right now on cnn this morning, president biden about to roll out a sweeping executive order to turn back asylum seekers at the southern border. >> we've got details plus opening arguments set to begin in just a few hours and the federal gun trial of hunter for biden and the white house, pressuring israel to end the war in gaza, a move that might cost prime minister benjamin netanyahu his jaw all right? and 5:00 a.m. here in washington alive. look at capitol hill in this tuesday morning, everyone in cases it's wonderful to have you with us. >> congress couldn't get it done. so today, biden, president biden is expected to take action on the border crisis on his own. cnn has learned that the president plans to announce an executive order that will effectively shut down the us, mexico border. to asylum seekers crossing illegally. when the daily threshold of crossings is exceeded the executive order relies on a regulation that was enforced under the trump administration at that time, it was widely denounced by democrats this does mark a significant attempt by the president to address head-on. what is one of his biggest, if not his biggest political vulnerability? >> just weeks before his first debate with donald trump, that is set for right here on cnn axios reports this morning that biden is expected to announce and sign the order today at the white house. >> she'll be joined by south texas mayors. i am joined by one of the coauthors that report axios political reporters, steph. steph. good morning to you. wonderful to have you let's dig into what we know about this. >> this number, 2,500 is a key piece of this, and it's different actually from the bill well, that democrats had supported in congress that they were trying to get across the finish line. what's the difference here the difference here is that they're focusing on just the number of people crossing the border illegally. >> that's what that 2,500 threshold is targeting. the bill. before that, we saw that was the bipartisan border deal focus on a larger number but it also included people who are arriving at legal ports of entry, but who maybe didn't otherwise have permission to enter the us. so it's just a little bit of a shift from what the focus is in this executive order. it's really focusing on people who are coming across the border illegally. but beyond that, it really effectively works about the same way as that bipartisan border deal, except it doesn't come with the resources that only congress can give the white house and the department of homeland security, which could make it harder for the administration to actually put this in effect. >> what does the timing tell the tell you about, about their thinking here? >> yeah, the timing is very interesting we know that they have been very seriously considering this move for months now, i've been hearing from sources for a very long time. this was something that biden was considering feeling like they needed to come out stronger and tougher on this border issue. it's been a clear vulnerability for biden from republicans basically since day one and his administration. >> and there are few things to note about the timing. >> one being that this obviously comes before the debate. so biden will be able to talk about his action on the border at something we know trump is going to want to talk about. it comes before the democratic convention. any internal party disputes over this move, hopefully we will have calmed down before then. it also comes after mexico's elections and it comes after chuck schumer was able to force republicans two again, killed that bipartisan border deal on the floor, again, allowing democrats to try to pin this on when republicans, right and try as they might though, this does represent a significant political challenge for democrats who are up for reelection in difficult states and they're not planning on showing up today. >> and i think we can put up the picture of some of these folks who are not gonna be there. they are the senators from montana, wisconsin, nevada, pennsylvania. these are places where they have uphill climbs here i think it tells you something about the politics. >> yeah, absolutely. and of course, you can't look at this move and not see it as a political move and addition to trying to address a serious problem biden is trying to provide himself cover from border attacks and he's likely trying to provide some of these vulnerable democrats cover as well, allowing them to say that they support these new restrictions on the border that biden is doing something to address the problem. so i think it's notable that none of these very vulnerable democrats are accepting this offer from the white house to come join biden at the white house as he unveils what is really one of his, if not the biggest border move biden has made to date. >> let's watch a little bit of what the house speaker mike johnson sun had to say on this recently on fox on sunday, watch is too little too late. now he's trying to desperately show the american people somehow that he wants to address the issue that he himself created, now he wants to issue some sort of executive order, i guess to show that oh, no, he he really does care about the issue. the only reason he's doing that is because the polls say that it's the biggest issue in america. >> and we can of course put up also the gallup poll that it's unclear