We are looking at 300point gain right out of the gain as investors await key Economic Data including personal income, Consumer Spending and allimportant september jobs report, of course, also the beginning of the Fourth Quarter. Joining me ed and joining the conversation all morning is Payne Capital management president ryan payne and pollster and president of maslansky partners, lee carter. Great to see everybody this morning. Ed, lets quick it off with you. What do you think drive markets in the Fourth Quarter . We have been in a classic correction. The market had a meltup as a result of all the easy money provided by the fed and on top of that we had a very big stimulus package. Unprecedented really, to have that kind of combination, some people call it modern monetary theory. Whatever you call it, its a lot of money. A trillion here and a trillion here. We had a meltup right up to september 2nd and i think investors realize that the market was ahead of the fundamentals and that there was some concerns up ahead here like, you know, are we going to have worse virus during the fall and is the economy going to stall. We need answers for known unknowns and we will get them very shortly. We had a bit of a direction here. At end of the day if you get money out of the market, its compelling to take advantage of any selloff and use that as buying opportunity. Maria great point. Big week this week, ed, you have the president ial debate on tuesday night, the president and former Vice President joe biden to square off in first of 3 president ial debates and what impact will these events have on the markets if any . I think that the debates could be extremely important. Kind of reminds me of the first televised debates that we had between kennedy and nixon. People who listened in on the radio thought that it was sort of a tie, but anybody who watched it on the television thought kennedy won hands down. So here we go again with televised debate. Weve had lots of them along the way but this one could be just as a momentous as kennedynixon. The question is is either one of them really going to get rattled and come out the loser in the whole thing. I think the debates could be extremely important. You know, i think the reality is a lot of people will be tuning in. This could bring super bowl ratings. Maria zeroing in on policy, specifically, ed, what do you think the markets want to see . What policies do you believe investors want to see penetrate in the years ahead . Ed yeah, i think investors are a little torn. I think theres a widespread view that we need another stimulus package from the from the fiscal side and yet at the same time i think the market would like to see more gridlock coming out of this election. I dont think the market would like to see a democratic sweep where the democrats have the white house and both houses of congress. So i think gridlock no matter who wins is something that the market would prefer. Maria yeah, and then youve got wall street biggest companies, tech companies, really, leading the market. Facebook, apple, amazon, those Companies Google and microsoft on worst month ever according to dow jones data. Do you think the names come back Fourth Quarter 2021 . Ed i think to a large extent it was a valuation issue. Hanging over their heads especially the social media giants have been the potential for regulation and thats still possible once either trump gets reelected or biden enters the white house. Theres a lot of calls for the government to regulate these social media giants. But, thats been hanging over their head for over a while and they keep hanging more revenues and they are leading the way. I call them the magnificent 5 and i still think they are magnificent. Maria lee carter, what are the things that you will be watching for, lee carter . Lee im looking for a couple of things. Up until now we heard joe biden and donald trump attacking each other and not laying out agenda. Its important to talk about exactly on what they are going to do and joe biden especially, has spent most of the time attacking donald trump and i dont think thats enough to get him elected. Im ready to hear how hes all about and how he will present himself. Its important that he stops being on the attack on start laying out his stand for america. A lot of people are uncertain. Only a third of americans feel that they know what joe biden stands for and what hes going to do should he get in office. I think its critical that he gets the message out there. I also think that the expectations for joe biden are very, very low, and so if he has a decent night, i think a lot of people will be spawning over here and thats not necessarily a good thing for donald trump. Maria yeah, i think thats great point, actually, really, really spot on. Ed ive been bullish for some time and its a little late in the bull market going from all cash into equities but anyone who sold out i would go back in. Maria we will be following. Thats time for morning mover wpx energy, the company is in talks to merge with devon energy, create 60 billiondollar, dveon Energy Rising slightly on the news. Maria welcome back, no john durham interim report before the election and any indictments are unlikely before the november 3rd election now 36days away. My sources say john Durham Report on origins of russia probe will not be released because it is too close to the election, many people saying within the doj, pushing back, saying that it will now be viewed as politically motivated. I spoke with Senate Judiciary chairman Lindsey Graham yesterday on sunday morning futures and here is what he said. Your reaction to the breaking news this morning that i have reported from my source that is we will not hear anything from john durham before november third and the election. We found in the last two or three days that the russian subsource was actually suspected by the fbi of being a russian spy all the way back to 2009. They never told the fisa court that. The fisa application given to the fisa court completely misrepresented the subsource, who he was and what he said and all the evidence collected was never given to the court. Thats a breach of duty by the fbi and the courts, i would be shocked if somebody isnt shocked by the court but thats up to mr. Durham. Maria joining us federalist editor Christopher Bedford. You know the other side is going to say its politically motivated and john durham is facing off with doj lawyers that say its too close to the election. Whats your take on where we are today on all of the new bombshell testimony that was released on friday from mr. Barnett. Chris i think a share a lot of your frustration. I was hoping the report was going to be out weeks ago. The timeline keeps on getting pushed back. A lot of the country will call this political anyway. Investigation of the former of what was done to President Trump when he was running for office and then shortly afterwards. These are things that American Voters should know, but then again how much of america hasnt made up its mind one way or the other right now on this election, whats coming next. If theres anything that could possibly remove accusations short of history books, that would be grateful. They are undoubtful that that would happen. Any bombshells before the election, it looks like we will have to look to senator grahams investigation. Maria yeah, lets talk about some some of the texts that we that were released as part of barnett interview. This was a case against Michael Flynn, on friday doj released the documents related to unlawful surveillance of carter page and the sources used in the steel dossier. Later on in the show i will be speaking with Michael Flynns attorney Sidney Powell. But, chris, lets talk about what you what struck you most about this this testimony that was released from William Barnett of William Barnett . Chris the idea the question why exactly so many Text Messages appear to have been deleted before the investigation began seemed to have been revealed by Text Messages and testimony since that this was a bad investigation and people on it were word or at least the more fair people were worried on what its going to look like when its pulled out and sees the light of day and the idea that we learned from the testimony that the healed investigator felt that the whole thing was to get trump and was politically motivated, this is something that we have been talking about for years im assuming and right now we have per information to back that up and from the agents own mouths. Maria yeah, for sure. Chris, thank thank you so much r weighing in this morning. Christopher bedford from the federalist. Thank you. Ballot concern on november third. Keeping it real, check this out. Paltrows birthday post on instagram, its making a buzz, we have it for you. The beautiful bath youve always wanted, done right, installed by one expert technician, all in one day. But is it secure . Sure its secure. And even if the power goes down, your connection doesnt. So how do i do this . You dont do this. We do this, together. Bounce forward, with comcast business. Maria welcome back, a month away from 2020 election. Concerns are growing about mailin vote. I spoke with Kevin Mccarthy about the stakes of this election. You want to talk a bit about araceli what you believe is at stake . Youll need a ninth voice, right, youll need a ninth voice if this election is contested . You need that. Weve watched that many times before and i think everybody in the country knows its a different situation. You have so many state who is are now using mailin ballots who are not prepared for it. We watch the horrific job that new york has done where they disqualify people, we have seen ballots that vote for President Trump signed. How many times would that happen. They are not prepared for it. We need a court thats filled and have separate government where they can make a decision. Maria they dont want to meet with acb . Lee yeah, i think its a fascinating issue because just attitude towards covid this divides party lines. Democrats think mailin ballots think they are important and republicans have a concern about them. The concerns are valid. We all have heard stories or no people who have gotten mailin ballot incorrectly,i know people who have homes in two different states and have gotten ballots in two different states. The election can be very close. If you think of what happened in 2016, the difference between donald trump and Hillary Clinton was 7,000 votes ultimately. We have to make sure that every vote counts and we have to make sure