[ bleep ]. >> disturbing is the word for that. what is also disturbing, the graphic illustration of the consequences of our poisonous politics. >> the person was searching for me. and my dear husband, who is not that political, actually, paid the price. >> as nancy pelosi says, her husband paid the price. and it's a terrible price. one more question i cannot get off my mind, is what price will america pay for politics of violence? i want to turn to the former head of intelligence for the washington, d.c. homeland security department. and a faculty member at georgetown university. good to see you this evening. you and i spoke about this case when it happened. and the overall rhetoric who've seen in the past several years at the very least. from your perspective, how did it get, that the husband of one of the most powerful people in government, is attacked in his home by a hammer-wielding assailant. >> we got here by the caustic political environment. nancy pelosi has been the boogie man for her detractors over a w decade. and the with rise of trump, maga, there's some on the far right that are addicted to this misand disinformation and conspiracy movement. and words and tweets that are put out by politicians and people in the far-right media. there's individuals at home, that are unwell, like the one that has been charged with paul pelosi's assault, that are human nating on this. they are not happy people. they are taking the words and stewing in them. this is someone who is demonized and essentially assaulted. this is the environment we're in right now. >> what kind of terrorism? >> socastic terrorism. when you demonize a group of individuals long enough, those words will manifest. and this is the man testation of mis and disinformation, and demonization of a political party. >> when you talk about why this is relevant today, not only is paul pelosi on the stand today, but after he was attacked, people went to conspiracy theories. floating rumors he was gay and having an affair. and the overall distortion of truth, people can be more susceptible to have something over and over again. and having a face of who is supposed to be the villain. when that happens, all sorts of things can go wrong. you were sounding the alarm, leading to what happened on january 6th. people choosing their villains. in that case, it was political, as well. >> unfortunately, for those of us in this business, the targeting of a political figure is not -- was not something that was a surprise. what was a surprise, was as this man is getting operated on, prominent members of the far right and of the republican party, went to twitter, went to social immemedia to put memes. it normalizes this type of violence. i would love for you to put up on the screen the statement from the rnc denouncing this. but there was none. this is where we're at. many americans would find political violence unpalatable. unless the rhetoric is going to be brought down, peel have to get used to this type of targets, individual violence, until things get better. >> thank you for coming. people are probably going, oh, yeah. i think i remember this particular case. hearing about it today. and people thinking about all of the things that happened since. the normalization and the dismissing of what happened. thank you for joining us. >> thank you. i want to bring in sara matthews, and republican strategist michael singleton. i'm glad you're here. a lot of people forgot about this happening. and were surprised there was a trial going on. it speaks in many ways how distant a memory people make it when it happens. what is your reaction, thinking about, are we in for more political violence and rhetoric heating up more? >> i think so. i think a lot of people have the belief if trump were to go away or on the other side of this person were to go away, things would be better. i'm not convinced of that. i think there's a lot of people feel marginalized economically. and politically. and i think it's easier to point the a political leader's rhetoric. that's not to say tcan't inflam tensions. but that's not getting to the crux of what people are dealing with. how do we get the country to move forward as a whole, regardless of who is in charge? >> i'll talk about the moments of quiet. i don't know. i would like to hear about that. but in the meantime, i want you to hear this. run of the reasons it's so relevant, is the rhetoric has not stopped. tim scott dropping out of the race because optimism wasn't selling for a lot of people. you have grievance-based political structure. people say i like the anger because i feel angry, too. we saw results of dangerous political rhetoric recently. listen to what trump said over the weekend. >> we pledge to you that we will root out the communists, marxist, fascist and the radical left thugs that live like vermin within the confines of our country. >> not exactly our parents' version of political campaigning. why is this resonating? >> i think that donald trump knows this is the type of rhetoric his base wants to hear. he is always focused on his base. this will rile them up. it serves to divide americans. republicans were upset when hillary clinton called maga supporters deplorables. when trump wants to root the country of the vermin of his enemies, republicans are silent. the rnc chair said she wasn't going to make comments on it. the only one that made comments was liz cheney, who has moved away from the party, because of her willingness to call out donald trump for this rhetoric. and biden won in large part in 2020 because he said he was going to heal this