if the house speaker was referring specifically to this poll with the gallup poll that shows that immigration is what americans tell gallup anyway, is the most important issue here. so i mean, how if you're the white house, how do you strike a balance between putting this out there and also just trying to avoid making the national conversation about this issue i think this is the debate that the white house has been having internally for a very long time. >> they're very nervous about this issue. i've reported by and doesn't like talking about the border. this is not something he likes to draw attention to, but it's clear that they've been looking at the polls and they know that this is something that they have to address. golf isn't the only poll we see polls repeatedly showing that americans care about immigration and also that they are more open to harsher restrictions. the harsher moves, especially when it comes to illegal border crossers. at the us-mexico border. so this is clearly i'm reading the signs and recognizing that they need to do something on this they also know that we're going to be seeing in the senate at least a quick pivot to abortion and reproductive rights as we near that, the two-year anniversary of the fall of roe v. wade. and i do think we're gonna see them ministration try to address the border and then move on to their the issues that they are more confident in. >> and of course, we shouldn't forget to note, this is not going to sit terribly well with progressives. we've to focus on the us election because he's obviously close to donald trump as well. but he is going to run and it's a big threat because it's going to take away from the conservative vote and as rishi sunak has said, a vote for nigel farage is actually a vote. the labor, the left party because it'll take votes away from the conservative party has point is basically you're either going to have keir starmer as a prime minister or rishi sunak, if you vote for the reform party effectively, putting keir starmer in downing street by splitting up that support on the conservative side. very interesting to donald trump ideologically. they spoken to each other a lot. and i think that donald trump does take advice from nigel farage on certain parts of his campaign, or at least it did last time he was heading to the white house. so we're not quite sure what happened behind the scenes, but some cynics are suggesting he didn't get what he wanted from trump, which is why he's running here never dull a.m. local time because of this band of showers and thunderstorms and it's not just strong gusty winds frequent lightning and some hail that's come out of these storms. heavy rainfall. in fact, one to three inches, radar indicated flash flood warnings just south south of oklahoma city, including more. that's valid for the next 20 minutes or so. and a few other warnings to the south and east of that as well with this band of showers and storms. so here's the rough weather time i mean it out about 4:00 p.m. across the minneapolis saint paul region. and then we focus our attention on another flare-up of showers and storms across the deep south. that's why we have that slight risk, including dallas and points northward. we're going to focus our attention on the severe weather here. but this is all building across this collision of air masses, heatwave across the southwest, cooler weather over the east, and this is what we're talking about. heat indices will reach roughly 120 degrees morning, everyone. kasie hunt, it's wonderful to have you with us in just a few hours opening statements are set to begin in hunter biden's federal gun trial. biden is the first child of a sitting president to ever go on trial yesterday. 12 jurors were seated six men, six women, the majority are black, some of them opened up about loved ones dealing with addiction while others admitted to owning a gun was of course, two major themes in this case president biden issuing a statement during jury selection, st. quote, as the president, i don't and won't comment on pending federal cases. but as a dad, i have boundless love for for my son, confidence in him, and respect for his strength. the president's allies on capitol hill noting the difference between this case and donald trump's the hunter biden's not running for president. donald trump's running for president. but look, that's the perfect example. democrats were not out there saying that hunter biden's trial is a far sits of fraud. it's rigueur. we're not attacking the justice system all right, joining me now from wilmington, delaware is axios national politics reporter, excuse me. >> alex thompson. alex, good morning. it's wonderful to have you joining us because you were inside i had the courtroom yesterday, and of course, you can't help but miss that this trial is taking place while biden's campaign staffers going to work very nearby in the same city, but bring us inside the room. what was jury selection like? what was it like to see a hunter biden in that courtroom? >> yeah. there are a few really striking things. one is the contrast with just a year ago. >> now in the same courtroom, it's where the plea deal that almost resolve this all a year ago took place and back then, hunter came solo. essentially, this time he was surrounded by family and friends. you obviously had the first lady you had his son-in-law, heater, neil, you