that people have access to vote safely and fairly. And so i think all concerns that maria especially, lee, since weve seen evidence of wrongdoing. Ag barr told me earlier this year that mailin ballots open up the flood gates to fraud. Weve got the new report this morning by project exploring ballot harvesting, ilan omar, a car full of ballots, whats your reaction . Wow, a car full of ballots. I feel like theres got to be a way to do this safely. You can do notaries online. There has to be a way where you can do it legitimately where there isnt frowned. With government being bureaucratic, not sure they can do it. I dont think you can fight that trend even when it comes to the election, even when it comes to voting here. Maria thats a good point. We will slip in a break. The fate of tiktok, we will take a look back on the pushback from the judge, stay with us. Rally underway, futures indicating gain of 350 points right out of the gate for the dow industrials, the nasdaq is up 186 and s p higher by 42 and a half points this going into the end of the quarter, wednesday marks the final trading day of the month and of the Third Quarter, friday, of course, we saw a big rally, pretty good green largely boosted by technology move that pushed the nasdaq into positive territory for the week. The dow industrials were up 358 points on friday and nasdaq up 241 and s p 500 higher by 52 points on wall street friday. Global markets this morning have momentum, take a look at european indices in the green boosted by investor optimism in the Banking Sector. The cac quarante is up 97 and dax index higher by 341, asian markets mostly higher as well despite new sanctions by the United States against chinese chip makers which will talk about coming up. Meanwhile this former fbi director jim comey to get grilled this week of the russia probe. Cheryl good morning, comey will testify before Senate Judiciary committee on wednesday and former second in command mccabe has agreed on october 6th, this comes after interview revealed that an agent criticized investigation into former National Security adviser Michael Flynn accusing investigators of having a get trump attitude. Well, Nieman Anaheim nieman s out of bankruptcy. Now board of directors and jeffrey will continue to serve as chief executive officer of the Nieman Marcus group. Well, uber scoring an important victory if london, a judge overturning ban on ridesharing app. Last year regulators refused to renew ubers licenses after finding unauthorized drivers picking up passengers. Uber fit and proper to hold a license in london. And finally theres this, amazon has the date for biggest shopping day of the year. Prime members will have access on 1 million deals. Amazon originally postponed the sale after the coronavirus, unprecedented stain, take a look at amazon on premarket, maria, stock is up more than 1 and a half percent. Those are your headlines, over to you. Maria cheryl, thank you so much. Bit of a victory for tiktok, a federal judge blocked Trumps Administration to ban tiktok downloads in the United States, this just hours before the policy was about to begin. This gives more time to get approval for a deal with oracle and walmart to obtain u. S. U. S. Operations. Joining me right now Atlas Organization jonathan t ward. Jonathan, thank you for being here. Isnt it interested to see the pushback on the president s ban on the tiktok app, whats your take on what took place last night . Jonathan thanks, maria, the judges ruling has not made public but what the legal people are saying and this was filed if august and a couple of weeks ago you have the communist party talking about strengthening ideological guidance. They say that the Companies Need to maintain high level of consistency, political principles and paths, you have the Party Strength easing private sector in china and this all misunderstands the relationship between private company and the Chinese State and reverberates through every aspect, whether youre investing in china and doing business there and you have to understand how the companies fit into the actual system of the peoples republic of china. I think the complaint puts the wrong foot forward in that regard and its a matter of time before they can successfully argue the case. Maria well, whats your take on the departments move that they have to obtain licenses before exporting china, semiconductors, a blow to china and efforts to compete in advanced technology. Your take on where we are in this fight, china and the u. S. And you said it first here that you think that this fight is going to play out in corporate america. Jonathan thats right. Corporations are going to be drawn into this because at the end of the day this is an economic competition and semiconductors is one of the key strategic sectors. Its a place where the United States has a genuine lead. China cannot yet do what we can do in semiconduct os and they cant do what other democracies can do and the idea that they will continue to have access to all of the materials and use that to strengthen base and civilian sectors as they expressed in china 2025. We will have to start cutting import to their progress on industry and military power. This is one of them. Theres a lot of tools that can be deplayed. Maria what do you make about the story in the journal about Chinese Companies headed home to raise money. Some of the most valuable u. S. Listed Companies Selling stocks in hong kong as hostility between United States and hong kong are rising. A unit of alibaba going public, thats a big deal but, of course, the bankers, they are hoping to get that business and they are in the United States, banks like jp morgan and Goldman Sachs and morgan stanley, but this deal is going to be gigantic in hong kong. The companies will not comply with sec law they would be delisted. They understand that. In some respect its big win for hong kong and shanghai financial centers. Whether or not we are going to fund the growth and the rise of peoples republic of china even as we come to recognize that this is a National Security adversaries. This is a hostile state, hostile to the United States and many of its neighbors and to have us tied together financially, thats really the next big battle that the u. S. Has to fight, is making sure that we are not funding the further rise of china. If we do, we will bring in chinese and nothing we can do to stop it. Maria ryan payne, since november 8 Chinese Companies that originally went public on New York Stock Exchange or the nasdaq have added listings in hong kong, theyve raised 25. 6 billion, theyve got a market cap of nearly 1 trillion, thats alibaba, yum holdings, knowing that they are going to face resistance in new york, lets raise money in hong kong. Ryan yeah, i wonder what that means for u. S. Companies like apple that get most of their equipment out of china and you look at all of the investment from u. S. Companies in china right now. Jonathan, do you see a place here where we will start to see companies actually withdraw from china because it seems if anything theres been more investment china by American Companies over the last couple of years not less . Jonathan well, i think they should be doing a sequence withdraw when it comes to supply chains. Those are all at risk and we should understand riskics poe sure to china, whether its revenue like, what their supply Chains Really look like and aggregate risk of being in American People operating in peoples republic of china. This is a country thats building a military thats designed for conflict with its neighbors and talking about seizing taiwan. I mean, these are the kinds of questions that people really have to take seriously. You cant just have china as a market and ignore chinas military goal and chinas strategic ambitions. Thats going to be that will get plenty of companies in trouble. An entire decade where china marks forward on invested goals. Maria jonathan, we will leave it there. Great insight. Thank you, sir. Jonathan ward, founder of Atlas Organization. Quick break and then Big Technology innovations, one companys predictions for the future using ai technology, Artificial Intelligence. Maria welcome back, big tech transformation, ibm out with 5 and 5 Tech Innovation predictions they include using advanced Computing Power and recreate fertilizer, rethink batteries and computer parts and how we tackle deadly viruses, joining me right now the head of ibm research dario gill, thank you so much for being here. Hey, good morning, maria, pleasure to be here. Maria the last time we spoke i was researching my special on Artificial Intelligence and you took me to the ibm ai lab and showed me innovations at ibm lab. How do you think things will change in 5 to 10 years with regard to technology, dario . I remember the visit very well and im from the laboratory and what we are looking is computing, most exciting time since First Computers were created in 1940s and 1950s and what is happening we are using all of the machines that we need and love plus Artificial Intelligence and in the near future we will be integrating quantum computing as well and the combination will afford us a any way to do scientific discovery. We can apply it to solve problems that really matter to all of us and the examples that you just gave of building better batteries that are longer lasting and safer or creating carbon separation membranes that allow us to do Carbon Capture as example and to be able to, you know, deal with pandemics present and future are good examples of what you can do with revolution and computing. Maria so the new computing will work along side humans and enable humans to be that much faster . Thats right. You look at discoveries for looking for something new and we know it involves lots of people. Scientists like us, but also its onerous and takes a lot of time. To develop a new material, it may take us Something Like ten years and 10 to 100 million of efforts and expense to carry it out. What we want to do is partner with humans so that we can do that that much faster, 10x faster, thats power, complementary capability to allow us to discover better. Maria so tell me what else is possible, what industries, dario will see change as a result of technology, its not just tech industry, technology is in every industry basically. It depends on the ability to, you know, to compute and analyze and and to predict, i mean, it basically touches every sector, right, but to concentrate, for example, on the pretics that is we have put forth in the world of materials, companies in Life Sciences will be imaffected. Manufacturing companies will be impacted and logistic and Automotive Company that relies on future of building better and better battery technology, the acceleration of the discoveries thats going to be be made possible by the advents of Artificial Intelligence, so it will literally touch every sector of the economy. Maria so so bottom line here, dario, final question here, what is the biggest change that we will see as as a country in terms of technology . I really believe that the advent of what is going to be possible by using Artificial Intelligence to allow us to imagine new scenarios like hypothesis generation to complement what humans can do coupled with quantum computing which would allow us to solve problems that were unsolvable before. That powerful combination is new basis of competitive advantage for our country because with that we would be able to affect the material world, perhaps my last thought and t interesting, we apply for digital, the world of websites and so on, applying now, computing to the physical world so that we can engineer new materials to build new industries is such a powerful thought. Maria it really is. Dario, great to have you on the program. We will be watching. 