country of our divisions. and it was a battle for the soul of the nation. and i think that americans are still really divided. that's a large part of why people are maybe reluctant to support him again in 2024. they thought that a vote for biden in 2020 would move our country in a better direction. and unfortunately, a lot of republican -- a lot of americans are suffering. >> the idea of one person being a solution, is always going to be elusive for people. if it were just the vermin comment, one thing. but there's reporting from axios, i want to share with you. they say, former president trump's allies are prescreening the ideologies of thousands of potential foot soldiers as part of an unprececedented corporati to centralize and expand his power at every level of the u.s. government, if he wins in 2024. by the way, up to 54,000 of them. that's an astonishing number, if true. >> lessons learned, i would suppose from the first time. within the first year or first couple months, they had a process of going through people's social media to see if you were critical of the former president. i was one of those individuals. if you were, you got the boot. you were fired immediately. this goes back to the political disenchantment of a sector of the republican base. and trump has figure out, we can debate if this is good or bad. he figured out that the people are starving for someone to be an answer of what they perceive a political corruption of the elite class. not only from republicans, but democrats themselves. as long as he has i am the answer, the resolution to this corruption, he's going to continue to have support. >> i am tickled that trump is supposed to not be the elite class. does this scare you that the recruitment. it was about having adults in the room. i joined because i want to be the adult in the room. but recruitment around philosophy is scary. >> this is one of the things i'm most concerned about if donald trump were to win a second term, is who would be staffing the second administration? you look at the first administration. and whether you liked all of the people who worked for him, there were people of good character who were in positions of power, who did push back. and who thwarted a lot of the extreme plans he wanted. i'm thankful we had people in positions of power like bill barr. or general kelly, or even mike pence, because he did not go along? >> will others come, now? >> there will be some good people. i don't know if that will be the case. it will be mainly yes men that will carry out trump's marching orders. >> this is a part of the plan. if you are a supporter of trump. and if your plan is the only way the agenda can be realized, is having like-minded people as close to 100% as possible. europe not going to get pushback from the republicans who want to be close to trump. if the idea is to promise to the base to receive this make america great again idealism, we have to have people that aren't going to check the president, when his worst instincts take control. paul pelosi on the porstands the illustration when political, violent rhetoric, manifests and focuses on a target. h this is the husband of someone in government. if you were facing serious criminal charges you wouldn't want people to see your trial on television. why he is trying to make his trial in washington, d.c. must-see television. has donald trump ever seen a camera he did not like? i'm asking you a rhetorical question. this is a man who introduced himself to america in tv. >> you're fired. >> you're fired. >> you're fired. >> you're fired. >> you're fired. >> you're fired. >> and the man who now is demanding that his election subversion trial here in washington, d.c. be televised. unless you think i'm overstating it. here's what the former president's attorneys wrote in a filing on friday night. president trump agrees and demands that these proceedings should be fully televised. media organizations, including cnn, have asked for permission to broadcast the trial. i want to bring in trial attorney and defense attorney for convicted murderer alex murdaugh. he was a big advocate for cameras in the courtroom. thank you for being here. you changed your mind after that trial about having cameras in the courtroom. why? >> sure did. thanks for having me. i was a big proponent of cameras in the courtroom. i had a couple other cases. and i felt it was important to educate the public on how ktrias operate and better educate and hopefully have faith in the judicial system. but the murdaugh trial was a different character. it brought out the worst of the viewing audience. we had people that would come to the courtroom to get on television. it evolves into a sporting event. at times the gallery and the courtroom would clap when the judge would rule against us. and there was tremendous temptations. trial lawyers are hams, actors. and you lose track of what the focus of the trial is and the jury. in the murdaugh case, that happened to all of us, court officials, lawyers. and there was a circus atmosphere on the outside of the courtroom. and when the jury would leave, they would see tents and reporters from major networks. you know, cnn and other networks. >> what you describe -- and i understand -- first of all, i understand trial attorneys being hams. hams are always a part. we indict ham sandwiches. we are hams in the courtroom. what you describe, couldn't that be contained by minimizing who is present in the courtroom, and allowing cameras to be there for the greater audience? a case like this, you have a former president on the stand, aren't there