Why does Congress Need to look in the mirror on this issue . Guest because it has, in many respects, become an enabler of persons who engage in Sexual Harassment. I say that because, first of all, there is no requirement that members and staff take Sexual Harassment training. There is aen requirement to take ethics training but not Sexual Harassment training. Then, if you do complain it is to an office that no one knows about. The office of compliance. It is really constructed in such a way that it is there to protect the perpetrator and not there to protect the victim. Host for folks unfamiliar with how capital works, why is the structure of how this is set up different from the rest of the federal government what they might see in their own workplaces . Guest there is a requirement in the rest of government for Sexual Harassment training. There are officers an equal opportunity that yout can go to for support and here in congress we have a patchwork that is inappropriate. Ill give you an example. First of all, interns and fellows have nowhere to go and yet they are, in many respects, the most vulnerable. Ifd you do have a complaint go o the office of compliance and they are you are given up one month in which you are supposed to providepo legal counsel. It is typically one section and they tell you the ropes. Then if you agree to move forward you sign a nondisclosure agreement in perpetuity and then you go into mediation. In mediation theres a mediator, there is you and there is the house of representatives general counsel representing the perpetrator. In the most recent case in which i talked to one of the victims he was trashed by the House Counsel saying you will never work here again if you move forward with this using intimidation and after that mediation was completed then you have one month enough. In that period of time you have to work in that environment. It is an unsustainable and indefensible program. Host you mention your conversation with one of the victims but this is an issue that you experience personally on capitol hill and you talked about. Can you explain . Guest when i was a staffer back in the early 70s the chief of staff in the office in which i worked one day to me and we were alone in the office and he took my face, held my face, kissed me and stuck his tongue in my mouth. I recoiled and i panicked and i made sure that i was never in a room alone with him again. Back in the 70s we hadnt coined the term Sexual Harassment. The courts had not determined that it was a violation of title vii, Civil Rights Act. So, it was not nearly as undefined as it is today, nor in many respects is it recognized back then as being a conduct that should be punished, we clearly appreciate that today. Host do you get a sense of the problem on capitol hill is as prevalent today as it was back then . Guest it is and probably more so. Host why . Guest because we have a system in place now which the perpetrator is never doubted, the perpetrator never pays ason price, the cost of any settlement is taken out of the us treasury and all of us as taxpayers pick up the tab. The members reimbursement allowance which is the way we actually run our office is in impacted by it. Its a get out of jail free card for those perpetrators. One bill require members and staff to have Sexual Harassment training, mandatory every year. The on that the second bill will provide a means by which you do not have to sign a nondisclosure agreement and there will be a special Victims Counsel available to the victim to support and represent the victim. You will not be forced to go through mediation and when you look at most Sexual Harassment cases you either go to the media or file a lawsuit. On capitol hill you cannot do either. If it becomes known that you have filed the Sexual Harassment complaint there is a likelihood that you will not be hired in another office for fear that you are going to look for a means to create trouble. Most people, men and women, do not even file complaints. Three quarters of those were sexually harassed in society never even file a complaint. The finance committee will be rolling out their proposal, the starting place, what we call the germans market at the end of the week. This week we are confirming once again a number of administration positions that frankly should have been confirmed but we are hoping that we are getting close to getting a better place with the democrats on confirming executive branch appointments to the administration. Amid the controversies that surround the Second Amendment to the constitution there are areas of consensus and that has to do with the background check system, keeping guns out of the hands of people with mental illness, convicted felons, people who commit Domestic Violence, tragically, we saw the system to fail and 26 people are now dead and 20 more wounded as a result of the tragedy that occurred in texas this last sunday. We intend to work with colleagues in the administration to come up with legislation that will both ensure the fact that the federal government, particularly the timing of the fence, and military princes comply with the law and upload this information to the human uniform code of military justice proceedings. That all of those would be uploaded into the background database but also come up with an additional set of carrots and sticks where necessary to instead by the states to likewise comply with the law and upload those results into the background databases because when the shooter or the gun purchaser like this individual lies about their background he lied about the fact that he had a felony conviction and lied about the fact that he had been convicted of a crime of Domestic Violence then the only way to catch them is through the background database, the next system and i believe there is an opportunity for us here to work on a bipartisan basis to come up with a way to address this one consensus solution to a very real problem which may well have prevented the outcome we thought current in texas last monday.
