In his about half hour of remarks on voting rights, either during it, before or after, Merrick Garland made no mention of all of these revelations. But what we do know is a list of investigations are being lined up so the Justice Departments Inspector General announcing they will look into these subpoenas used to obtain records from not only Members Of Congress, but also members of the media we previously reported had their phone and email records obtained, including our own grubauer correspondent, barbara starr. So, this Ig Investigation Will Dig into these issues about whether doj under Attorney General Sessions or Attorney General barr whether it complied with its own policy and procedures. Theres that on the doj side. That on the other side, in congress, Chuck Schumer and dick durbin are announcing Jeff Sessions and bill barr to testify under oath. They issued this statement. Former Attorneys Barr and sessions and other officials involved must testify before the Senate Judiciary committee under oath. If they refuse, they are subject to being subpoenaed and compelled to testify under oath. In addition, the Justice Department must provide information and answers to the judiciary committee, which will vigorously investigate this abuse of power. We have reached out to former Attorney Generals barr and sessions and have not heard back. Sources told us Jeff Sessions was not involved in any of these subpoenas related to the House Intelligence Committee. As youll remember, he made a broad recusal from the russia investigation. Because this investigation of the House Intelligence Committee members or staff or even their family members, this was all related to any possible leaks related to trump aide contacts with russian officials. So, Jeff Sessions, a source that is familiar with this, says he was recused from this and not involved. But a lot still to uncover as we see from these multiple investigations being announced or even requested from lawmakers. Victor and alisyn . Jessica, thank you so much. He spoke to politico. In this article he said that he was not aware of any congressmans records being sought in a leak case. He added to politico that trump never encouraged him to zero in on democratic lawmakers who reportedly became targets of trumps push to unmask leakers. Also said that the former President Trump was not aware of who we were looking at in any of the cases. I never discussed leak cases with trump. He didnt really ask me any of the specifics. So hes trying to distance himself and the former president from what we now know appeared to be unprecedented cases where the Justice Department went in and got records from these Members Of Congress. Its one thing, of course, for the former Attorney General to say that to a news organization. We welcome him to come on this one as well, but as you just heard from jessica, the Members Of Congress who are very upset about this and want to do their oversight want them to come and do it under oath. You worked for an Attorney General. Is that plausible, what bill barr has just said to politico, that he had no idea that any democrats records would be collected . No, thats completely implausible. As dana just said, its one thing to say that to the media. Its another to say it under oath. When i worked for ms. Reno, anything that was sensitive like that, lawmakers, reporters, it had to be run up the chain to the highest levels and in addition to that, at every level it would have been met with skepticism and rigorous scrutiny because this is exactly the kind of thing you want to the guard against, even the appearance of the department being used as a political weapon. So, jennifer, to you. Does this sound like the donald trump that we know, that donald trump would have never asked bill barr about these investigations and we remember the testimony from james comey about asking about some of these investigations. What do you hear in this response from bill barr . Well, you know, victor, i would agree that it doesnt sound very donald trump like to stay out of it. On the other hand, there was no secret what he wanted to happen. I mean, bill barr didnt have to have an explicit conversation with the president to know that he would be in favor of and encouraging of seeking records against his political enemies. You know, maybe it was unspoken, but we all know what donald trump wanted his Department Of Justice to do and it sounds like in this instance, bill barrs Department Of Justice was willing to do that. Dana, we just played in the last hour that moment between bill barr and then senator Kamala Harris where it was at the Senate Judiciary committee, she asked him, has anybody asked you to open an investigation. He stammered and stumbled and looked like a Deer In The Headlights throughout the entire answer. Never said no. Asked her to repeat it. Asked what suggested means. Now you see it in a totally new light. He couldnt say no to that under oath. Its so true. We knew it was a moment at the time because of the strong questioning and more importantly because he didnt give a straight answer at all. And now it appears we know, despite the fact that in this new politico interview, the former Attorney General is claiming he didnt know anything about this. I obviously defer to the experts on our panel who actually have the experience being in Justice Departments where sensitive notions like investigating Members Of Congress or maybe even seizing the records that they have and those of their children, including a minor child, i mean, how do you not do that . The only potential answer is to have deniability. Even that is hard to swallow. Merrick garland just spoke about a very important topic, protecting voting rights. But consider all that is happening in and around his department, the coverage of it, he didnt say anything about this. No comment at all. Are you surprised by that . I am surprised by that. And i have Great Respect for Attorney General garland as well as his staff, including lisa monaco. But they need to step forward on this. They need to make a statement that at the very least they are going to vigorously support the Inspector General investigation, which has limited, victor. He can only compel current employees. So, they can look at policies, talk to current employees. But the big fish, barr himself, that that has to come from congress or potential criminal investigation with a grand jury. And what does that mean, jennifer . If people want to get barr again, under oath, which is where he fumbled through that question from Kamala Harris, how will that happen now . Well, the oig cant do it. It has to be congress. We all know how ineffectual congress was during the last administration in terms of getting people to comply with their subpoenas and before that their request to testify. But if they want to know the answer to this, if we all want to know the answer to this, they have to stand firm, subpoena him and fight it in court to get him in the chair to answer those questions under oath. But can he say these are privileged conversations . You know, i had conversations with the president and i dont need to disclose those . Well, he can try. He can try for an executive privilege. Remember, he said there werent any conversations, even though that wasnt under oath. Thats going to be hard for him to take that line here. You know, i would expect him to continue the tack hes taken which is they didnt discuss it and try to weez weasel around in which context they did or didnt come up to something similar to that topic. Dana, Congressional Republicans have tried to perpetuate this line of deep sat inside of the Department Of Justice that even former