36 days to go, the 2020 election is a month away and both candidates preparing for first debate tomorrow night. Gwyneth paltrow going all natural, we have the photo, back in a moment. Maria time for the morning buzz, first up a birthday suit for birthday celebrations, Gwyneth Paltrow turned 48, look at this. Ryan, what would your birthday Instagram Post be . Ryan inspiring maria she posted herself naked. Reign reign i think its aspiring and brilliant marketing scheme because she does have beauty product. Maybe its a great idea i do the same for my birthday this year but i feel like its not beginning to have the same affect over my client base. I dont know. Maria okay. [laughter] maria next up fake fans for the win, the Denver Broncos added cutouts of characters of the hit show south park as fans in the stands for yesterdays game. This is hilarious, the creators of Comedy Central show are both from colorado and huge broncos fans so they purchased the cutouts for big game. Lee, what do you think of this as creative substitute for real fans . Lee i love it. I think its fun. You know, one of the things, its hard to watch sports without fan base there and i think its creative and something to look forward and so clever. Maria yeah, i think thats great. Finally social distant trick or treating, one texas couple decided that coronavirus would not stop them from celebrating halloween, their favorite holiday. They created a candy cannon to make sure kids get their candy while keeping their distance and candy robot. Lee, creative way to save halloween. Lee i love it. I know the kids this year are struggling figure out how to get some sense of normalcy and necessity and i think this is awesome to see how people will do this, great for the couple. I hope this is a wild success and id love to see how more people will be able to make sure that our kids are out there having a great time on halloween this year. Maria thats the thing. People know that theres no trick treating now. Theyve got to adapt to the coronavirus. Thats what we are doing, ryan. We keep adapting. Ryan exactly right, exactly right. Necessities is mother of invention. Im all about the candy cannon, i want to get involved somehow. The 90 minute debate in cleveland hosted by fox news channels Chris Wallace will have President Trump facing off against joe biden over a slew of issues including the Supreme Court pick, the economy and the integrity of the election. President trump issuing a challenge to the former Vice President ahead of the faceoff. Im willing to take a drug test. I think he should too. Because hes had a very uneven i watched him with some of the when he was with, you know, debating pocahontas and harris who treated him so badly but i watched him and he was out of it, right. And then i watched him against Bernie Sanders and he was okay. Maria the Biden Campaign issued this response. Vice President Biden intends to deliver his debate answers in words, if the president thinks his best case is made in urine he can have at it, from the Biden Campaign. Joe biden takes a break from the campaign trail today while President Trump will give and update on the coronavirus this afternoon. Confirmation hearings for President Trumps Supreme Court nominee, amy Coney Barrett, will begin october 12th according to Lindsey Graham. This as the Senate Minority leader Chuck Schumer said he will not meet with judge barrett at all. I believe, first, that the whole process has been illegitimate and, second, because shes already stated that she is for overturning the aca. Maria Kirstin Gillibrand along with Richard Blumenthal say they wont meet with judge barrett, accusing her of wanting to he overturn obamacare and roe v wade which is not what she said at all. The number of deaths due to coronavirus approaching 1 Million Worldwide. This as wisconsin, utah, or rejohororegonreport record cas. Several states are of moving forward with reopening plans, new york starting limited Indoor Dining on wednesday, florida, starting on friday, there wont be restrictions on restaurants, bars and nightclub capacity. A federal judge hits the pause button on the trump administrations ban on downloading tiktok, hours before it was supposed to take effect. Joining the conversation all morning long this morning, ryan payne and lee carter. Great to see you guys. Its time for the word on wall street, top investors watching your wallet. Joining me now is head of Global Research Katherine Rooney vera. Macro strategist, len oore hawks and troy gieski. Stimulus talks are further stalled. Republicans are aiming to confirm judge amy Coney Barrett before the 2020 election. Katherine, well start with you. How is this affecting markets . Couldo you think this means we t get a stimulus package . Any distraction from the negotiation of the stimulus package, maria, is negative for the markets and i think thats what we saw after Ruth Bader Ginsburg passed. The markets got jittery precisely because a lot of people thought that the third stimulus package would possibly be tabled and i think thats effectively the case. The distraction now is replacing rbg with amy Coney Barrett. I think its phenomenally impressive that were talking about an illegitimate constitutional mandate. The sooner we get this done, maria, i think the markets going to be looking towards the next fiscal package which i think is inevitable, perhaps it doesnt come before the election but over the course of the next several months, i do think its in the works. Maria the upcoming president ial election impacting markets, depending on what policy persists after november 3rd. Youve got President Trump and joe biden set to debate for the first time tomorrow night as some Analysts Expect Election Results could be delayed due to the influx of mailin voting which could lead to market volatility, troy. How are you expecting all of this to play out . If democrats take the presidency, the house and the senate, and we see a sweep, wont markets sell off because of different poll of sighs . Policies . That would be the h kneejerk reaction. In this case, if we do get an election result thats not contested thats the key. Pennsylvania is arguably going to be a big mess, similar to florida in 2000. Lets assume its a clean sweep. That means well get a pelosi style stimulus in the near term. I think markets in the near term will focus on the larger stimulus and not necessarily sell off its going to take a little while for markets to start focusing on higher Corporate Tax rates as well as higher Capital Gains tax rates. In the short term, whether trump or biden wins, as long as its a clean outcome we expect markets to rally on what will finally be a passing stimulus. Maria i dont agree with that. I dont think you can see the markets where they are today at 27,389, troy, if you didnt have a belief on wall street that these policies are going to continue, that the president s low tax, low you know, deregulation, turning on the energy spigot, his focus on jobs, will not be the focus after november 3rd. Do you disadegree with that . Well, again, in a typical election if not for the coronavirus, if not for the fact that we do need another round of fiscal stimulus, youre 100 correct, maria. Markets would focus on the changing tax policy, more regulation like we had under the obama administration. These arent normal times. The key is getting back to peak gdp. The more stimulus we get, the faster well get there. We think that will be the key focus post election and at some point in early 2021 markets will begin to focus on the fact that Corporate Tax rates are going to go up meaningfully, Capital Gains tax rates will go up and the tax rates on the upper 2 or 3 will go up as well, that will start to impact markets we think in q1 or sometime in q2. In the shortterm a clean election with a fiscal stimulus package should drive markets higher. Maria meanwhile, jobs are in focus. Weve got the september jobs report due out this friday. Estimates call for 850,000 jobs added to the economy in the month of september and Unemployment Rate ticking down to 8. 