now the israeli prime minister says israel will maintain control of gaza indefinitely. and a key battle going before the supreme court as justices revisit a landmark case. we are following these major developing stories and many more all coming in right here to "cnn news central". we want to take you straight to california where ventura county sheriff's deputies are giving an update on the jewish protester who died after suffering a head injury following an altercation during a protest. let's listen. >> good morning, everyone, and thank you for being here. this morning as your sheriff of ventura county it is with a heavy heart that i stand before you here today to address this tragic incident that has occurred in our community. i want to express my deepest condolences to the family and friends of the victim, who lost his life in this unfortunate event. our thoughts and prayers are with them during this very difficult time. as law enforcement officers our primary duty is to protect and serve the community. we take this responsibility very seriously and we are committed to investigating this matter to the fullest and finding out what exactly occurred. we're working tirelessly to gather all the facts and evidence related to this incident. and we will do everything in our power using every resource we have at our disposal to make sense of this incident. and if criminal wrongdoing is covered to bring the person or persons responsible to justice. i would like to thank the members of the media for being here today. your role in keeping the community informed is critical. we appreciate your cooperation and support during this difficult time. we will do our best to provide you with accurate and timely information and updates as they become available. i will now tell you what we know and keep in mind this investigation is ongoing and fluid. so i will refrain from providing conjecture. i will state the facts as we know them at this point in time. on november 5th, 2023 at approximately 3:20 in the evening the sheriff's communication center received multiple calls regarding a possible assault and an unconscious male who was bleeding at the intersection of thousand oaks boulevard and westlake boulevard in the city of thousand oaks. the callers advised the incident was related to a rally or demonstration that was occurring at the location. flyers distributed on social media indicated a demonstration for freedom for palestine protest and a counterprotest was led by we are pro israel. there were an estimated 75 to 100 people at the demonstration between both groups. three patrol deputies were dispatched code green meaning with their lights and siren to the scene along with medics and paramedics to the ventura county fire department and american medical response. soon after two fa troel sergeants along with two additional deputies responded to the scene. at 3:2-22 p.m. one of our patrol sergeants arrived on scene. at 3:24 p.m. two additional patrol deputies arrived on scene. the sergeant contacted the victim, identified as 69-year-old paul kessler, a thousand oaks resident, who was lying on the ground. mr. kessler was conscious and responsive. the sergeant observed what he saw was bleeding from the head and mouth. medical personnel from the ventura county fire department arrived on the scene and began providing aid to mr. kessler. mr. kessler was then transported to a local hospital by paramedics for advanced medical treatment. mr. kessler remained conscious while being transported to the hospital. the suspect was identified, willingly remained at the scene, and was interviewed by deputies. the suspect was cooperative and indicated he was involved in an altercation with mr. kessler. the suspect further stated that he was one of the reporting parties who called 911 requesting medical attention for mr. kessler. several witnesses were contacted at the northwest corner of the intersection where the shell gas station is located. and they were interviewed. these witnesses providing conflicting statements about what the altercation and who the aggressor was. some of the witnesses were pro palestine while others were pro israel. during the investigation at the scene deputies determined that the altercation with mr. kessler, he fell backward and struck his head on the ground. what exactly transpired prior to mr. kessler falling backward isn't crystal clear right now. at 4:02 p.m. a deputy and sergeant arrived at los robles hospital where mr. kessler was being treated. soon after the deputies still at westlake boulevard and thousand oaks cleared the scene. mr. kessler was listed as being in critical condition by los robles hospital staff. however, he was still conscious when contacted by deputies at the hospital. at 5:32 p.m. the deputies at the hospital cleared the call and documented the incident pending follow-up investigation by detectives from the thousand oaks police department. on november 6th at approximately 2:43 a.m. the sheriff's communication center received a call from the hospital staff in reference to the earlier incident involving mr. kessler. at 2:53 a patrol deputy and sergeant arrived at the hospital and were told that mr. kessler had succumbed to his injuries. at 3:00 a.m. investigators from the major crimes bureau were notified of the circumstances surrounding mr. kessler's death, and they immediately launched an investigation. the ventura county medical examiner's office was also notified and sent an investigator to the hospital. mr. kessler's body was later transported to the ventura county medical examiner's office where a subsequent autopsy was