It lasted a little less than an hour and we expect a final ruling, a decision by these five justices could come any time before the election. This New York Appellate Court typically rules about a month after hearing oral arguments. Today the five appellate justices heard arguments from former President Trumps lawyer John Sauer who successfully represented trump in the president ial immunity case before the us supreme court. Sauer made the Case Today that the 454 Million judgment former President Trump was ordered to pay by Judge Engroan was grossly excess very excessive and unconstitutional in part because the allegations are past the statute of limitations which at least one justice pushed back on. Even if we agree with you on the statute of limitations point, that would not result in the complaint in its entirety being dismissed. We learned once again Communication Problems plagued the Secret Service. I do not believe they could hear us at all. They did not have a radio from us and we did not have a radio from them so in the local Command Post there was no way for us to hear any of the Secret Service radio traffic. Reporter we heard from the Butler County Emergency Services Unit, the butler police department, Pennsylvania State police, a former secret Service Agent not involved in butler, and the Medical Examiner who did the autopsy on shooter Thomas Crooks, the 20yearold. Out of all the interviews, all the pages of documents and documents, theres one pressing question both democrats and republicans are still asking the Secret Service more than two months later. Why in the world would you let former President Trump go out onto that platform if you werent sure it was secure . Reporter chairman kelly referring to a quote from a Senate Report released yesterday, a secret Service Counter Sniper leader saw local police with guns drawn and was asked by senate investigators, did the Thought Epa cross your mind that you should inform someone to keep the protectee, meaning Donald Trump, from going on the stage or if he was already on the stage taken back, did that cross your mind. John lets bring in Congresswoman Laurel Lee from florida, a member of the Trump Assassination Attempt Task Force. She was in the Hearing Today. Would have loved to have seen mayorkas and some other folks testifying before congress today, but its good that you got to hear from the local authorities who were on the scene. What was your biggest take away from today, congresswoman . Today was an opportunity for the american public to hear from the local Law Enforcement officers who were part of the team that was on the ground to secure the butler site. One of the most important things you touched on, which was the lack of a unified command center. So Secret Service relies on these partners to secure a sight but that only works if they all have a Game Plan that they all have communication on the day of the event. So when something suspicious happens, theres something that needs to be addressed, they all understand and get that information simultaneously. So today really made clear that local Law Enforcement did not have the support, the plan and the communication that they needed from Secret Service in order to do their jobs effectively. John there was a lack of communication as you point out which has been noted many times in the past. Also the lack of instruction. Heres the Butler County Emergency Services Unit commander, seemed to make a lot of news today, particularly when he said this. Listen here. We didnt receive any direction from the Secret Service as far as how they wanted our Sniper Teams to deploy or what their actual mission would be. What was your mission as you understood it that day . As we understood it . It was to deploy Sniper Teams to overwatch the stage, the crowd, the Venue Area where most of the people would be gathering. John no specific instruction from the Secret Service and then we end up with the Agr Roof being uncovered. Exactly. So theyre looking out over the crowd and in that direction, and there was no specific instruction about securing that Agr Building that ended up being The Point of vulnerability. It was also clear that the perimeter was not nearly broad enough, that there were buildings that needed to be secured that werent secured. So in the coming weeks, well be hearing more from Secret Service. The Task Force itself has had the opportunity to receive documents, to get briefings but its important for the american public to continue to hear from federal Law Enforcement, from Secret Service and youre absolutely right, we need to hear from Secretary Mayorkas, the head of the department of Homeland Security who ultimately is responsible for making sure that Secret Service has the resources, the guidance and the protocols that they need to be successful. John so, you know, you probably herd David Spunt mention this but there was the idea that there was clearly a threat of some nature and yet the information was never passed to the president s protective detail that you might want to hold mogul from either going to the stage or maybe secure him on the stage because we have a Security Situation here. Heres what the senate Interim Report says. Quote shortly before shots were fired a secret Service Counter Sniper saw local Law Enforcement running toward the Agr Building with their guns drawn but did not alert former President Trumps protective detail to remove him from the stage. The u. S. Counter sniper told the committee that while seeing officers with their guns drawn elevated the Threat Level the thought to notify someone to get trump off the stage, quote, did not cross his mind. Protocol with local Law Enforcement is you dont draw your gun unless youre possibly going to use it, and if youre a Sniper Team on overwatch, and you see a bunch of local Police Officers with their guns drawn, that means, Ding Ding