she is asking for the u. S. Department of justice to take a closer look at a system thats kept the citys Police Department under their thumb of a federal monitor for more than two decades. I dont think i was who they wanted to begin with. Exoakland police chief Ann Kirkpatrick is firing back at a citizens commission, and mayor libby schaaf for her abrupt firing last thursday. Are you upset . Angry . Not angry. I will tell you im disappointed. Im embarrassed. Terminating the chief of police. Commission chair Regina Jackson claimed the chiefs firing was without cause, but jackson went on the say the commission had lost confidence in kirkpatrick, who had openly sparred with commissioners in past meetings. I am not going to have a police chief that you speak to our staff in that manner. The commission had also criticized kirkpatrick for failing to fire four officers involved in a controversial 2018 shooting that left joshua pollack dead. I knew i could have had a good headline. I knew the commission would have been happy with me. I knew the monitor would have been happy with me. But to do so would have violated integrity. Do you feel like the mayor turn yound . She was one of your biggest supporters. Yes. I do think that i was surprised and disappointed in her, yes. I was disappointed. Why . I believed her. Unlike those who fired her, kirkpatrick believed she had made significant progress towards complying with a federal monitors goals, including Violence Reduction and hiring more women and minor officers. I want to be clear that i am not a opposed to federal oversight, but after 17 years in this pattern of firing chiefs, ten of them, this pattern that we cant seem to compliance is troubling. Kirkpatrick told us she will ask the u. S. Department of justice to investigate, and she is considering legal action against the city. Abc7 news news has learned the basis for her legal claim may be alleged retaliation related to kirkpatricks reported refusal to grant special favors to at least one member of the Police Commission. As for oaklands next chief i would tell anyone who calls me, and they will. Any candidate will be calling me, that if you have a family or children or parents, anyone who is relying on their income, do not come to oakland because they will not have a job for long. Now kirkpatrick went on the say she believes her firing and the way it happened will have a Chilling Effect on oaklands efforts to hire a new chief, and she promises to release more information about why she thinks she was really let go by that Police Commission in the coming weeks. Hollywood mogul Harvey Weinstein is in jail today after being convicted on rape and Sexual Assault charges involving two women in new york city. A jury found weinstein guilty on charges that could send the 67yearold to prison for up to 29 years. But the same panel also acquitted him on two more serious charges that carried life sentences. One of weinsteins production assistants accused him of sexually assaulting her in 2006. Prosecutors also claimed he raped an aspiring actress in 2013. Harvey weinstein has finally been held accountable for crimes he committed. The women who came forward courageously and at great risk made that happen. He is going to be filed and but an appeal will be filed, as soon as possible. Wine scene will return to court in manhattan for sentencing on march 11. He also faces Sexual Assault charges in los angeles. In the east bay, air testing continues at Mcclymonds High School for cancer causing chemical tce. Its the case of good news and bad news for mcclymondss families. Good news because so far they havent detected any toxic air at the school. Thats just preliminary testing. Theyre still waiting for final results, which means the students will be split up in different locations in order for classes to resume on tuesday. All of that information came out at a meeting that happened here at west Oakland Middle School this morning. Today we were angry as well. We didnt really get anywhere. Bea hendricks just attended a meeting for parents. Many worry more than just safety for the kids. Her son is a junior at the school, plays football. But right now h is home without sports or grades. The scouts look into your grades and what youve been doing in your junior year because they want to know if they even want to talk to you your senior year. Classes resume tuesday all within a couple of miles of mcclymonds. Ninth gradelers go to ralph bunche, tenth and 11 to west oakland middle. Mcclymonds will remain closed as air testing on property continues. Final results are expected at the end of the week. The good news is the preliminary test results we had on saturday showed exactly what we were hoping, and that is zero percent tce throughout the school. Parents have been angry and confused about the process. The school shut down last week after tce was found in groundwater near the school. Officials have yet to trace where it came from, but there are several Hazardous Waste sites in west oakland. Were hesitant to allow them to go back because were not sure, like i said, what are the acceptable levels of this. We know that there is all kinds of distrust, and rightfully so. This is a situation where people of color, poor people have frankly always gotten the shaft in this country. And we need to change this. Now file results for that toxic air is expected later this week. Theyre trying to keep the students busy. Theyre going to be going on field trips all over the bay area. You go on and pick the profile that fits your situation and see which companies have low rate, and focus your efforts on those companies. You dont waste a lot of time shopping around at companies that are going to be expensive. I know what people are thinking right now. Too hard. Too much of a hassle. Its affordable. Im done. Tell them its not hard. Is it hard . Im not saying it was easy. Its like doing your taxes. I mean, its a pain. It might take an afternoon. It might take a day. You might have to get some people wait for people to call you become, there might be some run around with some companies where you have to deal with an underwriter. So its not simple. But you can save a thousand dollars and save that year after year after year, thats worth my time to do this. I think another mistake people make is well, i just renewed with them. I just got the notice to renew and ill do it when it comes up again. You dont have to wait even if youre prepaid. But as you well know by now, because weve said it so often, we have had no rain so far this february. Our forecast animation indicates we may get a couple of hundreds of an inch by sunday, which is march 1. But that doesnt help us in february, does it . Here is the forecast animation showing the approach of midnight saturday night, with no rain at all. But early saturday morning, it looks like a little rain may touch parts of the bay area. So its probably going to be a completely dry february. Overnight conditions, clear, breezy in the hills. Mainly mid to upper 40s. Tomorrows highs will range from mid60s a the coast to low and mid70s around the bay and up to almost 80 degrees in the warmest inland spots tomorrow. It will be mild again, or mild to warm on wednesday with inland highs in the mid to upper 70s. Thursday perhaps even warm were highs approaching 80 degrees inland once again. And friday, still in that mild to warm range. So here is a look at the accuweather sevenday