When is he going to do an interview . He finally didnt interview. It was fine. It didnt really change things much but really harris throughout her very shortly and pain has been having a oneway conversation. It has not been a twoway conversation. She has been able to control the outgoing message and hasnt really had to deal with a lot of incoming. She has done these quick gaggles by the by air force two or in the hotel where its rapid fire questions, rapidfire answer is no time for followup and president s love to do that. Former President Trump likes to do it. President biden likes to do it. You know, its chopper talk and that puts the candidate or the president in the drivers seat because they are choosing the question they ask and they can walk away when they want the camera is not rolling actively here settings right . Its very different. Taking a couple of questions on a tarmac is very different. A full sit down interview where there is backandforth for someone pushes you on past positions but also, i think this is in some ways an extension of the biden approach to interviews, which was there was a lot of skepticism in his campaign and his white house about the utility of traditional interviews with traditional outlets like ours certainly for harris shes had a month of largely positive press. They have been pushing their message out. Theyve just gotten through the dnc and so i think there is this sense of east among some people are under that they are they have a lot of Forward Momentum without inner yeah. And thats the thing its the incentive to continue on doing this. The polls are looking great. It looks she has been inherently a very cautious politician. I mean, i interviewed him many times as a senator asking you a questions and her sidestepping those questions because shes doesnt take sometimes a sort of positions because hes worried if you take a certain position, youre going to get hammered for it. But then if youre very cautious, youre getting hammered for it as well. So do we think that her approach will be different now as the president ial nominee and not having as not being the running mate, having to serve the president for i dont know if theres enough time for her to take a dramatically different approach. And so far, the incentives for her to stay the courts have been pretty positive for her. Its not like ive heard democrats say, why should we rush to do an interview we like how the narrative is going right now. We like that we are on offense. Why change that . And its clear that republicans in this moment want an interview and want her to trip up as she has in the past and then clip that and push that out. And they are really hoping that this burst of enthusiasm for is just a bubble. And of course thats what the trump and Vance Campaign absolutely want because they need to change their narrative, which has been going against them really since he jumped into the race. But look, there are things that she has said in the past that shes going to have to answer for and then she suggested or campaign has suggested she has changed her position on the issue of fracking. For instance, she said that before in the past in 2019, when she was a primary candidate running for the democratic nomination, he said she was opposed to fracking. Shes changed her position on that issue. Medicare for all singlepayer health care. She had there have been opened and medicare for all. Now go campaign is saying background mean not necessarily on the record. Now from the candidate herself, that she is no longer in favor of that. Those are complicated questions you have to explain how she reconciles are current views with our past fields. And i was actually thinking about that today, about how different this is just given the unprecedented that nature, because she didnt have to go through a primary yes, she did. Back in 2020, but this time around, she didnt have that almost immediate recollection of the American Voter of her talking about Ending Fracking of her talking about these farther left policies that was now what, four years ago and we know that the American Voters memory is very short. She has this opportunity to kind of change the narrative because there is not this instant recollection of something she just said in january of this year. But again, as you said, there are still questions about how you can go from a to b particularly make those kind of tight turns at a time where obviously pencil well then you might be the most critical state fracking very important in pennsylvania to change your opinion on that and then not answer questions. And thats obviously what youre hearing from republicans and the Trump Campaign. Im not sure that the narrative is loud enough from republicans and the Trump Campaign at this point to try and force for to do something, as you said, democrats are pretty happy with the way things are going right now. But she has now said that shes going to do an interview by the end of the month were getting to the pretty meantime, i want to turn to what you have some new reporting about the Trump Transition Tier about some of the new people on trump including rfk junior, who said that over the weekend, there was no sort of quid pro quo, no deal, and the like, but it turns out that both Tulsi Gabbard, a former democrat who is now endorsing trump and rfk junior have a role in at least selecting the next people in the government . Yeah, theyre going to have a big role in this the