2 as the market recovers from the coronavirus pandemic. Lenore your thoughts on the upcoming jobs report this week . Will that be a market mover . I think the markets have been focus on not so much the economy as its really been about liquidity. If we look at the fundamentals of the economy, the level of uncertainty, looking at this jobs report, weve only recovered about half of all the jobs that have been lost. And the recovery, that pace of new jobs being added is slowing considerably month over month and week over week and the number of unemployment claims continues to come in above what is expected. So the market isnt really looking at the reality of the economy. What its looking at is that stimulus, both fiscal and monetary stimulus. Because whats happened lately over the past decade or so is the stock market has been based all about liquidity, not the market. Maria yeah, but do you think that we are going to see a firmer market in the Fourth Quarter . Do you think the economy is improving . I think the economy is going to get a little bit more wobbly in the Fourth Quarter. Im in italy right now. Were pretty much about a couple weeks, maybe a month or so ahead of u. S. As far as whats happening with the pandemic. And over here were already seeing cases starting to rise, the u. S. Is starting to see a rebound in cases. We are nowhere near out of the woods yet on this pandemic and a vaccine is not imminent. As far as being widely available. Which means were going to have to probably go back into some sort of lockdown, i doubt well see the lockdowns we saw the first time around. They will probably be more targeted. All of that is creating more uncertainty. That uncertainty means fewer jobs starting again, that means more companies are going to completely shut their doors for good, they cant withstand this for a lot longer and none of that is good for the economy. Maria all right, katherine, lenore and troy. Thank you for the word on wall street this morning. Coming up, the media not wasting any time slamming President Trumps Supreme Court nominee, ill speak with trump 2020 Campaign Senior advisor Mercedes Schlapp about that. And then Madison Cawthorn is here, back with us, explaining why he says he wants to be the aoc of the gop. New bombshell documents, we brought them to you friday related to the unlawful surveillance of former Trump Campaign advisor, Lieutenant General Michael Flynns attorney Sidney Powell will join me live next hour. Later ill be speaking with ray kelly on the crime in america, unrest in our cities. Plus, Kayleigh Mcenany will join me to talk 2020, the Supreme Court and a whole lot more. Stay with us. Dont miss a moment of it. Youre watching mornings with maria live on fox business. Maria welcome back. President trump on saturday named amy Coney Barrett as his nominee toe the suprem nomine Supreme Court, to fill the seat left vacant following the death of Ruth Bader Ginsburg. At least four Democratic Senators say they will not meet with judge barrett ahead of the hearing. Joining me now is Senior Advisor Mercedes Schlapp. Thank you for joining us. Your reaction to what has taken place . Good morning. Ive got to tell you something, its no shock that the democrats are refusing to meet with amy Coney Barrett. As we know, the democrats have played this political game even with Brett Kavanaughs process, as well. What were going to watch for is the democrats, are they going to apply the same character Assassination Campaign that they did to Brett Kavanaugh . And i think that they are really going to walk a very fine line with this. I think its a dangerous path for the democrats to look and try to attack amy barrett. As we know, shes a very wellqualified judge. I mean, she has exceptional qualifications, a very strong legal record, in addition to being someone that we know has received huge praises on both sides of the aisle. Maria yeah. I mean, Lindsey Graham will be presiding over the hearing to nominate her. Do you believe they have the votes and do you believe she can be confirmed before the election . I do. I do believe that she can be confirmed before the election. Look, weve seen this in the past with Justice Ginsburg where they confirmed her in 44 days, Justice Sandra day oconnor, 33 days she was confirmed. Justice stephens, 19 days he was confirmed. So this is very doable. And i know Lindsey Graham, hes someone who will make sure we keep things on track. I think that the more people learn about amy barrett, they will realize that she is the right choice for the Supreme Court. You look at, for example, the Bipartisan Group of law professors who have said that she is rigorous, fairminded, someone who really understands the law, loves the constitution, and as amy herself has said, where she is focused on not prejudging cases, regardless of personal preferences or political pressure, it is about inbretting the law, not interpreting the law, not making the law. I think that explains what her judicial philosophy will be moving forward. But for the democrats, i think theyre completely stressed out because theyre left with few options to stop this nomination. Maria and of course, you mentioned Lindsey Graham, the chairman of the Senate Judiciary committee joined me yesterday. He will be presiding over the nominating process. Heres what he said about amy Coney Barrett yesterday. Walk us through the Supreme Court nomination. So well start on october 12th and more than half of the Supreme Court justices who have had hearings were done within 16 days or less. So well start on the 12th of october. Well have a day of introduction. Well have two days of questioning, tuesday and wednesday, and on the 15th well begin the markup, well hold it over for a week and well report her nomination out of the committee on october 22nd. Then it will be up to senator mcconnell as to what to do with the nomination once it comes out of committee. Maria so mercedes, you know, Chuck Schumers not even going to meet with her, they just dont want the president to choose another Supreme Court justice. This would be the president s third appointment should she get appointed. Right. Well, you know, as we know, the president is simply following his constitutional duty. When there is a vacancy, the president has the right to make this nomination and then following that it moves to the senate to provide advice and consent and since both the senate and the president are for the same party, theyre able to they move forward and are able to proceed with this confirmation process. I mean, this has happened 29 times where youve seen a vacancy in the Supreme Court during an Election Year prior to inauguration. The president has the constitutional duty and authority to do so and to appoint this nominee. Its why were moving forward with it. Its what the American People have called for. You know, our biggest concern is that when you have the democrats talking about packing the court as senator shy you her said in a schumer said in a press conference. If they were to win the senate, quote, everything goes. And so the idea that theyre talking about packing the court, we are still waiting to see what joe biden thinks about doing that. We know what the late Ruth Bader Ginsburg thought about that, which was keep it to nine. Were also waiting to see if joe bidens ever going to release his list of Supreme Court nominees. We havent seen that list. So we dont know what joe biden is hiding but we know it would be a list of very far left judges. Maria well, now that the focus is on the Supreme Court, does the stimulus go away . How Speaker Nancy Pelosi said on sunday she believes that coronavirus aid deal is still possible but House Democrats are working on a new aid package with a 2. 4 trillion price tag, it would include another round of direct payments, enhanced Unemployment Benefits and aid for airlines. Do you think we will see more stimulus before the election . As the president mentioned yesterday, we are making progress. He hopes that we can negotiate a deal with the house of representatives, with Nancy Pelosis team. I think the goal at the end of the day is that Speaker Pelosi shouldnt withhold this money, the stimulus money that we need. The relief that American Families need right now, those who are suffering from the coronavirus pandemic and at the end of the day, we need to make sure the American People get the help and thats what President Trump is focused on. Maria all right. Mercedes, great to see you this morning. Thank you so much. Stay with us. Well be right back. Keeping your oysters business growing has you swamped. You need to hire. I need indeed indeed you do. The moment you sponsor a job on indeed you get a shortlist of quality candidates from a resume data base claim your seventyfivedollar credit when you post your first job at indeed. Com promo maria welcome back. The first president ial debate kicking off tomorrow, joe biden and President Trump will square off for their first Time Beginning at 9 00 p. M. Eastern tomorrow night, the topics chosen by fox news own Chris Wallace include the Supreme Court, covid19, the economy, race and violence in our cities and the integrity of the election. We will cover it live. Lee, what do you think will be the most hotly debated topic tomorrow night . Lee i think its going to be about the Supreme Court and i also think theres going to be a lot about character and weve seen so many attacks between these two. Its going to be interesting to see what they do when theyre right next to each other and they have to debate each other facetoface because right up until now, theyve been constantly attacking each other and is that the way theyre going to behave when theyre on the stage. I dont think thats what the American People want to hear. I think the American People want to hear what these candidates will do and what theyll do differently if they were to become president and i think donald trump is president , we know more of about who he is, what hes going to do. Joe biden has a big case to make for himself. I think we need to hear that. Im afraid its going to end up being a lot of attacks. Maria you make a good point. Were all going to be focused on body language and what they say to each other. Ryan, the other major topic will certainly be the economy. How do you think the president will make his case and what can biden say about trumps economy given the fact that we were at record lows in unemployment before covid19 showed up . Ryan absolutely. I think in all fairness here, the economy is getting on firmer footing. I dont think thats very good for biden. You look at gdp this quarter, a lot of economists are calling for a 30 increase which is a huge, huge recovery from where we were just a couple months ago. Unemployment on fridays probably come down a little bit more. I think with the economy on firmer footing here, thats going to be very, very hard for biden. I think everyones going to be tuning in to specifically for the mud slinging. I think this could almost be like payperview, i used to watch mike tyson when i was younger. I think thats how excited people are for the mu mud sling. I think the economy is working in President Trumps favor. You look at housing, were basically in a boom right now and the Economic Data continues to come in better. I think thats going to be very hard to deny. So i think thats going to be very, very good for President Trump. Maria joe biden will likely focus on the coronavirus. Thats what hes been hammering. President trump on. Be sure to join us tomorrow night. Ill be there live along with neil cavuto to preview the debate, starts at 8 00 p. M. Eastern and well have the debate live at 9 00 p. M. On fox business. Join us tomorrow night for this incredible event. Coming up, North Carolina congressional candidate Madison Cawthorn is here, why he wants to be the