Abc 7 News ReporterAmy Hollyfield is tracking the latest development. Shes live at the hall of justice in san francisco. Good morning, amy. Reporter good morning, natasha. Even after todays court hearing, this man still has a ways to go in the court process. And today, for the first time, the public defender spoke out on what he thinks is really going here. He says he thinks President Trump didnt like this conviction or this verdict and, therefore, this man is now the victim of political vindictiveness. No matter what sentence Jose Garcia Zarate is given today, he will walk out of county custody because of time served. The maximum he could get for this gun conviction is three years. But now he will be handed over to federal custody. Thats because a federal grand jury charged him for being a felon in possession of a firearm. This came after he was acquitted of killing kate steinle. That killing happened in 2015. Thats a verdict that President Trump tweeted and called disgraceful. Defense attorneys call these federal charges vindictive and a direct result of the verdict. Its rarely done. I mean, for the federal government to come back two years later and say, oh, you know, by the way, were going to charge you with federal gun possession because a jury acquitted you, because the president was upset with the verdict, yeah, its unprecedented. Reporter tony sara has volunteered to represent zarate pro bono in the federal case. He could go to prison for ten years if convicted in federal court before then facing deportation to mexico. Everitt Aaron Jameson is scheduled to be in a federal courtroom in fresno tomorrow. Today, rather. Prosecutors say he planned to use home made pipe bombs to force people into one spot and shoot them with an assault rifle. The indictment against him says jameson told undercover fbi agents he wanted to attack pier 39 on christmas day, as a show of support for isis. He went into detail about how he planned to assemble the bombs and where he was going to put them. Jameson who lives in modesto was discharged from the marines in 2009. Were expected to get more details from San Jose Police on this case thats shocked a local community. Authorities believe they arrested the man behind a Sexual Assault and robbery of a middle school employee. The suspect seen here in the Surveillance Video assaulted the woman inside of a classroom at harker academy. It happened just an hour before students were set to arrive.