performed. i will defer any comments regarding the autopsy results to chief medical examiner for the ventura county medical examiner's office dr. young, who will provide a statement shortly. yesterday afternoon detectives obtained a search warrant for the suspect and the suspect's residence. at 4:58 p.m. detectives conducted a traffic stop on the vehicle driven by the suspect in the city of simi valley. the suspect was detained and until the completion of the search warrant and he was released at 6:15 p.m. during the detention of the suspect detectives executed a search warrant at the suspect's residence in the city of moorpark. i cannot comment on the results of that search warrant as the investigation is ongoing. investigators have not ruled out the possibility of a hate crime, and this is being investigated as a homicide. investigators from the sheriff's major crimes bureau and the thousand oaks investigations bureau are committed to continuing to locate and interview witnesses to the event or individuals who were present or nearby that might have helpful information to provide. it is our understanding that mr. kessler, a u.s. citizen who practices the jewish faith, was at the event supporting israel. the suspect in this case is a 50-year-old who resides in moorpark and was at the intersection advocating for palestine. we understand that the war in israel and gaza has led to an increase in hateful and threatening rhetoric, and we want to assure the muslim and jewish communities that we stand with them both during this difficult time. the ventura county sheriff's office remains committed to protecting the rights and safety of all members of our community regardless of their race, religion or ethnicity. to this end we have increased patrols around mosques and our muslim community centers and jewish houses of worship. we also are working closely with our religious leaders in our community to provide support and assistance as needed. the ventura county sheriff's office and law enforcement in general play a critical role in preserving people's fundamental right to peaceably assemble and in facilitating demonstrators' safety and security as they exercise their first amendment rights. the ventura county sheriff's office is requesting assistance from the public regarding the ongoing investigation. anyone who witnessed or has knowledge of the incident or who was present at the demonstration is encouraged to contact our agency. we have provided the media with a release, with the contact information for our investigative unit as well as our press information officer team. those who wish to remain anonymous can certainly do so by contacting crimestoppers at 1-800-222-tips or 8477. those who may anybody possession of video footage or photographs of this incident can also remain anonymous by using the link we've provided to the media here today. during this time we urge you to remain calm, peaceful and patient. we understand that you may have questions and concerns but we ask you to allow us to conduct our investigation, and we will provide updates as soon as we can. we also ask that you refrain from spreading rumors or spreading misinformation on social media or other platforms as that can not only hinder our investigation but it can cause unnecessary panic in our community. in conclusion i want to reiterate that safety and well-being of our members and our community are of utmost concern to us. we will continue to work tirelessly to ensure that everyone, no matter your faith or religion, feels safe. we appreciate your cooperation and support during this difficult time. and now i'd like to introduce the chief medical examiner of ventura county, dr. christopher young. >> good morning. dr. young, chief medical examiner for ventura county. the death investigation is also ongoing. the -- the death of this 69-year-old, paul kessler was admitted to los robles regional medical center on november 5th at 15:53 hours. diagnostic studies at the hospital included a c.t. scan which demonstrated intercranial injuries, which included swelling of the brain and hemorrhage surrounding the brain. mr. kessler's condition continued to deteriorate, and death was pronounced on november 6th at 1:10 a.m. an autopsy was performed on the morning of november 6th. the autopsy demonstrated non-lethal injuries to the left side of mr. kessler's face. additional injuries included injury to the back of the head. these injuries are consistent with and typical of injuries sustained from a fall. internal injuries also were consistent with a fall, which included skull fractures, swelling of the brain and bruising to the brain. the cause of death has been certified as blunt force head trauma. the manner of death is homicide. the manner of death is a medical-legal determination. manner of death of homicide does not indicate that a crime has been committed. this is a determination that is made by the district attorney's office. when a manner of death of homicide is made, it's simply stating that the death occurred at the hands of another person, or the actions of another person contributed to the death of a person. our hearts and our thoughts are with every individual affected by this tragic event. thank you. >> now, at this time we will entertain questions, understanding that i'm very limited on what i can discuss based on the investigation itself. >> are you giving the name of the suspect? >> no. >> okay. why is that? >> -- any crime at all? >> the suspect has not been arrested. no arrests have been made related to this incident. and the suspect has not been identified publicly. >> sheriff, you mentioned