aoc on the gop. And tiktoks fate in the balance as the judge blocks the trump administrations attempt to ban tiktok downloads in the United States. Were taking a look when we come back. Stay with us. Maria welcome back. Good monday morning, everybody. Thanks so much for joining us. Im maria bartiromo. It is monday of day, september 28. A look at markets, 7 31 a. M. On the east coast. Were looking at a rally underway this morning, futures indicating a gain at the start of trading, with the dow up 350 of points, one and a quarter percent, nasdaq up 187 and s p 500 higher by 42 and a quarter. Wednesday marks the final trading day of the month and the final trading day of the Third Quarter, a lot of positioning going into end of quarter buying. Friday saw a day of green as well, largely boosted by a tech rally that pushed the nasdaq into positive territory for the week. The dow industrials were up 358 points friday, the nasdaq was up 241 and the s p higher by 51 at 4 00 on wall street friday. Global markets continue the momentum, european markets in the green across the board, fq100 up 82, cac up 97 and dax higher by 342 points, thats 2 and three quarters percent, boosted by Investor Sentiment in the Banking Sector. Bank stocks are higher. Asian markets mostly higher overnight, despite new sanctions by the u. S. Against chinese chip makers. Meanwhile, the u. S. Is calling for peace as tensions escalate between arrest men gentlema arm. Cheryl the Armenian Defense Ministry Said they shot down two helicopters and struck three tanks. Azerbaijan said it was armenia that broke the cease fire first. At least 21 people have been killed in the clashes so far. The International Community is calling for deescalation with the u. S. State department saying in part the United States believes participation in the violence by external parties will be deeply unhelpful and only exacerbate regional tensions. Well, President Trump is slamming a New York Times report that said that he paid no federal income tax for 10 of the past 15 years. The report claims he paid only 750 in taxes the year he was elected and again during the first year in office. The president says the report is completely false. Total fake news. No. Actually, i paid tax. They should give all those Pulitzer Prizes back because everything was wrong. I mean, it was so bad. Their reporting was so bad. They were wrong. It was exactly the opposite. Cheryl a statement obtained by fox news from a lawyer says the president has paid tens of millions in federal taxes. Well, more controversy in the Breonna Taylor case after a new report contradicts the Kentucky Attorney general hads finings that an officer was shot by her boyfriend. A report questions if the bullet that hit an officers thigh was the case of friendly fire. This came after body cam footage was obtained, in the footage the s. W. A. T. Team arrests Breonna Taylors boyfriend after the shooting and an officer can be seen telling officer hankison to leave the scene immediately. Doug parker is confident that the airlines and congress will reach a deal on federal aid, this coming after reports that American Airlines received 5. 5 billion loan from the treasury department. Meanwhile, Qatar Airlines divulging that the qatari government loaned the airline 1. 5 billion amid the pandemic. Theres american in the premarket, up 4 andahalf percent. Those are your headlines. Back over to you. Maria all right, cheryl, thank you so much. Looking to make history now, our next guest could be the youngest personnel ected to person elected to congress at 25 years old. Madison cawthorn beat off a trump backed candidate in the runoff election, reaching out to conservative voters. Madison, its great to have you. Thank you for joining me. Maria, good morning, as always. Maria what are the policies you are pushing forward to reach out to Young Americans and are you seeing this resonate with young people . Well, you know what, theres two main policies. One, obviously you have to have a plan on healthcare. I feel like a lot of people in my generation feel like the Republican Party has been the party of no on this issue out without presenting a real plan. I want to go into that market, deregulate it and allow more competition to come into it. Two, i believe conservatives need to start taking environmental policy headon because we can win this negotiation. We can win this argument. Our ideas actually work and theyre marketbased, not Something Like aocs green you new deal which would cost the company 51 trillion that we simply dont have and it wouldnt even protect the environment because it puts the needs of 15 an hour minimum wage, medicare for all above any real environmental change. Maria so you say you want to be the aoc of the gop. Tell me more about that. You know what . I actually have never said that. Thats something that i sometimes resent when people compare me to aoc because i believe that my principles an my policies are truly based deeply in my principles and my feelings and what i really follow as my conservative beliefs. Whereas i feel like aoc is really led by her party and by her feelings which is something that i dont believe makes a great statesman. Maria so where did that come from, that youre the aoc is it just being a young person . I think it might be the fact that im a young person, im able to reach out to a large generation of greatly untouched by politics and also being able to bring people into the party, new people that dont normally participate in politics. Maria a new poll from the Washington Post and abc gives democratic president ial nominee joe biden a 10 point lead over President Trump. What do you expect to happen at the polls in november . And how will this debate tuesday night play into it . Well, i believe i dont believe the debate will change many minds. I believe well get to see President Trump absolutely dominate in it. But i think both sides pretty much already have their minds made up. When i hear these polls that donald trump is 10 points behind or trailing by 5 in others, i really just shake my head. This is the same thing we heard in 2016. But being on the ground campaigning every single day, i can tell you, i have a lot of anecdotal evidence that speaks otherwise. There is so much enthusiasm and momentum for President Trump and for the conservative movement and i genuinely believe that that momentum and that energy really does count and will show up in the polls in november. Maria uh huh. So madison, what do you think is most important to your generation in terms of President Trumps leadership . Here we go, watching the policies being talked about tomorrow night, were going to be watching what resonates with people at the debate tomorrow night, but what do you think is most important to younger generations . Are they looking at this election differently than older generations . Well, you know what . I believe the majority of my generation breaks down to the demographics that most americans do. Probably 40 of the people deciding for joe biden, 40 of the people decided for donald trump. That 10 thats left over, 20 thats left over, i believe what its going to come down to is the economy because a lot of them have Student Loan Debt and its hard to find a job when they leave, graduate out of college. They want to know about freem. People of freedom. People of my generation, we dont like being told what to do by the government. We want more deregulation. We want to get rid of three letter agencies, we want to live life on our own terms. Maria its great to talk with you as always. Thanks so much. Well talk soon. Coming up, ill be speaking with Lieutenant General Michael Flynns attorney Sidney Powell on bombshell documents related to the unlawful surveillance of general flynn, that starts at 8 00 a. M. Eastern right here. Mailin voting versus absentee voting, what you need to know about the differences. Youre watching mornings with maria live on fox business. Maria welcome back. A federal judge halting the trump administrations ban on tiktok downloads, the u. S. District judge, carl nichols, issued his ruling hours before the ban was supposed to take effect last night. Joining us to talk more about that is senior judicial analyst, judge andrew napolitano. Judge, great to see you. Good morning, maria. Maria your reaction . Well, the judge ruled shortly before midnight that the government is enjoined from interfering with the tiktok structural relationship until theres a trial. Its very unusual because federal judges are required to give reasons and to write them down in an opinion at the time they make any kind of an order, whether its a final determination or a preliminary injunction as this one was. The judge did that but he didnt publish it. He sent it to the lawyers for both sides, the Justice Department and bytedances lawyers for them to review. Why would he do that . I suspect there may be some information in there that is either proprietary to tiktok or sensitive National Security information and he wants the lawyers to sign off on it or to ask him to redact certain information before he makes it public. However, judging from what he said in the oral argument which was late yesterday afternoon, it appears as though this judges concern was that the department of commerce issued this order, it didnt give tiktok an opportunity to deal with it. So it was taking away property without due process, without a trial. So this ruling last night is a temporary ruling until a trial can be had which is now scheduled for november. Maria right. And then the overall deadline on a deal is apparently november 15th now. So the administration has pushed that out in terms of the time that these companies can organize a potential deal. Judge, let me switch gears, get your thoughts on the nomination of amy Coney Barrett to fill the seat of justice Ruth Bader Ginsburg on the Supreme Court. Well, i have a bit of a bias in favor of her. We are graduates of the same law school. We have many, many although im a generation older we have many, many mutual friends. I am familiar with her intellectual honesty and her intellect both of which are beyond reproach. I also know from having discussed this many times with the president , this is exactly the jurist he has been looking for and this is exactly the moment hes been waiting for, when he personally, donald trump, can cement a conservative majority on the Supreme Court. I have every reason to believe shell be confirmed. I was listening to your excellent interview with Mercedes Schlapp a few minutes ago and i agree with her