meet him so bad. met him. they really spent the evening together, the latter parts of the evening. he has a phone and is texting his girlfriend the whole time with texts that i think help the prosecution that he's touching me. he's inappropriately doing things. and the defense said this are text that's are missing. we deserve that cell phone. he didn't give you the whole picture, prosecutors. so the judge actually said, all right. this young man and his family, they have to turn over the actual phone to the defense. they now say they can't find it. they don't know where it is. and so the judge said if you can't find that cell phone by monday, july 8th, i want the family to be in court and tell me why you can't find it. >> so then what happens for him monday? kevin space quliy him. >> if that cell phone cannot be found which the defense alleges have texts on it that could actually help show it was consensual or the nonexistent,
