Gerrymandering combined. What was the ruling on that one . We had two Different Cases involving partisan gerrymandering. One out of maryland. Another one out of north carolina. They ruled that partisan gerrymandering is something that courts should not get involved in. Its what they call a political question. Something that should be left to congress and the political proce process. The problem with political gerrymandering is that everybody has long known and accepted that when youve got state legislatures who are drawing maps, of course they will consider politics and the problem with political gerrymandering is how do you decide when a districting map has gone too far when youve considered politics too much. Weve never been able to come up with a workable standard to figure out when a map crosses a line from being a permissible use of politics to an unconstitutional use of politics. Were not going to try, in essence. Some states have set up in an effort to take the politics out of redistricting but courts arent going to get involved in. Both of these cases sent back to the lower courts with instructions to dismiss them on the ground that courts dont have the power to hear them anymore. Looking into the future and he referenced several other states, what does that mean for those cases and maybe future cases . Cases with ongoing and in federal court with ongoing political gerrymandering cases are likely to be dismissed on the ground that the courts dont have the power to review them. I think the opinion probably left open the possibility that states could have their own jerry mandsje gerrymandering cases. There are cases, for example, that have been cases in pennsylvania recently involving partisan jergerrymandering unde the state constitution. Justice kagen delivered the dissent from the bench. You said this doesnt happen but it was a long statement from the bench and she appeared to be very passionate and her opinion. The justices dont often deliver their dissents from the bench. When they do its a sign they are dissatisfied with the opinion thats being delivered. She had a pretty remarkable line at the end of her opinion. Something along the lines of respect and sadness i dissent. She talked about the effect she believes this decision will have on american democracy and the idea that the challengers as the product of partisan gerrymandering that legislatures can choose their own constituents and that the problem can be selfperpetuating. If you have the republicans and the democrats have power then they can draw the maps to ensure that they have power in perpetuity. Not only will that enable one party or the other to have a hold on that states clelegislae or that states delegation but i think theres a fear among the challengers that people will feel like their vote doesnt matter because of partisan je y gerrymand gerrymandering. The next term doesnt start until october. Any petitions youre looking at that could come before the next term that are huge . A couple were watching very closely. One the justices are likely to consider at their Conference Today is a group of petitions to end daca. Its a program started during the Obama Administration that allows undocumented immigrants who came to the United States as children to apply for protection from deportation. Allowed them to get drivers licenses or to work in the country legally. The Trump Administration decided to end the program and several different courts around the country blocked the Trump Administration from ending the program. The Trump Administration has gone to the Supreme Court and asked the justices to review those decisions to allow it to go ahead and end the daca program. Another possibility in light of todays decision in the census case is that Supreme Court decide it wont hear the cases. It will send the cases back to the lower courts for another look at the Trump Administrations motives in ending the program. Theres case out of louisiana. They blocked the state from enforcing a law. They said it was similar to a texas law that the Supreme Court ruled unconstitutional when Justice Anthony kennedy was still on the court and the Supreme Court will be reviewing the challengers petition in that case probably when it comes back from its summer recess in october.