entirely. The democrats are dumbfounded. How do you attack a brilliant woman, the mother of seven children who has just been confirmed by the same senate three years ago . I dont think they know what to do with her. Maria well, theyve tried already. I mean, at least Democratic Senators have said they dont even want to meet with barrett. They said, look, were not even going to engage. Is this what the senate is supposed to be doing now . That is rudeness. Yeah, no, thats not what the senate is supposed to be doing. They should meet with her and they should engage with her. They apparently want to treat her the way republicans treated merrick garland. Although some of those republicans met with judge garland at the time. Thats the person that president obama nominated to replace the late just continues Antonin Scalia on whom the senate declined actually to give a vote. I think when you show rudeness, you undermine your own base. The person im going to be watching here the most is senator Kamala Harris who of course is on the ticket with joe biden. Shes also on the Senate Judiciary committee, to see how she treats judge barrett when judge barrett appears before that committee in about three weeks. Maria well, we know how she treated judge kavanaugh. So well see if theres a repeat there. Judge napolitano, its good to see you this morning. Hillary [ laughte. [ laughter ] pleasure. Maria coming in, mailin voting versus absentee voting, we take a look at the differences, what you need to know ahead of election day 2020. A legendary save from former nfl quarterback, joe montana, his facetoface encounter with a home intruder making a buzz this morning. Back in a minute. Maria welcome back. The election now about a month away with voters having a multiple multiple ways the to cast their ballots including absentee and mailin voting. Hillary vaughn has more on this. Hillary, good morning. Reporter good morning, maria. This election is unlike any other, between universal vote by mail, ramped up absentee applications and extended deadlines to count mailed ballots, 80 million americans are expected to socially distance their vote, instead of showing up in person. Thats twice the number that did that in 2016. There is a big difference between how ballots show up in your mailbox. Absentee ballots have to be requested ahead of time by a voter. The application is submitted by the voter and an actual absentee ballot is then sent out. With universal vote by mail, ballots are automatically sent to every voter on the voter rolls which many times can be inaccurate. People who have passed away can still be listed on that voter role. Other names of voters who arent eligible can sometimes be included or other voter may receive more than one ballot in the mail. Its not just mass mailed out ballots that make a difference. Many battleground states have different deadlines for when mailed ballots can be counted in. Florida or arizona ballots have to be received by election day in the mail. Other states like michigan will count ballots up to two weeks after election day. 35 days away from election day, 43 states still have multiple pending cases related to voting, lawsuits in court and how those cases are decided could have a big impact on how voters see the results of the election. How ballots are mailed can also make a big difference. In pennsylvania, the court ruled that officials cannot count ballots that arrive naked. Those are ballots that arrive without their second secrecy envelope but instead are mailed loosely in their outside envelope. Maria. Maria wow. Look at michigan, all the way until november 17th in terms of accepting ballots. Thats pretty incredible, hillary. Thank you. Hillary vaughn. The election is on november 3rd. Look at minnesota, november 10th, michigan, november 17th as hillary told us. Lee, your reaction to this . If im going to wait for ballots until november 17th, we may not know who the president is for weeks. Lee there are people who are saying it could be up to six weeks before we know. Many states i mean, the 17th is a long time. Many states it has to be postmarked by the third. We know whats happening with mail these days. We could have a long time and these votes are so close. When you look at some of these states, swing states, michigan, pennsylvania, North Carolina, were talking about the polling right now has them so close together that every votes going to count. It could take a long time. The Supreme Court is probably going to have to get involved when were looking at it this closely because people are going to ask to recount and i think that were not going to know on Election Night. Unless somebody wins in a landslide and i dont think thats likely. Maria and thats right, if its a landslide then thats different. But he lee, i mean, you know, what are we supposed to think . Can we trust the system here . Because, look, this weekend we found six ballots in the garbage can that were voting for President Trump and somebody threw them out. I mean, i think its a really sad state of affairs that we cannot trust the system. I think the one thing that despite all of our differences, despite everything thats been happening, when theres trust in the system we can have progress and things can move forward no matter how bad it gets, when we look faith in the system and thats what were seeing happening, were seeing faith in the system at an alltime low. Theres going to be real unrest if we cant get to a place that we all agree and really believe that were going to do the right thing by the American People. I understand why people are forced to go into the polls in person. We have to find alternatives thats viable and safe. We cant continuously find these things are happening. No one is going to trust the results on the other side of this and thats going to be a big problem with where we sit here in america. Maria i dont know. Ryan, i dont even i cant even begin to think about what this uncertainty is going to mean for the markets between november third and the end of november. Ryan 80 Million People is a lot of people and this sounds like theres no uniformity. As an asset allocator from my side i love uncertainty. That sounds counterintuitive. When you look at elections in the past and look before elections, markets do sell off a little bit. Markets dont like uncertainty. Maybe the elections going to push that uncertainty a little further. Once you have confirmation which i think is going to be weeks after the election, thats going to bode well for markets. When you look at what earnings look like for next year, i actually look at this as my friend. The market right now is providing tremendous value. So from my perspective, this is i like the uncertainty. I know it sounds crazy. Its only boding well for anyone who is trying to get invested, who is sitting in cash, sitting on the sidelines waiting, i think thats the worst thing you can do right now. Thank you, maria. Congratulations to you, on getting all documents declassified opened up to the world to see, first i want to ask you about the filing that was was released on friday. Tell me what was most stunning to you, when you look at some of the Text Messages interview of William Barnett he what he said in testimony. The timeline is particularly interesting. He indicates that there was very little if any activity on the flynn case through august and fall until after the election, really after new years even. So makes it even more clearer that flynn was quote insurance policy that they opened the file on him, and kept you it open using pretense of National Security letters like subpoenas that dont have to go before a judge to keep file open so they could go after him if in fact he went to white house with President Trump, that is exactly what they did. The National Security letters was pretense they had no derogatory information on him whatsoever. It was all a scam that they carefully created and orchestrated to set him up frame him for statement that he didnt even make. And weve got technicalities among fbi officials that really state so much, for example, are in october 2016 fbi was investigating ties between russia and Trump Campaign, of course, never materialized, two unnamed agents write haha blank is trying to work a trip to south africa the crossfire road show, i am interested to see how this all plays out i am telling you, man, if this thing ever gets a foia that is a freedom of informing act there are going to either some tough questions asked a great deal of those related to brian having a scope way outside boundaries of logic what does this t t eexnge tnge t usls know badasas theewhe s ut thehat anyif anyny gotototold hold oft text msages to bebe be aeik proem eviednc a lot a lot imon faclosely closely reaeaouu canee peter pzokzozodmitting is pngesithith the t t ntntnteltem fbi fbi u use t t alizerializpeningpeningf fil fif 302s302s yan t celremore02s02 ersierssi of o whathoule oeronson of thethemccabemcca memo apparently about phone call with general flynn all kinds of games inside fbi reflected in those Text Messages mr. Barnett was stunned by all of it i mean very clear that there was a no derogatory information on general flynn whatsoever. Never should have been a case brought against him. And the agents were just off the rails particularly genie rhee egregiousness to target flynn mr. Barnett refused to even work with her. I want before i get to next text, lets walk through what was happening, the fbi, was investigating trump, and collusion with russia they couldnt find any evidence, of any collusion, but they kept driving the narrative driving narrative they were worried then candidate trump had already been elected, he is before his inauguration, and he was going to choose general flynn as National Security adviser he chose general flynn as incoming nsa worried as soon as new ncivilitya comes in what happens he gets his hands dirty gets into everything they are doing then going to immediately figure out, that they have been investigating both him, and President Trump. Is that right . Yes, and he would have seen all fisa abuses, he would have caught on to all illegal surveillance, he was going to review the Intel Community and how it has abused all kinds of its authority, not just fisa, but nsa database i think mind for private gain private contractors comey gave access to unsupervised a heck of a lot goinghe would have stopped immediately uncovered cleaned up and out. What happened before july of 2016 when fbi claims they started investigating trump but we know there was all this activity, in march, april, may