All of the defendants have been charged with violating georgias racketeering law, which carries a maximum Prison Sentence of 20 years. In addition to the mr. Trump, the indicted defendants include his former white house Chief Of Staff mark meadows and some of his former attorneys, including Rudy Giuliani and sidney powell. The 98page indictment lists scott mccafe as the judge who will be presiding over the judge. Appointed by republican Governor Brian Kemp and joined the Fulton County superior Court Earlier this year. Hours before the jury handed up the indictment an incomplete document listing the same charges briefly appear dollars on the Fulton County clerk of courts website before abruptly being taken down. My colleague bryan llenas pressed the d. A. On what happened. Can you tell us more about that Document Leak because now you have the former president s lawyers saying this is emblematic of a serious problem with your office. No. I cant tell you anything about what you refer to. What i can tell you is that we had a grand jury here in Fulton County. They deliberated until almost 8 00, if not right after 8 00. An indictment was returned. Trump attorney alina habba says none of the defendants was given any advanced notice on the indictments before news broke on tv and online. The d. A. Is giving the defendants until noon on august 25 to voluntarily turn themselves in. Steve, ainsley, and brian, back to you. Steve hey, jonathan, i know they included a punch of Security Measures around the courthouse where you are right now. Just in case there was trouble. Was there anything . In fact, there was a small protest yesterday, unrelated to what was going on in the court protest against this Police Training center under construction outside of town. Knowing the National Media would be out here outside the courthouse they took advantage of the opportunity to protest. Steve you mentioned the story so they got what they were trying to do. Jonathan, this is not a surprise denied knowing anything about it noteworthy. What stands out to you . I did find that statement by a District Attorney to be baffling, to say well, i dont know anything about the Clerks Office this was a premature publication of the indictment its a serious mishap. You think she would be somewhat curious about how that happened. The indictment as we expected founded on this broad racketeering claim. 18 individuals charges. Willis charged everything and allowing everyone and allowing god sort them out. Look at this indictment. Every call, every tweet, every speech seems to be criminal act that composes this conspiracy. That raises really troubling questions as to the criminalization of the challenges to election. You know, i have been covering president ial elections a long time. I cant even remember how many. But, in every single president ial election, we track challenges by democrats, by republicans. Some of them are based on strong evidence. Some are not. Even in this election, you have people like marc elias for the Democratic Party after this these acts allege that Voting Machines in new york were at the were the cause of flipping an election. And challenging that election. Was that a crime . Of course it wasnt. It was a challenge. They were looking for judicial review. So its a very troubling indictment. Ainsley jonathan, they waited two and a half years to do this. If they had a problem, our question is why didnt they take this to court two and a half years ago . Why wait in all four of these indictments until a year before the election knowing these court cases are happening next year when well all be going to the polls in november . I think thats a fair question and former president in his rights to raise it. This indictment, obviously, could have been brought long before yesterday. It seemed to have been timed to hit right in the middle of the election. And now we have a pile up. This president is being really pursued, pillar to post, across the country in different jurisdictions. Theres going to be a reaction to that. I mean, there is this is a very troubling thing to watch. The thing about georgia though that i dont think the trump team should discount is that this has legs because it was brought under the racket tearing statute, its going to be very hard to getten an Appellate Review to knock this out on threshold largely fact questions. The prosecutors argue let us prove our case let us bring the evidence together. The chances of this surviving a review are likely quite high, at least in some form in the d. C. Case the judge there could cause a similar problem. She could make it difficult for trump to get to the court of appeals on the Supreme Court on what i think are major threshold questions. Unlike georgia, jack smith is creating new law. And its not going to please a lot of these higher courts. In georgia, this is a state action. Elections fall within their pursue. Thats according to testimony from a former fbi agent who says i felt it was people that did not need to know about our intent. I believe that the Secret Service had to be notified for our safety, for lack of confusion, for deconfliction which we would do in so many other ways cases but i didnt understand why the initial notification. Thats james comer over at the Oversight Committee even more mad at this Special Counsel weiss. He says the Oversight Committee has no confidence in u. S. Attorney weiss as Special Counsel, given his inability to prevent the Biden Transition Team from being contacted and federal agents were not permitted to interview hunter biden as planned. But, to all of this, white house officials are still saying its just a big distraction from the issues impacting americans. If you think about what republicans in congress have tried to do for years, right . They have been making claims of and allegations, right . About president on this front and whats been the result of that if you ask yourself what we have seen from that . They keep turning up documents and witnesses showing that the president wasnt involved. Never discussed these Business Dealings and did nothing wrong. Theres been zero evidence showing showing