ways to change what you saw as circus-like? >> that's a lesson learned. if i were to be faced with the same situation again, i would know better to ask for restrictions on how the media is, you know, placed. outside the courthouse. media have a first amendment right. it's a balancing test for judges, balancing the first amendment right to the media. the public's right to access trials. and a defendant's right to have a public trial. i understand why president trump and his lawyers -- i know john. excellent lawyer. i worked with him. why they want to have cameras in the courtroom. they want as much spillover effect of what happens outside the courtroom to impact the jury. we felt like in the murdaugh case it was a spillover effect that the jurors couldn't ignore. murdaugh was a refiled defendant. he was accuseded of doing bad things financially. stealing from his clients. he was not liked. president trump is liked by a lot of people. i can understand why they would want a broad audience coming into play. and the jurors hearing from them. maybe to sequester the jury. that jury was sequestered for months on end. maybe that's the answer. >> i think everyone is changing their address. they don't want to be on a trial that would have a sequestering like the o.j. trial. you balance it out. the transparency, to have people see the process of justice. especially because jump will be talking about, as he is in the new york civil fraud trial, of what he sees as injustices in the courtroom. when you balance the two, what is better? to have the transparency in real-time or a transcript at the end? >> i can tell you for president trump's trial it would be best if it would be broadcast. all of trump's supporters and trump has made a political career attacking the media. if the verdict comes back against donald trump and all they have heard is mainstream media's interpretation of the evidence, they will not accept it. i believe that an unfiltered public broadcasting of president trump's trial would be in everybody's best interest. you have to take cases individually. if i had to do the mur ddaugh case, i would say the opposite. >> we'll see what the federal court says. they're not allowed in the court for any reason. this would be a departure. thanks very much. >> thanks for having me on. >> check out jim's crime podcast, the presumption, where you get your podcasts. available on youtube. she pleaded guilty in the georgia interference case. now what jenna ellis told prosecutors about the final days in the white house with ways to overturn the election running out. >> he said, the boss is not going to leave under any circumstanances. we'r're just goioing to stayay powewer. the boss, meaning president trump. and that's what we called him. he said, the boss is not going to leave under any circumstances. we're just going to stay in power. and i said to him, it doesn't quite work that way, you realize. he said, we don't care. >> ellis pleaded guilty to lesser charger in exchange for her testimony. and let's talk about it now and more, with norm ieisen, a forme ethics czar. and seth -- thank you for being here today. norm, i'm glad you're here. when you heard this from jenna ellis, did it transform her into a more important witness? >> i wrote for t"the new york ti times", this is going to be the star witness. when we heard those words, the boss is not going to leave under any circumstances, but you lost, we don't care. that summarizes what the prosecution's case is in georgia and federally, is all about. the illegitimate desire to hang on to the white house, even though you lost the election. dynamite video from jenna ellis. >> there's sidney powell testimony. abc news hearing from her. let's listen to this. >> what was president trump's reaction, when his cadry of advisers would say he lost? >> it was like, well, they would say that and then walk out. he would say, see? this is what i deal with all the time. i will say, with respect to ellis, trump's lead counsel in fulton county told abc news, that the statement of the private conversation, absolutely meaningless. you're chuckling, why? >> he's probably saying anything he can. but the reality is, this is really hitting paydirt. one of the most difficult but core aspects of a prosecutor's job is to find an evidentiary job of the mind o to the defendant. this is a door that can open. you're seeing instances where mr. trump is apparently showing that state of mind. demonstrating he realizes full well that he didn't win, even though they are saying, they're not going anywhere. there's going to be a little evidentiary challenge for jenna ellis. t there's going to be a here say objection. she will say, they can get over the hurdle because they have to put him on the witness list. this is not good for mr. trump. this on top of the new york trial, he's not having a good week. >> don jr. on the stand again. it wasn't a deja vu. it was a new statement and testimony happening. how do you think he performed today? >> it was like an infomercial for trump properties. he talked about how great the properties were. but this case is not about are they good or bad. it's about the valuation and the over valuation. sometimes many times over. some of the evidence that came in today, was harmful. they put a brochure into evidence that said 40 wall street was 72 stories. but according to public records it's 63 stories. they made the state's case for them today. i thought it was a face plant. >> likely eric will take the stand again. if don jr. face planted, what happens to them? >> we start with love, love for human