of 2016, where these quote unquote democrats or washing up spies were running into Trump Campaign people, and dropping things, so that they were being paid apparently Stefan Halper i have speculated being paid by well we know being paid by office net assessments built got paid huge money i speculated page to run into Trump Campaign people not to write on china sand rush another text for you on january 5th, 2017 during the transition, two unnamed agents write this so, razor is going to stay open . Question mark three times, yep crimes report being drafted what is the word on how president obamas briefing went . I dont know but people here are scrambling for information to support certain things, and it is a madhouse, jesus, trump was right still not put together why do we do this to ourselves what is wrong with these people the last techs refers to tweet from then president elect trump two days prior writes intelligence briefing socalled russian hacking delayed until friday perhaps more time is needed to build a case very strength. Sidney during transition period january 2017 still say trump is right, still not put together. No evidence of any collusion. Yeah they knew there was no collusion they had ordered the flynn case closed first by november 8th election day, ordered it closed again by january 4th, and just used excuses of calls with ambassador kislyak to reopen started strangling for information to try to build a lockan act case when they you a knew was bogus there has never been a successful logan act case probably unconstitutional not to mention how much other people have violated it flynn was doing his job there was no logan act violation at all they knew that, too. It was one absurd effort after the other. Yeah. Lets just point out also, that this team did not like Michael Flynn. He had been neither obama administration, the general, and he wanted to you had aid things like office of net aassessments where this was going. The one adamant trying to find something against him, was the one who represented clinton and clinton foundation. Of course, general flynn had said lock her up with the crowd at convention, or one of the rallies, and that is where they got so enraged particularly about general flynn. Yeah, so the finding revealed january 10, 2017 fbi agents obtaining liabilitied insurance sidney wrote we all want purchase professional Liability Insurance holy crap analysts too . Yep. Can i ask whor potential lit gators suing you all. Haha who knows the concern when we got it a big leak at doj New York Times among others was going to do a piece the thought was if piece comes out january 20 comes around the new ag might have some questions then yada yada we all get screwed. That was that was yeah, that was specifically in response to the article written by David Ignatius somebody leaked calls flynn made with ambassador kislyak pursuant to duties as incoming National Security adviser that article came out they used that that was a deliberate leak, obviously, to start a new whole new prosecution of general flynn that was also baseless. Have a Lindsey Graham came on the show yesterday with me he said that any investigation around general flynn was total garbage made up where do you stand right now with youre clients, general flynn, the president skeptics critics are trying hard and general flynns critics are trying hard to keep this going. Well they have absolutely nothing, the government filed a massive motion to dismiss on may 7 that included 80 pages exculpatory information despite court order up to four years now weve got a hearing tomorrow on motion to dismiss 11 00 a. M. , the public can listen to it i will tweet out adSidney Powell 1, information so that everyone can listen but judge sullivan must grant the motion to dismiss with prejudice disevery case in the country requires dismissal of government notion to dismiss every single precedent there is more than ample reason to dismiss here because the government is clear no case should have ever been brought there is more than there is more evidence than i have ever seen to justify and mandate absolutely mandate dismissing it. And, by the way, sidney quick we only have 15 seconds here you are not getting paid for this you are doing this because you believe this is right thing he think to do;is that right . This comes during a summer in which Defund Police movement gained steam in many democratic led cities across the country are former new york city Police Commissioner Guardian Group ceo ray kelly thank you for joining us access the situation with all the defund the police commentary coming up across the country, and protesters turning violent, what is your take on where we are today . In crime in america . Certainly been a sea change across america as far as policing strategies, and tactics since death of george floyd no question, on the part of police, proactive strategies worked three decades to reduce crime in this country in a few Months Police backed off from that some is because political leaders telling them also police themselves are backing off they realize they are not being being supported, as far as protesters are concerned they are ongoing certainly Portland Seattle but cities as well new york city a major protest every night covered some of it, it is going on for quite a while irrespective of Election Results. I didnt realize that in new york city there is a protest every night are these Peaceful Protesters . Is there upset and crime in looting along with it every night . Well, no, i think it depends on your definition of peaceful full there are arrests made every it in a but if sticking a raerm into face of police inches away from face calling them temperatures in doesnt fit my definition of peaceful protests you have that element virtually every demonstration. If elected democratic Vice President ial nominee candidate Kamala Harris wants overhaul of the Justice System includes the elimination of cash bail, gd andrew cuomoo pushed through bail reform crime is dramatically acrosses new york city when cash bail is eliminated throughout the country cash bill pretty much throughout the country 90 of the people arrested are not held on any bail at all the difference in new york state by the way, is that judges do not have discretion to hold someone if they are quote dangerous, virtually every other state judges can do this, so a major flaw in the bail reform in new york state i think we need a lot more data to make determination just like effects of bail reform law, but stands to ran if dealing with recidivist population which we are people out on streets going to commit more crimes, likely our people are committing one or two crimes in certainly categories. So, about going out in new york state, it is appears to be developing into a major problem. So i asked Governor Cuomo about this, back in march. When he joined me. And he said he would have an answer by april, here is what he said watch this. Will you propose are a support that judges have to discretion to let out criminals as they see fit and change this bail reform situation, which caused crime numbers to go shooting up. Bail reform for many years was based on how much money you had maria, that is what cash bail is if you are rich get out if you are poor you sit, that is an injustice not just. We made that change going to make more changes i understand the fear. I understand the criticism. I said that i am working on it. And i believe we are going to get something done, in to budget on april 1. Maria correct me if i am wrong i dont think anything changed april 1 except numbers getting worse. They made changes changes pretty much cosmetic what they did was increase the the crimes that the judge can charge bail for. But still judge has to give cash bail it cannot who will somebody remand somebody put them back in jail unlike virtually every other state in the country new york is different than the rest of america, in that regard. Maria ray kelly thank you so much for being here this morning we appreciate it well be right back. My mom has super powers. Its like she can see the future. Maria welcome back, a vote of no confidence the new york city city Principal Union voted unanimously for mayor de blasio give control full control to city schools to State Government the union making the decision following last minute decisions about School Reopenings Virtual Learning kaurt officials off guard lee carter this only creates more issues probably between the governor and mayor but the schools unions are done they need some stability. Yeah, this is going to create more problems, and i think this is already you know we have a narrative around manhattan new york city right now, it is a mess de blasio is being held accountable across the board this is one more capital of de blasio failing the city, and needs to be acknowledged i think that you know when you look at some of the concerns about urban centers americans have, it being blamed on dplakt leadership, in large part i think really, really important that joe biden addresses this because it is not enough to say they dont know how to has become a democratic issue democratic city the after democratic city de blasio blamed one thing after another a disaster for the city. Look at democrat run cities Unemployment Rates the unemployment much worse for these cities that are being run by democrats because of the policies. De blasio under fire for allegedly ignoring advice of panel of educators warned him of a Teacher Shortage appointed dozen of leaders to of our visa amid coronavirus pandemic, he ignored their advice, parents want kids back in school we caning go protest get close to each other a lot buildings that force businesses to put wood up, and, you know, close them down and, yet, we cant go to school. It is crazy sounds like a haez up 12,000 Teacher Shortage come fall we are Teacher Shortage that concerns me i think a lot of teachers i know clients, friends want to get out of teaching altogether has become such a disaster trying to teach through amazon impossible to gauge kids through a computer i think that is a bigger longterm issue who is going to become a teacher when you have all bureaucracy and clearly things not going smoothly at all almost draconian the say they set up some of these, it is crazy. Yes, it is we will take a break when we come back white House Press Secretary Kayleigh Mcenany here will weigh in on 2020 Supreme Court a whole lot more right after the break dont miss it. Senate judiciary chairman Lindsey Graham joined me on sunday morning futures will oversee preside