ding, theres a problem here. Thats right. Its really unfathomable that that kind of threat information, that that kind of information could be coming to them and they dont say, hey, timeout, lets get the president off the stage, get him to a safe place. And that could have changed everything. So that is one of the key points of failure. Of course we had the issues leading up, the issues of communication on the day of. But those minutes immediately surrounding shots being fired, how that information did not get to the people who needed it in the secret Service Team and why they allowed President Trump to take the stage and then stay on it, those are some of the most foundational questions. And heres why its so important. Because President Trump is still out there every day in the public talking to voters. And getting his message out in america. And so there needs to be a level of assurance that he is being kept safe, that the protective detail is doing the things that they need to do and that something like this isnt going to happen for President Trump or any of the other people who are under that protective detail. John one of the things thats been rolling around in my mind here is, we know Thomas Crooks came up on the Fbis Radar back in 2019. How many times have sites be left unsecured but there was just never a shooter there, trying to take out the former president. And then we see with Ryan Routh that he was in the area of trump international Golf Course in maralago for the better part of a month before he was found by the secret Service Hiding in the bushes. And what does that say about the intelligence regarding threats to the former president , particularly in light of this huge threat from iran that he was briefed on, and the Secret Service and Others Ability to be able to uncover and identify these threats before they get anywhere near the former president. And that is why only one of the things thats relevant to the level of protective detail should be status as a current president or former president. Thats one piece. But the second piece is, accepting the reality of the Threat Environment. And the Threat Environment right now, as it relates to President Trump, is extreme. We know that. Weve seen that. So at this point, he needs to be getting every bit of available resource to make sure that he is being kept safe, unto and including that which is assigned to the current sitting president. John i mean, these were a couple of miss fit Wanna Bibs who nearly took out the president imagine what a trained team could do. Thats exactly right and we know that there are foreign actors, we know there are people out there making these kind of threats. We know that it exits. And so it needs to be something that is front and center of everything Secret Service is doing and all available resources need to be put there to make sure that hes kept safe. Sandra back to our top story in New York, appeals Court Today Hearing Arguments to overturn the civil Fraud Judgment against former President Trump which could cost him nearly 500 million. The case brought by the office of the New York Attorney General, Leticia James, claimed trump and his associates fraudulently inflated the value of assets on financial statements for personal gain. For starters it was refreshing compared to what weve seen in the lower court trials of Donald Trump because the questions were actually substantive and thoughtful and they were presented to both sides and i have to say, my take away from this is that the 5judge Panel had concerns that the Attorney General, Leticia James, had really overstepped her bounds. They asked questions to the state, well, whats the line . It seems that the Attorney General went beyond what her job is and is interfering in the private transactions of citizens and what are the limiting principles . What kind of guardrails should be in place to make this not so subjective . And i thought the state struggled a little bit answering those questions. Sandra one of the questions is were there any victims. This is the judge in that case questioning that very thing if there were any victims in the Trump Case. Here it is. Really sophisticated bodies in which No One lost any money, and that was The Point of my initial question. Every case that you cite involved, whether it was damage to consumers, damage to the marketplace, youve got a scheme unsophisticated consumers to take out home loans, you have the collapse of Lee Man brothers. I think the statute itself is problematic because it doesnt require victims which means the person who is in charge and has the law on their side wielding that authority can subjectively determine what she thinks or he thinks is fraud or not and i think a good example of this was just how under how much they under valued maralago. This week has been crazy the un the Trump Case and Mayor Adams at that News Conference earlier reacting to what i think is a 57page indictment, we have it here against him. Hes been indicted. He says its pay back for complaining about bidens migrant crisis he says theres politics at play. Karine jeanpierre was just asked about this at the White House moments ago and she said this. Watch. Eric adams suggests hes being targeted by the biden administration over his criticism of the migrant crisis. Now this is the kind of accusation thats similar to what weve fleshed former president Donald Trump, so what is the president s reaction to that kind of language being used from a democrat . Look, we have always been very clear, the president was clear even when he was running in 2020 that he was going to make sure that doj is independent and dojs handling this case independently. Aim not going to go beyond that. Sandra so thats a new update to the story. Mayor adams has been federally charged ill lay it out on the secrete, conspiracy to commit wire fraud, federal Program Bribe