that you want information, you want photos and videos from the public. it's important if we're going to determine if a hate crime occurred here what interactions occurred between mr. kessler and the suspect. can you tell us anything about what witnesses have told you about that interaction? >> i can just tell you that the information we're getting is conflicting with one another. there was clearly an interaction between the two. but what that level of interaction is is still unclear. that's why we're asking for any video footage that we can have. the one camera angle that i think you have all seen that's from the shell station is unfortunately blocked by the message board indicating gas prices. and so we cannot see that from that angle. so we're hoping that somebody has video that can help shed some light on what occurred leading up to mr. kessler falling and hitting his head. one second. follow-up question. >> -- hit him in the head at some point? >> we do not have that confirmed. that is something we're trying to investigate. that wasn't a statement that had been made. but we do not have confirmation of that at this time. >> given conflicting reports as to how the fall happened, why did the medical examiner deem it a homicide? if it's unclear who the aggressor was. >> do you want to take that? >> sure. so again, the manner of death of homicide doesn't reflect whether or not a crime has been committed. so it just -- that there's an interaction with another person. so it doesn't -- it's not hinging on who's the aggressor. it's just that another individual was involved in partially causing the death. >> doctor, you said that the injury to the head was non-lethal. so the lethal injury was the injury to the back of the head -- the injury to the face i should say. >> correct. the injuries on the left side of the face were non-lethal. and the lethal injury was the impact to the back of the head from mr. kessler falling and striking his head on the ground. >> so is it your belief that this victim was also hit and that caused him to fall, or was it the hit itself that caused this fatal injury? >> again, this is still under investigation. but there are injured on the front of the face which could be consistent with a blow to the face. >> so to the sheriff, if i may, when you talk bay blow that would cause an individual to fall, is it your contention that the suspect structure v struck t the victim and caused him to fall? >> my contention is we still don't know that. we're waiting to see evidence of what occurred in that interaction and whether there was a blow to the face that caused the fall or if mr. kessler fell without that being the precipitating event. >> sheriff, you mentioned increased patrols around houses of worship. did this incident change your safety and patrol measures at demonstrations regardless of the size? >> no. so we are not changing our protocol. what we do right now is we evaluate every protest on their own merit to determine what we think the threat level is and then based on that threat level we determine what resources if any need to be there. it's very clear that sometimes when law enforcement does arrive on scene that we can be a catalyst for additional aggression, and so we try and limit our presence. but if there's already aggression being displayed, we want to be there to make sure people are peacefully protesting. in this event 15 minutes prior to this confrontation our thousand oaks police chief had driven through the area. there was about 30 people present when he had left. there was no indication of impending violence. and so no additional resources were needed. our patrol staff had been made aware of this protest and were driving through frequently to just keep an eye on what was happening. this event was not preventable. >> and the suspect you are indicating has been -- is cooperative as he could be under the circumstances? >> it's my understanding that he answered the questions when he was contacted at the scene. i don't know the vetting of all those questions that he answered. but he at least stayed behind in -- >> when he was detained, was that a cooperative -- >> to my understanding yes, cooperative. >> what does he say that happened? >> i'm not at liberty to say that at this time. >> why did you execute a search warrant at his home? >> we're kakt thorough investigation, we want to make sure we have all the evidence we need if we're going to prosecute someone. >> is he a suspect? >> we've identified him as a suspect because right now he's the only one we have information on that may have had an interacts with our victim. that does not mean there aren't others. we're waiting for that information to come out from our residents who were there or any other people who were present and if they have video of that to indicate there was more than one person involved we definitely want that information as well. >> there were some earlier reports that the victim may have recorded on his cell phone the interaction before it actually -- or as it was unfolding. do you have any information on that? >> i don't have that information at this time. >> -- cell phone and -- >> it's my understanding our investigators are working on that and i don't have that information to disclose at this time. >> sheriff at one point it looked like the two groups were on opposite sides of the street. did they intermingle at one point or how did they come in contact? >> to be honest i don't know that information either. i don't know if it was one corner or two corners that were occupied by one group or if they were all commingled the entire time. we