President Biden was using the Department Of Justice to go after republicans. After this reporting, were not hearing anything from top republicans. We are. Were hearing the sound of silence, victor. And its deafening. Its deafening. Thats something. I wouldnt be too optimistic about Progress Being made but i would be certain President Biden will raise the issue of alexei navalny, will raise the issue of human rights, will raise the issue of russian aggression in Eastern Ukraine because he has made such a commitment to try and reinstate International Norms and reinstate these traditional liberal democratic values. President trumps Justice Department secretly seized private records of sitting Members Of Congress, their staff, their families, all in an effort to track down leakers. Its shocking but not surprising. The former president made no secret about his obsession with leaks. Youll remember disgraced former president Richard Nixon was also obsessed with leaks. It led to the Watergate Hearings and nixons eventual resignation in 1974. Joining us now, someone who remembers that scandal well, cnn distributor john dean. He was president nixons white House Counsel and also with us cnn chief political analyst gloria borger. Watergate is also seen as the mother of all political scandals. From what we know about the Bombshell Revelations of what the Trump Department of justice was collecting in terms of democrats, now we know, and reporters, phone records, et cetera, and gag orders, how does this compare to watergate . There is a slight comparison with reporters. There is no comparison at all with Members Of Congress. I can recall no instance where nixon went after a member of congress using anything improper or even in the slightest bit devious. With reporters, he did. He wiretapped reporters at one point. When it was legal, he had the director of the fbi, j. Edgar hoover, tap reporters and white house staff as well, trying to track down leaks. When that became illegal by a ruling of the supreme court, he pulled the taps. So he did stay within the law on that, but he was aggressive in going after leaks, no question. Gloria, i know i revisited this a few times, but republicans abandoned nixon, right . Weve got now republicans who are sticking with President Trump it. Two impeachments and no condemnation from republicans after were getting this reporting. Yeah. Not only no condemnation here but no calls for clarification, no calls for further investigation. You have an Inspector General now thats going to be looking at this. No republican saying, thats exactly what we need. We need to get to the bottom of this. We need to have bill barr, the former Attorney General, testify. We need to have Jeff Sessions testify. The democrats are calling for that. But you would expect, even in the age of trump, that there would be some republicans saying, look, this cannot stand, this kind of investigation, spying, on democrats who were investigating the president. I mean, the guardrails are off and at some point republicans have to say, this is not good for american democracy, and so lets just get to the bottom of it. John, because youve seen some version of this movie before and lived it, what is about to happen next or what should happen next . Well, the counsel, the Inspector General law, is actually a postwatergate law. That does give some apparatus to effectively investigate it internally. What happens, whats needed is a congressional inquiry where they can, indeed, Order Sessions and barr to come before congress and explain what they did or didnt do. Whether theyll do that or not, i dont know. Ive been surprised this congress hasnt done more to put some teeth in its subpoena power. Its one of the weaknesses in the separation of powers where the executive branch, even former members of the executive branch, can stonewall almost indefinitely. We just saw mcgahn after two years finally come to the hill. So, thats what needs to happen. Thats what normally would happen. We dont know what will happen in this instance yet. John, are you surprised that were here . Congressman schiff said the norms that were put in place after the Nixon Administration were supposed to protect against Something Like this, but even they could not stand up to the Trump Administration. Are you surprised were having this conversation . I am. Actually, that norm hes referring to, directly involved me. It was the fact that i had gone to the prosecutors early and talked to them and nixon wanted to know what i had told them and how it affected him as well as his top aides, his Chief Of Staff and his top domestic adviser. And he was pumping the head of the criminal division, brought him over to the white house, sat him down and intimidated him into talking about what i was talking about. Thats the basis of the norm. Thats a nonowhere a president becomes directly involved in a case. So i have a special sensitivity to that norm. Im sorry to see it violated as it has been by trump on a number of occasions. And the interesting thing here is that donald trump never made any secret, as you all know, of who he wanted investigated. He wanted adam schiff investigated, he wanted andy mccabe investigated, he he said it publicly that schiff was the leaker, for example. So, barr, who told politico today that he didnt have any direct conversations with the. The about this, didnt have to because the president told everyone or anyone who would listen that this is what he wanted. So what barr did is he took a defunct investigation, it was over under sessions, they never found anything, and he reinvigorated it and then appointed someone to be in charge of it because the president of the United States still was not happy. And, you know, that is just an exploitation of the Justice Department and i think the Congress Needs to get to the bottom of it. The question is, once they get to the bottom of it, what can they actually do about it . Who does bill barr answer to at this point as a private citizen . Well, look, we have some early details about what this deal actually includes. We know it is 1. 2 trillion in infrastructure spending. We also know 579 billion of that money is new money. One of the Question Marks we still have is whether or not democrats would be able to rally around a proposal that five of their more moderate members came to a consensus on with republican counterparts. One of the concerns you have heard behind the scenes and publicly from democrats right now is that they are worried that the people who are negotiating this in the middle, people like senator joe manchin, people like cinema of arizona, that those members are not going to embrace a broader, robust Infrastructure Plan they think is necessary. Thats why youre seeing someone like Chuck Schumer argue, this is now moving on two tracks. He believes that a bipartisan deal could be reached potentially with changes that need to be made to this Bipartisan Groups proposal. In addition, democrats could move forward on their own bill using that process known as reconciliation. That, of course, allows democrats to pass a bill with just a simple majority. But you need all of your democratic members to do that. And i think that is where the challenge really lies on this moment. What does the white house say . Well, the white house says this is a good start but they have some questions about exactly what this proposal will include. They were briefed yesterday from some democratic members, but right now what weve seen is these top lines. What you dont see is a breakdown specifically of all of the pay fors on paper nor do you see where exactly this money is going to go. Whether thats rail or highways.