ruchings and to receive Campaign Contributions by foreign nationals. Wire fraud, solicitation of a contribution by a foreign national. Theres also count four of the same. Count five, bribery. On the surface, on the face, these are very serious charges. Where are you on how big this is . I have a mixed opinion on the charges that doj brought. I think if the Straw Donation allegations turn out to be true which is, in this country, you cannot make a political donation in somebody elses name thats illegal and doj is alleging that Mayor Adams solicited foreign funding and they funneled it through people who claimed it was their money in order to fund his campaign and then he turned around and applied to a New York city match program, which gave him an extra 10 Million as a result that matched these illegal donations. So i think if thats true, thats a problem. On the Bribery Front . I have to say it felt a little weak at the Press Conference today, sdny spent a very long time talking about all these Flight Upgrades that he got and an occasional nice Hotel Room from turkey but then of course the immediate question is, okay, what did turkey get in response, what did they get from this . What was their benefit, because thats the crux of bribery, and the only thing that i heard was that they that Mayor Adams pushed through a Fire Inspection, said, okay, a building they want to be built in New York city doesnt have to have the Fire Inspection done right now. They wanted this building up and running when their president arrived. But the thing is the thing thats missing from this sandra is i dont know the context is is fdny no Tor Offslow in doing Fire Inspections . Is this a longstanding irritation that Mayor Adams has had with fdny for a long time . And, two, if its simply that he pushed through this building being up and ready without the Fire Inspection in exchange for some Flight Upgrades, i dont know. It seems a little weak. When you look at our cooperation, our attempts to sit down and cooperate. When you look at what has taken place, theres been a narrative of giving the appearance that there was something improper that was done and it was just wrong. I think this will be a huge distraction for his administration which he needs to consider but what also needs to be considered by the public watching this unfold is who would replace him and the person who would replace him is a known very antipolice activist which, at a time when New York city needs all the Law Enforcement they can get given crime, thats a concerning situation and im sure Mayor Adams is thinking about that considering he came back and wanted to clean up the city. So with every minute that passes, strength could be gaining. So marissa how are things looking there right now . Reporter i mean, if you look at just the weather, if you isolate this moment in time, its actually kind of nice. Its cloudy, overcast. Temperatures are down, its a little humid but its the south. But Saint Marks is of note. Mandatory evaluations in place, they wanted everybody out by 8 00 a. M. Especially those closer to the Saint Marks river. I am here at the Saint Marks river we are going to clear out shortly. Weve been watching the situation its calm on the river. Going into low tide all the river heading out into Apalachee Bay into the Gulf Of Mexico well see a shift and start to see water pushing in. One you have High Tide coming up tonight but also you have the water already rising and as Bryan Norcross is going to tell you, all that energy pushing up against the gulf and that is starting to make this water rise. As you can see as you look at the dock there, water where it shouldnt be and when you see the dock in general, if we have a verified 1520 foot Storm Surge this will be covered. This, im about 13 feet up, this will be covered. A lot of the boats you see here will be covered and shifted and potentially pushed into the marina. So mandatory evacuations into waculla county, they have no shelters because they dont want anybody this county the closest will be where tallahassee is but as expected were expecting impacts there mainly when it comes to the wind. John for The Big Picture here lets bring in Fox Weather Hurricane specialist Bryan Norcross. This thing took a bit of a turn to the right as it goes up into the Apalachee Bay not much there but looks like its going to hit Saint Marks and go into tallahassee. Reporter it will have effects all up and down the coast john. Two parts to the hurricane, one is the core here and the core is obviously where the strongest winds are and thats whats going toward north florida. Its going to come closer to tampa than it is to the Southwest Coast of florida right now. The other are these bands out here and these bands are producing wind gusts to 60 miles an hour just recently at fort myers, Fort Lauderdale had 62, the that will spread up the coast and some outer bands have tornados in them especially north. So this is going to take time. Whats happening already is the energy from this storm pushing water against the coast got us in the moderate Flood Stage already at naples earlier now the tide is going out this Big Push will happen later on today. Theres the size of the storm, see It Move to the north. Theres the forecast, 120 miles an hour offshore of tallahassee. Yes it could be 130 category 4 plus or minus, and then Tampa Area in the Hurricane Force gusts. So were going to watch the orange there for hurricane. Out there this is wind gusts up to 60 or so in the yellow. Now watch we go further north. This is tomorrow. Now were into atlanta, 65 mile an hour sustained, that makes gusts 85, 90 miles an hour in Metro Atlanta there which can take out power for an untold number of people because that part of the Country And None of North Georgia and all that upstate there is can deal with very strong winds. They dont have the trees for