Transition Team has four people so far, so adding them to a fourperson team, making it six people, thats a pretty substantial amount of weight that theyre carrying. And it will tell you part of this is because theyre trying to reach they being the Trump Campaign, the damage for graphic that does support Tulsi Gabbard, that does support rfk, which they believe is a pretty similar demographic obviously, both of them, once progressive democrats now have shifted Conservative Rfk most, the most substantial stiffing supporting donald trump in this election, but they also were trying to make those voters that Tulsi Gabbard, the rfk voters, voters who dont usually go to the polls. Remember, go to the polls in november, the question is, how do you do that . And part of thats going to be saying, well, they have a role now in the administration, so its not just oh, they like me theyre going to help the people you like if you elect me are going to help put the other people you like into my administration. So theyre trying to go a step further because they want to drive those independents to vote independence again, who they see that 6 , theyve done to actually show up, but that could give harris something so certainly, i mean, the oppo file on both gabbard and rfk junior is massive. The other question about the transition is, as you might remember, the Trump Campaign had a robust Transition Plan in 2016 put together by chris christie. It was thrilling now, and it turned you know, the partnership for Public Service did a call yesterday. They described the 2016 transition as one of the worst transitions ever in part because the transition was thrown out so this is a great honorific that is being bestowed on these people, right now. Will they actually be selecting the government or they make an imaginary document that will go anywhere, i guess well find out to keep them happy exactly right. Yes. A big part of it is showing showing right. It does rfk junior in the trump camp have any impact on this race . I mean, i think to the point about vote, there there are there are voters out there who are interested in rfk. There are independent voters. Theyre trying to pull in. I mean, i think a lot of those things is there unclear and i think we need to see more polling but certainly at certain points in the campaign, he was pulling a decent amount and polls. So i think there were, but that also some of that was a universe where people were unhappy with both biden and with trump. The plates have shifted yeah. Ive kept an eye. Well, well see if well will happen, then well see if theres going to be a debate on september 10, still debate over the debate, of course, as well. All right. Well for 326 days, this man, a 52yearold father of 11, was being held hostage by hamas inside the gaza strip. And today in a its very successful rescue operation, the Israeli Military rescuing him from an underground tunnel in Southern Gaza we dont have a ton of details about the nature of this operation. This is only the fourth time that these really military has successfully rescued hostages alive from gaza. But it is the first time that have seen them do so in an underground operation and all of the other cases, the hostages were rescued from aboveground locations in homes and buildings in the gaza strip. Now once he was rescued from that tunnel, we then saw video of him with Israeli Soldiers and what appears to be a home or a building in the gaza strip. And then he was taken by helicopter to Soroka Medical Center in southern israel, where doctors theyre evaluated him to be in good medical condition. Thats also where he was finally reunited with his loved ones, including several of his brothers, who said that they had started to lose hope that their brother might even return from gaza alive. Fox news had to settle with dominion over those false election claims, but there was threats of physical violence that threads that occurred. There for dominion, but its also part of a larger issue about personal safety for some of these Election Officials, right . Yeah. And there has been an exodus of Election Workers that just did not want to put up with the abuse this time around, both for the people that are still working they critical part of our democracy. So we should be grateful to them. They have beefed up their physical security at their offices. Theyve invested more than ever on the security. Hes asking an Appeals Court to overrule her decision, and that cannons quote, Novel Conclusions lack merit. Lets just want to several significant legal developments involving the former president that were watching this week joining me now to break this all down, cnn senior crime and justice reporter katelyn polantz, and cnn senior legal analyst, elie honig. Nice to see you both great legal news is back. Were back with i appreciate that okay. So lets start with the new filing here. Tell us a little bit about what jack smiths argument he is. Youre in would do you think it will have any merit when the Appeals Court . Well, the top line manu is they want to revive the criminal case against donald trump around classified documents. They want want that to go to trial still, even though the judge dismissed it there at the Appeals Court. Now just said that the Special Counsel lacks Constitutionality Total to get dismissed. Close the case, the Appeals Court will now look at whether that reasoning was right, but what they have to do here and what theyre doing