over nomination process to his timeline for confirmation. Walk us through the Supreme Court nomination. So we will start october 12th more than half of the Supreme Court justices who had hearings were done within 16 days or less so we start on 12 october, we will have a day of introduction two days for questioning tuesday and wednesday, on 15th we begin to mark uphold it over a week report her nomination out of committee, on october 22nd then it will be up to senator mcconnell as to what to do with nomination once it comes out of committee. Maria joining me right now whats the press secretary Kayleigh Mcenany great to see you this morning thank you so much for being here. Good to join you, maria. Maria the senate just walked us through timeline we have already heard from the democrats in president s critics senator schumer says not going to meet with amy Coney Barrett, so does hirona saying they are making proceedings about how she will vote on things we havent even heard from judge barrett in terms of where positions are what is your reaction. That is right, blatant politics by democrats, their wish that president would stop being president year four ufrlt for them not how constitution works they have bad precedent on this trying to set a new precedent we ne president barack obama made a nomination in fact they didnt have control of the senate we have control of the senate and president she very compelling case for having made this nomination first constitution, is probably the most compelling case this is blatant politics trying to frame this nominee before getting a chance to hear from her shameful she has a juries prudence history attacking her, people questioning that struck me, they dont have anything else, to point to, in terms of her record, so moving into personal life. Exactly right, they are attacking her for being a working mom, they are attacking her for her faith and make no mistake this is a trend from democrats, this is an attack against working moms aCross Country the people of faith Cross Country lucky for us no religion techs to serve in Public Office exclusively prohibited by constitution, 36 hours, 48 hours of being named indicative of where the Democrat Party is today shg unfortunately more vicious as we move forward. Former Vice President joe biden and President Trump square off tomorrow night first of three debates going to be must watch event of the season how is the president preparing kayleigh . He prepares every day, maria you see it as well as i do, when he takes questions, from very hostile reporters in the Briefing Room gavel setting yes additional behind scenes reviewing all he has done as president preparing to reply accomplishments to the debate stage most in a very transparent public fashion he will be great deal advantageed for engaging with very hostile press corps he will be ready for whatever comes his way. Our own Chris Wallace will be moderator six items of discussion china not on that list will president try to get in conversation about china even if it is not a direct question asked . I know this is an issue that is very important to the president given the fact he is first one first president to push back on the bad behavior, and theft of intellectual property Chinese Communist party has engaged in for decades. We have strong record this president came in Office Brought fight to china navigated made his way to the one chinaing deal what this president has done compare to ob obamabiden bowed down to china did not stand up for our economy Domestic Production far our farmers, this president has. A very clear contrast important as we face pandemic this came from china. This is the china virus after all. What are you doing to make sure there isnt cheating around this election . Look, last week we found six ballots that voted for President Trump in the garbage this morning weve got news of a ballot broker boosting keeping hundreds absentee ballots in car trunk kayleigh in minnesota bragging about them being filled by police other by people other than voters often money changes hands witnesses tie fraud to Campaign Chairman of prominent member of radical squad you know her omar. Very troubling what we see across the country, states are really in control of this, and i say unfortunately, we have seen democrat governors pave way for mass mailout voting we saw in nevada ballots language wishing in trash cans onus on states localities to protect safeguard elections where you have 100,000 ballots rejected in california primary 100,000 we didnt foe who one a Congressional Election for six weeks, in new york, new york city one in five ballots tossed out this isnt a system that enfranchises voters it distorts it we making the case quite publicly so people put pressure on democrat governors, mayors Election Officials to make sure this is accurate vote of American People. The president is going to need a landslide really because they are already saying they are not conceding Hillary Clinton said under no circumstances should joe biden concede this election are you expecting we dont know who president is for next term for weeks. We certainly hope that is not the conveys we want this to follow in the way of great tradition every election september onegoer, none of us wanted to see a projected winner Election Night would like to see play out you are right always onus on President Trump will he accept results of election in fact Hillary Clinton has never accepted the results of have election Hillary Clinton who said joe biden should not concede under any circumstance many other democrats who have been on record saying something to that effect, always been Democrat Party but leave it to media to ignore that. Well the media is certainly helping, joe biden, as much as they can, the New York Times out with a story this morning, on President Trumps tax returns. The piece is alleging years of losses, and years of avoiding taxes, kayleigh, your reaction do the New York Times piece this morning. It is inaccurate, flawed wrong, as the president s attorney told New York Times, but loaf it to in Orange County times to accomplish inaccurate piece done so aven as we led up to russia hoax nothing to see here as mueller found, we have seen this play out before Tax Information or purporting Tax Information dropping on eve of debate tried it 2016 didnt work work got more creative in strategy as we move toward in 2020 didnt work out too well for them last time around. Kayleigh i have learned we are not getting interim report from durham before election may not see indictments before election i imagine going to continue after the election but debate going on inside the department of justice that if they release anything now any conclusions from you durhams criminal investigation it will pare politically motivated. Should not American People understand, how they tried to unlawfully take down a duly elected president in 2017, and make sure people understand, are the scam that was behind it . Why arent we hearing from john durham yet. American people deserve answers i lever to it doj as to timing of that report. Look we have had numerous investigations into President Trump finding no collusion has been most investigated most exonerated person in america. What we do know in fact i can say dont know but need answers to is this about elaborate takedown scheme happened in Obamabiden Administration Oval Office Meeting days before exiting office a plan it seemed to entrap general flynn to go after him take down this administration, the lawful vote of the American People. We deserve answers on this the answer policy by peter strzok what was going on if fbi we deserve those answers in short order. That is absolutely right, Kayleigh Mcenany good to see you this morning. Maria welcome back Airline Industry structural from covid shutdowns International Travel restrictions thousands pilots flutes flights facing unemployment if Congress Unable to extend federal funding there is bipartisan important is for extension relief delayed due to broader package stalemate joining me aviation analyst mike boyd great to have you this morning an important issue for all of us what happens to these airlines if aid is not extended this week . Is it we are going to have biggest change in Airline Industry since deregulation this jumping off cliff rocket launched if employees let go not coming back in airline is going to have to totally restructure right now today, 45 u. S. Airlines are still grounded going to stay grounded, Different Air Transportation System they wont come back. So how are the the Major Airlines doing . I mean do you expect that we will see consolidation . How will this play out . They cant possibly stay in business if they have no business. No what they are going to have to do is shrink way, way down, down to 45 of where they were a year ago. That means going to have smaller Revenue Streams how are they paying debt consolidation isnt really in carrying mergers between mirlz messy expensive a23 operative spirit not same one operated by american cant put those together easily consolidation is not a solution here, it will probably be airline shrinking way down maybe to point cant cover debt, that is may be a year out if this happens on october 1 congress can look at air Transportation System, that is not going to be the same again. Unbelievable, ryan jump in. How do you compare to 9 11 . Is this recovery even slower . We are going to 45 cuts in airlines that is pretty tremendous is its palpable or much, much worse right now. Totally different situation right now, then worried about peek sneaking around in if airports, now we have this phantom thing call covid we keep saying what happened the problem airlines of the economy is recovering we all know that i dont care what other people say we know recovering people cant fly, one hand not sure getting speculative and running into checkpoint charlie to get in queen they hear how bad on an airplane it really isnt if you are a business send somebody on a trip they come back might have covid bring lawyer with them fundamental things stopping people from flying airline industries, the problem is when people are told koifrd is expanding not saying exactly what it is, people are staying home. Really troubling when do you expect travel to pick . Normalize schedule 2021 or beyond. You are talking to us we thought we would be back 80 by end this have year normal, going to be about 50 because people cant cannot use air perhaps like before the new normal wont be anywhere near where it was before at all going to be at least 90 down up.