don't have that information. >> can you talk a little bit about what that corner had been like or if there had been previous rallies or demonstrations there and just give a little bit of color about what that's been like in the past few weeks and previously? because from what i understand that was a place where there had been some trump rallies and other sorts of political demonstrations. >> because of the volume of traffic that's at that intersection it tends to be a fairly popular intersection to have protests of any number of things. for this conflict that we're facing right now there had been three prior events at this location in thousand oaks. two at the location. this event would have been the third one at that intersection. we've had 21 protests countywide since october 7th. this was the only one so far that has had some type of violent encounter at all. >> thewere there permits -- >> there were no permits required. this is a first amendment protected activity and oftentimes protesters use the crosswalk to make their voices heard and be seen. so when you ask if they're intermingling between sides they're using the crosswalk to be seen and so that interaction is likely to occur. >> sheriff at any point did you recover a megaphone from the suspect? >> did we recover what? >> a megaphone. >> i don't have information on that. i apologize. >> any priors on the suspect? >> i'm not at liberty to discuss at this time. >> and were there any other confrontations or disturbances between the two groups beyond the normal yelling and -- against each other? >> i don't have any information about any other conflict other than one group who was pro israel and one who was pro palestine -- >> physical confrontations. >> we don't have any indication of that, there's been any prior physical confront aiatfrontatio anyone. and as far as both organizations having their events on there, publicly stated on their social media was to have peaceful protests and to not engage in counterprotests. >> the suspect and mr. kessler, did they know each other? have they ever met before? >> i don't have information if they met before, if they knew each other prior. >> do you have any information if in fact the suspect was carrying a megaphone or if a megaknowphone was used to strike victim? >> i don't have that information. >> but you've heard that -- >> i've heard that. and i think the medical examiner has said that the injuries on the face could have been caused by a megaphone. but i don't have the information. >> do you have a sense of the relative size of the two groups? i mean, was there one side that was significantly larger? some of the video has shown there appear to be more pro-palestine protesters or demonstrators. >> i don't have that information. i apologize. >> sheriff, how much information was the victim able to share with you from the hospital? >> i'm not at liberty to discuss that part of the investigation at this time. >> was he able to walk you through what happened? >> i don't have that information at this time. >> we'll take two more questions and then we're going to wrap. two more questions. >> sheriff, do you have any information on who instigated the altercation? >> no, we do not. >> sheriff, you mentioned -- >> last question. >> -- that you allocate resources based on an assessment of the threat level. had you made an assessment prior to this and how is that assessment? >> in assessment was done. we reviewed it. and like said, everything on social media was this was going to be a peaceful protest. even though we were going to have opposing sides. but we had not had any issues previously. there wasn't any indication this was anything more than that. so our presence was simply having our patrol officers drive by and monitoring it. like i said our chief drove by because he was aware of it just to make sure it wasn't turning into something that required more attention. thank you all for coming. appreciate you. >> we've been listening to the sheriff of ventura county, california along with a medical examiner there giving us details about the death of paul kessler, a 69-year-old jewish man who was killed during a demonstration over the weekend. we understand that kessler went to a demonstration where there were both pro israel and pro-palestine protesters. at that demonstration there was apparently a confrontation with a 50-year-old pro-palestine demonstrator. and now unclear exactly what happened during their confrontation, but kessler fell to the ground at one point. officials say a blow to the back of his head ultimately cost him his life. that incident now being investigated as a homicide, with officials not ruling out the possibility that this was a hate crime. we understand that the suspect remained on the scene after this happened, he was cooperative with officials, he actually helped to contact first responders to get to the scene. officials took interviews with several witnesses that were there. some of the statements were conflicting. and that's why officials right now don't have a clear picture as to exactly what happened between kessler and that 50-year-old pro-palestine demonstrator. however, they're asking for the public's help to get information. they revealed there was a security camera at a gas station near the scene. but apparently part of the footage was blocked. so they're still trying to figure out exactly what happened. of course we're going to keep an eye on this story and bring you the very latest as we get it. turning now to the situation in the middle east that has precipitated these kind of demonstrations across the country, we're learning