it, florida Palm Trees bend Oak Trees do not and the other kinds of foliage you have once you get well inland. John bryan hasnt been a bad Hurricane Season so far and now we see this Thing Pop Up i guess Theres Plenty of warm water there checking the temperatures in the Gulf Of Mexico still 82 degrees there even though its the latter part of september. Remember back in 1992 when we had one hurricane and it was andrew. Reporter yeah. So this is a whole different kind of storm than andrew. Andrew was a small storm like a big tornado, 20mile wide tornado. This is a giant hurricane in the top five of the ones we see at this latitude in the record book. Big hurricanes like taking your whole arm in the bathtub and moving the water compared your hand moving the water. This one will move water into the coast. South of tampa bay, sarasota area, All The Way around, life threatening Storm Surge forecast. As a matter of fact, All The Way down to the tip of florida, you could have dangerous Storm Surge. So thats all going to happen tonight. So were just in the early stages of this. John we talk about what might happen in the metro areas of Tallahassee And Atlanta after the storm makes Land Fall. But what about a lot of those little coastal towns, you know, apalachee may be a little too far west but definitely Saint Marks some other coastal towns there right there on the sand. Whats going to happen to them . Reporter yeah, well, theyve really gotten it the last few years right . Earlier this year we had debby which wasnt terribly strong last year edalia down to Tampa Cedar Key which has been there forever but this would exceed those Storm Surges that weve seen in recent history. You have to go All The Way back to 1896 in Cedar Key for a big hurricane. So this is unprecedented. For the tallahassee area, were talking about 1842 since a hurricane of this nature has come right off the gulf into tallahassee, which is only 20, 30 miles inland, not too much elevation. The Secret Service, again, this bass a colossal failure and i think they need to take a big look in the mirror starting at the top at the leadership. They are completely antiquated. Their Protection Model needs a complete revamp. Their way of using technology or the lack thereof, that needs a revamp. Their communications. Everything is outdated, it is not working and i am actually quite impressed that trump is still alive, because it seems like the Secret Service, frankly, has been quite lucky in the past. There was no accountability for the operations plan. The Lead Advance Agent just said, you know what . I dont know, we all just collectively put information in there but theres really No One completely responsible. How can you have an operation where the buck stops with No One . How is anyone supposed to say, yes, i did my job when you dont even have anyone to report to . There needs to be a very clear definitive way of communication. The locals, god bless them. They stepped it up. They were given little to no guidance from the Secret Service and they did the best that they could with what they were given. Sandra i want to play out some of the sound that we heard in that Hearing Room because it is something nicole. This is former Uss Agent Patrick Sullivan said the Lead Agent was responsible to ensure that the communications were appropriate for that entire visit. This was earlier. Listen. In my opinion, it was probably the Lead Agents responsibility to ensure the overall communication for the entire visit was appropriate. And that was not the case. Apparently not. Sandra yikes. It absolutely was not the case. The Lead Advance Hag no accountability and when they were questioned they said, oh, you know, it really wasnt my responsibility, i just did what i needed to do. But again the buck has to stop with someone and i think everyone is asking, wheres Secretary Mayorkas . And the fbis been stone walling this investigation, Wheres Director Wray . Have something i think americans might find informative. These two men have never, ever worked in Law Enforcement. Theyve never had the gun, the badge, the credentials, theyve never done an operations plan. Theyre literally former u. S. Attorneys and im sure they were outstanding former u. S. Attorneys but when youre charged with leading these Law Enforcement agents and dont have a Law Enforcement background it makes it difficult to address the american people. So instead they send out the Deputy Director of the fbi and acting Director Rowe to come out and address things and as we saw today, actual Law Enforcement officers that were there on the ground, they understand their responsibilities, a former Secret Service with a stellar history is out there saying this is what should have happened and i think thats also, the leadership in this country and our 3letter agencies, we really need to look at the leadership from the top All The Way down and put people in there who are competent and able to lead these organizations and give the resource toss the Rank And File so that they can do their job. Sandra when you say competent i think about the portion where we learned there was a Drone Being flown by someone very inexperienced within the Secret Service who had to call a toll free number to get help at one point. This is a fascinating exchange. This is the Butler County Emergency Services Unit, nicole, the commander of it, Edward Lens saying the Secret Service never checked in with him. Watch. Youre the leader of the local Law Enforcement on the ground there right. Just the tactical units. Did anybody check in with you to make sure your guys were in the right place forthe event. They did not check in with me. Us Secret Service is about to pull a Security Detail with a former president at an event with a heightened risk of an international threat and they didnt check in with you to make sure your guys were in place and ready to go.