otherwise. And hunters lawyers are now saying that part of that plea deal the prosecutors appeared to say was dead is actually alive. The part that keeps him out of jail for a gun charge, hours republicans wrote to the doj asking for details about that plea deal. They got a letter back from the doj. When hunter biden would call his dad and put his dad on speaker phone, that was what a loving father would do. And i thought about that question because peter doocy asked the president about hey, when you would get your dad on thewhen you would talk to hunter on the speaker phone, about business and he goes i never talked about business. Well, now abbe lowell is admitting that joe biden and hunter biden talked to his Business Associates on the speaker phone. I agree with abby when my children fleece foreign i always get on the phone. Ainsley beach house in delaware. You know. The problem here is the moving of the goal post. You know, and the contrast is, of course, extraordinary. Trump is being indicted for everything short of ripping a Mattress Label off. Brian thats next. Yet, the Department Much justice seems to be waiting for a virtual confession from the president in order to bring an indictment. Its a very weird contrast. But, this is becoming so serious i think its going to be harder and harder for the media and the Justice Department to continue to deny this. The president said for years to the public he never spoke to his son about foreign dealings. Right. Recently devon archer said that was categorically false that the president knew about their dealings. Other witnesses said they had met with the president , had dinners, including one who said he discussed the family dealings. All of these narratives are collapsing and then they put up, yet, another one. Well, the loving father narrative is just not going to do it. You know, the house is now documented at least 20 million going to the bidens. Its going through a series of accounts, a couple dozen accounts that seem designed to hide those transfers. And all they can say now is well, can you show a picture of him receiving an envelope of cash or a deposit slip to an account by joe and jill biden . There are witnesses that have been cited that said they were told not to refer to joe biden directly. Not to make any payments directly to him. And why would you set up all these accounts excepted for that purpose . You know, they are there. So that you dont have that type of paper trail. Brian does circumstantial matter . Does that matter, circumstantial . Well, this is a pretty strong case as it is. And, yet, the Maker Garland just refused to extend the mandate. We had he appointed a Special Counsel that flipped the regulation on its head. You know, he picks someone who is literally being looked into by congress for alleged fixing of the prior investigation. And, yet, garland still will not say that he should investigate all of this. And get it all out. Instead, is he focusing on hunter. Ainsley Alan Dershowitz said the strategy is to get the conviction before the election. I used to tell the students if you bring ricco case it increases your chance of winning a trial and losing an appeal. If we get a conviction before the election, then it goes to an appeal that wont happen until after the election. Is this going to help or hurt him if he ends up getting convicted . Look, i think that this is obviously helping him. The American People dont like to see this. This is what you see in a lot of other countries. You know, the willis indictment has legs in the sense that it tends to be more iron plated because these are conventional state charges. That doesnt mean that its right. When you look at this indictment, its charging everything. Every call, every tweet, every speech. You know, the president is allowed to challenge elections. He is also allowed to be wrong. And there is no there is no clear principle or dividing line of when challenges will now be criminal and when w they will be allowable. Ainsley one more question why 18 codefendants . What did they do wrong . I think, once again, this is a very typical approach to a racketeering case. You charge everyone. And then you pressure a lot of the codefendants. Steve squeeze. To flip. We have multiple fires that are still burning by the way warm today, temperatures into the 80s, 90degree range and with the humidity its going to feel in some cases oppressive for hopefully the rebuild. The seasonal temperatures are close 90 degrees and with the humidity its going to feel higher than that the wind gusts thankfully have come down. We observed winds in excess of 08 Miles Per Hour on the western part of maui and we have rain in the forecast, which will be helpful for firefighters; however, we are not getting it into lahaina on the western side of the mountains. Eastern side getting rain but not the beneficial rain that they really need to help firefighters get the upper hand. We have been into a drought certainly in this region for the last several weeks. We are hoping to get more rain in the forecast. I want to point out we do have a Tropical Storm that is south of the islands. This will not impact the islands at all because its going to be weak and we are not going to feel those wind gusts of a hurricane we will monitor that. The pattern in place to spread the wildfires so rapidly. We dont have the same Weather Pattern in place today. So thats the good news. And nothing happened. The fbi tiptoed around her. They gave out five Immunity Agreements with no cooperation requirement. They did not pursue her. And she was one of the biggest Election Deniers out there she was out there saying that donald trump was an illegitimate president. And i have heard a lot of democrats out there say that. Probably the most egregious example to me is Stacey Abrams. You know, Stacey Abrams ran for governor and was beaten by brian kemp. It is kemp that is the governor. But she has never accepted that. She talked about how illegitimate that was you compare what she said, to what she did to what donald trump did and try to tell me and convince us there is equal justice in this country, it does not add up.