new details about israel's potential long-term plans one month into this deadly war. prime minister benjamin netanyahu says that israel is aiming to control gaza security indefinitely. and should it be a crime for people under domestic violence restraining orders to have guns? we have more on a key case the supreme court is hearing todaya when w we come bacack. election day, one that could have major implications for 2024. for democrats there is concern that president biden may be a drag on the party. while republicans are concerned the issue of abortion may again dim their chances as it did during the midterms last year. abortion is front and center in the biggest races today including in ohio, where voters are going to decide whether abortion rights should be enshrined in the state's constitution. in virginia republican governor glenn youngkin is hoping his campaign to tilt the state legislature toward republicans will pave the way for his 15-week limit on abortions. meantime, in deep red kentucky democratic governor andy beshear is framing himself as the only thing standing in the way of harsher abortion restrictions there. let's start with virginia with cnn's sunlen serfaty. unlike a lot of republicans governor youngkin is not shying away from the issue of abortion. >> that's right. not at all. the governor has really leaned into making and keeping this issue of abortion really front and center for this campaign. the governor of course himself, he's not on the ballot. but he has been heavily involved. his political operation, they've invested considerable time, money, resources all around this messaging around the governor's abortion plan. and his plan is pushing for a 15-week ban on abortions with exceptions for rape and incest and life of the mother. and he's really -- that of course is notable that that is much stricter than the current ban in place at 26 weeks with some exceptions. and we've seen really youngkin lean into this argument trying to frame it on the campaign trail that this is the consensus solution, of course on a very tough election year issue for republicans and democrats. here's him on the campaign trail earlier today. >> we've been very, very clear about i think one of the tough topics in virginia and america, which is abortion. and what the other side has been saying is simply not true. we're very clear. i will support one bill. one bill that will protect life at 15 weeks. a bill that will have exceptions for rape and incest and when the life of the mother is at risk. that's the bill. anything anybody else says is an absolute lie. and to call it a ban is such a mistruth and disinformation. and they should all be ashamed of what they've said over this campaign because none of it has been true. >> now, if republicans in virginia hold the house and retake the senate, that will mean that they will have for the first time since 2013, boris, full control of the state legislature in virginia. he's been very clear, the governor has, he will sign this into law. and of course a big test for them him going forward and the national stage, also a big test for republicans in this message going forward. >> and that's part of the reason we started with virginia, right? it's kind of a barometer for where the nation is. >> absolutely. the last few election cycles in particular really there was a correlation with the messaging and the strategy and how each party does in virginia to the broader national election. certainly both parties today will be paying close eyes on what happens in virginia, how it bodes for them going forward. and i think for democrats on the issu e >> what are you hearing from them? >> well, what we're seeing for ourselves, boris, and this is just one snapshot. i want to point out this is one polling place, this is a part of columbus that tends to lean democratic. but i mean, you can see here, this is something that we've seen throughout the day. the diversity of voters and a stream of voters, a constant line. we've seen mothers bringing children, college students, retirees. what people do in this community center is they check in with this table, they grab their ballots and then they head over here and they vote. american democracy at work. and the turnout, when you talk to the people who are working here at this polling place, is that they'll tell you that the turnout has been quite high and surprising for an off-year election. turnout was expected to be somewhat robust but it has been very high for an off year. it is issue one. the issue of trying to enshrine abortion rights into the state constitution that at least voters we've spoken with here say has been bringing them out today. take a listen. >> i think people feel very strongly about people's personal choices and their ability to make choices for their own. so just really respecting each other and making sure everyone has the ability to do that on their behalf is really important and speaks very highly of us as a community. >> we're living in weird times. and i think from personal experience sometimes you don't feel heard. so you kind of try to do your part. i feel like we're all sort of kind of hoping we can change things for the better. this is one way to do it. >> and this is expected to be very close. i've spoken with advocates on either side of issue one and neither of them say it's going to be smooth sailing, and they all say it is going to come down to the very last minute. both sides are out knocking on doors. polls close tonight. it is going to be a battle to the end and one that is going to be observed by states like arizona. i heard from someone in