forecast. Looks like were going have this unusually warm pattern all the way through the end of the week. Phil matier took a ride with the general manager, and they talked about one of the biggest concerns that riders have, safety. The message bart has for commuters. Bart is making changes. Is it makes a difference . Every bart line, every problem, every solution we can find. Cell phone, fare evaders. Things we found on bart. Abc7 newss building a better bay area contributor phil matier caught up with barts general manager at the civic center station to ask him whats being done to clamp down on crime. Now, heres the entrance, and this is where a lot of your trouble starts or stops. Thats right. Now, up until a couple of months ago, you could either hop over or walk right through it. Correct. What has changed for the people that are bugging people from getting in . We increased the pressure right here you. Not push this open and walk into it. We increased that railing. See that railing went higher on those side railings. So harder for you and i to jump over that thing. And the next step is new fare gates. So muni has those new fare gates already. See the people there . Its a lot tougher to get in and out of there without a ticket. Its been like that for years. What took bart so long . Well, again, i think were a little bit late on the fair evasion side, but we do have a plan in place right now. And the last piece will be the new fare gates. That will be a hardened station with new fare gates, higher railings, cameras and security measure theres. We call it a hardened station. But when people get on bart, they expect it to be safe. Thats what theyre paying for. Thats what these gates are for, to keep the madness of the bay area out. I hear that every day when im out. When you talk to people every day and youre out, what is it they tell you . Ill give you the top three. Presence in the system. They want you and i in vests. They dont care if were armed or armed, in a vest with a radio walking the trains nights and weekends. Thats probably what i hear most. Second thing is fare evasion. And third one is on homelessness and crowding. So what are you going to do about presence . Presence in the system. Two things are going on already. We started a train team, reporting a new police chief 30 days ago, and he immediately took Police Officers out of their cars, established a 12man police team, and theyre already running in the system. So we may see them as we jump on. And then our Ambassador Program is going to start up, and that will be another ten officers walking the trains. That brings us to another topic, which is theft. A lot of times on these trains people are getting their phones snatched when the train pulls into the station. Thats one of the reasons putting more kochs on there . It is, for sure. That is two pieces i would say to that. One, its certainly an Educational Campaign that we need to make sure our riders are look, you come into the system and you expect to be safe. And i want you to be safe in the system. But as youre coming into a station, if you can put your cell phone down or look up, its important to just be aware of your personal surroundings. All right. Phil is here to talk about this issue. And the bart general manager makes a good point. We need to be aware of our surroundings. People get work done on bart. They use their phones and computers and they ought to feel safe doing it. Its great that theyre making this progress, but now the point you addressed there, it took them a long time to try to get ahead of this. It really did. It really did. For years bart board of directors were even mixed on the idea of what they should do, if anything. You make a good point, dan. Unlike walking on the street or something like, that when you enter a bart or some system like that, there is a selve of expectation for safety and security. There just is. So youre not looking over your shoulder. And if theyre not providing it, its on them. I hate when we pass the buck to the victim in this situation. Its not fair. A lot ofpeopletakebartso they can use that commute time to get some work done. Right. Now what powers was talking about, though, in this past year, and i give channel 7 credit for this. You got on the story. You stayed on the story. And the bay area got on the story and stayed on the story. And you dont make change just by a couple of announcements. They were talking about putting more trucks on the trains every once in a while after a story would attack, or a particularly bad break. This year crime has gone up last year. Went up 11 . This year, january, the number of cell phone snatchings of january of last year was 74. This year its 46. Thats not perfect. Thats not close. But its moving in that direction. Number two, as we saw at the stations, they are making an effort now to harden them up. You can have a debate about who should be on the trains, how they should be comporting themselves, whether they should be laid out, sprawled out, whether they should be high, this, that, or the other thing. But if you a problem and you keep the problem from getting in, you beat it. Or at least a good part of it. And thats after years and years of debate about whether or not to do that, they decided to take that simple step. Its an expensive step, and i know they have to study their options and the different ways to do it. Was we waited until we reached a Tipping Point when it became kind of a joke. Everybody complained about it every day. A year, year and a half ago when we first started looking at bart really hard, there was open drug use going on in the downstairs. I remember that video, people littering the hallway. That was the Tipping Point. Are you kidding me . Look at all the video we get every day when we go down there. We just go down there, stand around for 15 minutes. 15 . Maybe 5. But its easy pickings. And theyre still going over that. That is an expensive proposition. In the meantime, they are upping the presence of police, but lpz the visibility. There is a certain amount of Public Relations here. Theyre getting out there with more Police Officers. Now theyre going to have ambassadors just wearing things. We may not make you safe, but were going make you feel safe. Now the big challenge for bart remains women and weekend riders. One thing when everybody is s crushed in on a sardine can and keep an eye on your cell phone, youll be okay. What about nights and weekends when youre standing on a platform or a station and feel alone and somebody is acting strange. Thats when youve got to do something, and thats the next big challenge they have. Well, as you said, we stayed on this. And bart has made some changes too. Andrew yates has supported his support but there are skeptics. Some say paying for it like a 10 tax on goods and services would hurt the poor. Another concern. He tweets people shouldnt have to choose between public assistance and the 1,000 a month as the bill is currently written. The lawmaker items me he is open to input and changes, but the fact that drove the campaign remains relevant. This transcends any candidacy of an individual, but rather this is about a movement, a Grassroots Movement to making sure we rewrite the rules of the economy to making sure that it works for everyone. The bill now goes to committee to figure out the cost and other details. To pass it would need a 2 3 majority vote which could make it an uphill battle. Guys .
