By going to the Libertarian Convention and trying to make the case for these voters, i think it is smart. You saw tran 11 take a lot of verbal views. A criminal trial against alec baldwin is looking like dash likely after they reject the request to dismiss the Criminal Charge against the Fatal Shooting of the scimitar preferred the filming of rest. The judges decision means alec baldwins case is on track for a trial this summer. A new mexico judge ruled that prosecutors had not acted in bad faith when securing a grand jury indictment as alleged by the defense and their motion to get the case tossed. During a tense may 7 hearing baldwins defense team argued that the prosecution kept jurors from Hearing Evidence that was helpful to baldwins case. The lead lawyer claimed jurors were not told they could question defense witnesses. The lead Special Prosecutor pushed back saying the claims were a misrepresentation, arguing that nothing was hidden from the grand jury. The judge ultimately ruled that the indictment against the actor will stand. Nearly three years ago during a rehearsal on the movie set, baldwin was holding a prop gun that have been loaded with live ammunition, a revolver went off killing the cinematographer. Theres a Jury Instruction that says one party is the primary or substantial costs of the death of somebody that you cannot have a Second Person be responsible for that. That is what i would be arguing if i was alec baldwin to get out of this case. My second point would be, look, david halls was a producer. The person that gave the gun before baldwin. He copped a plea deal for negligent handling of a firearm which is a misdemeanor. That is what the prosecution should do what baldwin if they cut a deal. Captain plead to a misdemeanor and get this case over. I dont think we are done yet you have a really good point there. Lets talk concert tickets. The Department Of Justice filed an Antitrust Lawsuit against live nation ticketmaster. Here is attorney general garland not only deploying tactics to artist and then use to use services that charge fans excessive fees. It is also worked strategically and illegally to eliminate the threat of potential rivals from emerging across any of its businesses. How do you think this will go yeah, i think the doj has a lot of traction on this case. Unlike recent lawsuits against amazon and google where i dont think the doj will prevail. I think they may prevail on this case and here is why. You have to prove there is a monopoly. That is easy. Live nation owns 40 of the 50 Concert Venues across the country. They also act as promoters and they have ticketmasters to act as ticketing. They clearly have a monopoly. What has to be proven as they have gained marketshare as opposed to organic competitive growth. That is where i think live nation will lose. Why . In this complaint it was very well written. There were emails with this Company Called Openview Group where they were promoter. You can see that live nation was bullying them on not promoting certain artists. Those two ended up colluding and now they are part of live nation the statement that garland was making made it sound like he was talking about the mob. Let me put out a statement. They did respond in part saying this will not fix ticket problems. Calling Ticket Master Them Monopoly may be a winner for the doj but it will lose in court. The fact that the bulk of service fees go to venues and competition has steadily eroded ticketmasters market share and profit margin. You just pointed out there is not much competition left out there because of the way they have been accused of behaving. Well, that statement is an oxymoron. There is not a lot of competition because live nation is allegedly gobbling up all the other promoters and venue owners another quick point, you know, when it was alleged here, live nation withhold artists from performing at certain then use and less they agree to have live nation promote them.