add his sister, ashley, you add his wife, melissa. you had friends including even a documentary filmmaker that's been following him around the last, the last two years. the other thing with jury selection, the thing that really stood out to me that you just mentioned before is the sheer number of people that mentioned that they had a loved one or friend, a family member, who had suffered from addiction in some cases, people had personally had problems to alcohol. i haven't done the exact numbers, but i believe almost every single juror had said yes to that potential juror question. and part of the reason for that is because delaware is sort of ground zero for some of these, especially the opioid crisis it was just really striking that when you're talking about a case that's really going to delve into what is an addict. when does someone stopped being an addict win? in terms of hunter biden at this time was in and out of rehab? you're going to have an audience that is going to have intimate understanding of that system it's really fascinating because again, for those who haven't been paying super close attention to this trial before it started, the question at hand is whether or not a hunter biden effect essentially lied on a form that allowed him to buy a gun by saying he was not addicted to drugs at the time and you report in axios, quote, hunters, a hunter biden's lawyers have signaled they will contest that he knew he was an addict at the time. >> given he had just finished a short stint in a rehab program and they will allege potential tampering with the gun form that he signed how confident do they feel about trying to argue this, considering that there also is a lot of public material hill about his addiction challenges that he put out there into the public record himself and his book and elsewhere absolutely. >> no. and no lawyer is going to go in there and say, we don't think we're going to win so abby lows, which is juncture biden's high power attorney is expressed confidence and you could tell by the jury questions that he was really focused on. well, if hunter biden believed he had beaten his addiction at the time he signed the gun form that is going to be a key timing note. now, part of the problem is that as you noted, that there is a lot of evidence to the contrary of him basically going in and out of rehab. and unfortunately for the entire biden family you know, a lot of witnesses, they're going to call it in. our family members. you are going to see hallie biden the present, and also kathleen buhle. now those are a hundreds ex-wife and his ex partner both our daughters and lodge to the bidens, you also probably going to see lunden roberts, they arkansas woman who had a child with and was in a relationship with at the time and the reason they're being called is to confirm that he was infrequently sharrock use at this time. so it's going to become incredibly messy and it's going to be a family melodrama. and that's really the real effect on this cases because, you know, the president is probably going to be affected in his mood by all these revelations. right, alex, i mean, the new york times actually reports this, quote, president biden wakes up every day to a list of concerns he must address this commander in chief. but at the top of that list, people who know him say is a concern that nags him as a father. the legal problems of his son, hunter biden, and we can also show everyone this is president biden back in may of 2023. and of course, these travails have gone on you referenced the plea deal that fell apart. we're kind of in that period of time when the president is making these comments. but here's what he said about his son first of all, my son's done nothing wrong i trust him. i have faith in him. and impacts my presidency by making me feel proud so that of course, alex is his direct way of talking about his son and what his son means, but expand a little bit on what you mean in terms of how this is going to weigh on i mean, he is not just president of the united states. >> he's also a candidate for reelection less than six months out from that election day, less, you just a couple of weeks away from his first debate with donald trump in this election cycle yeah, and this would affect any father, but i think one thing about this relationship that joe biden has the sun that you have to sort of understand is that hunter biden is the last in-person from the accident that killed his wife and daughter 1972 beau biden had also survived that, but then he died in 2015 and joe biden is taken this calling hunter, my only surviving son, so it's a little bit of an extra hoof and, you know, him holding onto his son. >> the other thing that you have to understand as joe biden is expressed, guilt for hunter being in this situation because he feels that if he had not run for president, hunter would not be facing these legal challenges which carry a significant amount of jail time if he's found guilty. now, you have to look at the timeline at this case when a hunter biden was in that of rehabs addicted to crack cocaine, was buying a gun. this was october of 2018. this is when joe biden was planning to get in the presidential race. joe biden enters presidential race just a few months later when hunter is sort of in this spiral. and so you have to understand her, say, understand the context of when these events