in a very lengthy and pretty forceful filing with a lot of history a lot of lot of back them up is to say, hey, let us do our thing. Weve been doing it for decades, even back to after the civil war. And what we want to do is be able to use special investigators, special prosecutors. One of the things that theyre arguing is that if this decision from Aileen Cannon stands at Appeals Courts endorsed her thinking that its not constitutional to have a Special Counsel, then that could cut out all kinds of abilities of the people in power to appoint people. A quote, if the Attorney General lacks the power to appoint inferior officers, that conclusion would invalidate the appointment of every member of the Department Of Justice who exercises significant authority and occupies a continuing office. So big ideas here that the Appeals Courts can have to look out months from now. And do you think that has merit, elie and also, if the Appeals Court sides with jack smith, how quickly will this go to trial . So i do think jack smith is ultimately going to win here as of this moment as we sit here, the case is dead. It is this is the classified documents case. Its been dismissed, but i think its going to be revitalized. I think its going to be put back on track by the Court Of Appeals. And heres why Donald Trumps not the first person to make this argument. Plenty of people whove been the subject of Special Counsel investigations and prosecutions have argued before this whole scheme is unconstitutional because Congress Never specifically he said, okay, doj, you now have a position called Special Counsel, but that arguments been rejected or is rejected. A molar. It was rejected in one of the hunter biden case. Its been rejected by an Appeals Court. Judge. Cannon is actually the first one to accept it. And the reason that it has passed constitutional matters because there are various laws passed by congress that say the ag can delegate his power, his authority, basically, however necessary to carry out his goal. So i think the 11th circuit will probably reverse this. And if not, it could well go to the Supreme Court. I dont know either way it could go to the Supreme Court. I dont even think the Supreme Court is going to go with trump on this one. It meantime, of course, there are several legal cases involving the former president , one in georgia, the election subversion virgin racketeering case. This is just mired in all sorts of problems for the prosecution. Fani willis is facing a lot of pressure here to be dismissed from this case include from the Trump Legal Team that made this case just yesterday. What is their argument to try to get her off the case . Yeah. Theyre really digging into say that she just has not been a fair prosecutor and theyre in this appeal keel to try and get that case essentially, its on ice right now, but to get it frozen for years, if if even if we come back indefinitely, right. And so what theyre digging into specifically as fani willis having given a speech at a historically black church in georgia where she spoke about being a prosecutor who was black and the trump team is saying that shes injecting racism into a highprofile trial, and that should not have happened. Thats not what the judge at the trial level said. He said that she could stay on the case, but it is going to be before an Appeals Court. And what is the likelihood she gets to i think theres a big problem here for fani willis and i think the problem is bigger than her being dismissed. I think the whole case could get thrown out because what trumps arguing in the brief he filed yesterday is my fundamental Constitutional Rights were violated. Here we have an elected da, a person who had already been warned by the way, by a judge about her extra judicial outside of Court Statements that they could be prejudicial to the defendants. And she goes in a church in her county where the jury will be drawn from and makes this wildly inflammatory, inappropriate speech essentially blaming the defendants, calling them racist. That is outrageous. And that could well get this case dismissed. So i think theres a real problem here for the da, and i think i think we may have seen the end of this case. I think theres a chance that Court Of Appeals just says prosecutorial misconduct. Its done. So meantime, theres another great case but yeah, its we are not god bring goods, no federal election subversion case. Of course, its been on ice as this bound over immunity took place before the Supreme Court. The Supreme Court sided with donald trump, who just a reminder, the viewers, just to look at the charges against donald trump in that Election Interference Case is still pending and theres a big hearing next week, elie, what do you expect from this hearing . And this is probably about jack smith really trying to reconcile that Supreme Court ruling with this kate, the charges against this, this is the biggest of all the cases. This is the Washington Dc Federal Case brought by jack smith relating to january 6 and 2020 elections aversion. This is the case that the u. S. Supreme court, back in july essentially gutted with their immunity ruling, and they werent super specific, but they said a lot of this case is going to be immune and needs to be pulled out of it. And now we begin the very complicated really first time its ever been done, process of jack smith and trumps defense team, and the judge having to sit through this indictment and decide, okay.