being. that's how we want everyone to look at the people, at the civilians, who are buying there now. they are humans, like us. they want to live. stronger now because we see that only us can protect each other and protect our kids. we want to keep them safe. >> it speaks to the future and what people are hoping to happen. you and mohammed divorced in 2022, after eight years after marriage. as mohammed, you co-parent your children. how are you explaining this conflict to them? >> our children are 7 and 6. they are quite young. we haven't given them much beyond the broad brush strokes. there is a war. it's between israelis and palestinians. we try not to give them the details. the details are horrifying on both sides. and tragic. we've given the broad brush strokes. and my daughter, i did share more with her, that people are dying. i told her that people have died on beet sides and it's horrible and tragic and shouldn't be happening. beyond that, we're trying to protect them. >> did she understand in that moment? >> yes, definitely. our daughter is superbright. our son is, too. our daughter gets it. she can sense that when we say something, the subject is closed. she's not pushing too hard. for more information. i appreciate that on her part. i don't know what i would do if she pushed for more information. we're taking it as it comes. there's no temperlate how to de with this. there's never been an escalation this bad, since 1948. this is the worst fighting since the creation of the state of israel. we're at a loss for words together as a couple. much less with our children. >> i appreciate your honesty and trying to figure out, what would the follow-up look like? and you hope there's not the one question too many, that it ends with you not knowing what to say. i felt that way as a mother. i understand that your family, rejected the idea of you even marrying maya at first because she was jewish, israeli citizen. when you think about that, do your families understand your positions now? >> they do. they know that she does not represent the state of israel. or support what they do. >> when you think about that, so many conversations surrounding what's happening right now, are about who represents who, and who is the proxy for somebody else? and who is accountable and the civilians versus the government. i wonder how you are feeling about the u.s. response to this war. do you feel there's enough being done or the conversations that are had at the political level sufficient? >> i feel that, you know, there has to be a secease-fire, perio. i don't feel what israel is doing to gaza or civilians in gaza, is going to bring israelis more security in the long run. i don't think netanyahu has an end game. if he does, it's not an intelligence end game. i think there needs to be more pressure on israel to stop what it's doing. there has to be a cease-fire. the u.s. government can play a huge role in that. i think the u.s. government is not handling this well, either. the u.s. government should be intervening as a peacemaker and not arming israel more than it's armed. >> mohammed, how do you feel? >> i feel shocked, they are using my tax money to bomb my own people. it's hard to explain to myself. for my children, when they grow up. how their own people were killed during this war. i don't have the words to explain that. >> thank you for allowing us a moment with both of you, to better understand how both of you have come together and are trying to grapple with what many families are thinking about now. how do we e explain anany of tho our chchildren. thanksks so much.. we'l'll be rightht back. > thanks fofor having u us. the highest court in the land, trying to stop the drip, drip, drip of questions over conduct by tightening the faucet. how? the supreme court has a code of ethics. that code coming after a mountain of public scrutiny. justices saying a lack of code has led in recent years to the misunderstanding that the justices of this court, unlike all other jurists in this country, regard themselves as unrestricted by any ethics rules. misunderstanding they be one way to phrase it. could that misunderstanding have anything to do with all that reporting about undisclosed lavish gifts and trips that clarence thomas got from a gop megadonor? could it do with samuel alito's luxury fishing trip, organized by a prominent conservative? or could it have something to do with the ethics questions facing neil gorsuch, amy coney barrett and sonia sotomayor. here we are, a code of ethics. it draws by rules that lower courts are required to follow. one legal observer is calling it a copy and paste job. it outlines what justices should not be doing, like taking part in activities that detract from the digcy of the office or raise questions about one's impartiality. there's a lot of questions about how it will work and who will enforce it. if there's no authority to monitor if the justices are following their own rules, you have to wonder how much a code of ethics is worth. ultimately, it will come down to trust. that trust is critical for the highest institution of one of our three branches of government. any country is only as strong as the institution that i it's bui on. and public opinion for the security, is at record lows. gallup polls put approval rating at 41%. this code of ethics, i wonder if it would reverse the downward trend, a trend that would rest largely with the justices themselves. from deathics questions to unpopular rulings, like the overturning of roe v. wade. i guess time will tell. thank you for watching. our coverage continues.