arizona, an analyst there who says he's going to see what happens here in ohio to tell him how abortion's going to play out until 2024. so a lot of states looking at what's happening here in ohio. >> yeah, just one snapshot that could portend quite a bit for both parties moving forward into next year. kyung lah from columbus. thank you so much. brianna? >> let's talk about this now with two of our cnn political commentators, s.e. cupp and maria cardona. maria, to you first. how motivating do you think that scotus overturning roe is going to be in these states? >> well, if we look at past elections, specifically 2022, we can say it's going to be incredibly motivating. and i've talked to a lot of the campaigns that are running on this issue. and they say it is still incredibly motivating when they have gone door to door. and it's not just democrats. it's not just independents. but it's also republicans. it's a lot of women. it's a lot of men that support the women in their family. because fundamentally this comes down to personal freedom. the freedom to be able to make the choice that is right for you and your family with only you, your doctor, your family and your faith if you're a person of faith. and that's how it should be. and i think that across the board we're seeing that that is one of the issues that is not at all measured correctly in the polls, which is why in 2022 so many people missed it. there was this incredible saying that there was going to be a red wave that never appeared. and abortion was one of the reasons why that was so. we'll see if that will be the case today. but i do believe that it does continue to be a motivating factor that is not easily caught in the polls, and if it is tonight or today then i think it's going to be a very strong, incredibly motivating position for democrats going into the 2024 election. >> s.e., if that is the case, if this personal choice framing is something that voters are really identifying with, what should the gut check be for republicans and what should it also be for democrats if yes, this is working but do they also need to have a better argument when it comes to the economy? >> well, so to the first part we should watch to see like maria says if this is going to be as motivating as it was an issue in 2022. i think maria's right that it will be. but then we also have to see if republicans attempting to soften their messaging as you've heard from glenn youngkin, trying to say that the left is extreme in this and that we're not -- we'll see if that works too. it's interesting. he's not wrong or dumb to try to do that because after dobbs republicans went whole hand on restricting abortion rights. they made abortion almost totally banned in a number of states. and they used some very regressive scary language around maybe jailing women, maybe even killing women who went out to get abortions. it's hard to put that toothpaste back in the tube once you've gone that far. so for glenn youngkin to come out and say listen, the far left is extreme on abortion, he's correct. and there are far more extreme versions of abortion than a 15-week ban. that's also correct. we'll see if that works for a lot of the suburban women voters for whom abortion is going to be the number one issue driving them out to the polls in states like virginia and ohio today. >> there are few, maria, if any democrats on the ballot today who have tied themselves to the ballot, right? that's just the fact here. the president hasn't campaigned with anyone. michigan congresswoman debbie dingell thinks this is the wrong approach. let's listen to what she says. >> we've got to do a better job of talking about what we have gotten done during this first term. if joe biden doesn't run well, you're not going to run well. so let's start giving him credit for what he has done. we all have to do a better job of talking about what has gotten done because of joe biden's leadership. >> if anything i've learned covering politics, it's that you should probably listen to debbie dingell if you are a democrat. she was out ahead warning about michigan even in the primary for hillary clinton, which hillary clinton to bernie sanders. she was sounding some alarm bells. and going into the general they were not listened to by the clinton campaign so much. what is the lesson here? are people listening to her now? >> i could not agree more with congresswoman dingell because let's remember that 2024 joe biden is on the ballot. he's at the top of that ballot, right? in 2022 he was not. today he is not. in the special elections where democrats have done incredibly well, which is also something that democrats have going for them in terms of the general mood of the country, right? regardless of the polls that we have seen, we have overperformed the partisan lean by more than 10 points. so that's a good thing. but going into 2024 i do think that everyone who's on the ballot is going to have to tie themselves to joe biden because they are already tied to joe biden. and there are several things going for them. again, to what the congresswoman is saying, joe biden and the biden administration have massive accomplishments that they need to continue to explain better to the american people. in focus group after focus group what we have seen is that when voters hear specifics about what the administration has done for them joe biden's numbers shoot up. we also look at the money raised, right? joe biden has outraised donald trump. that again is a real measure. if people are putting their resources behind the support for this president, that is a good thing for democrats. so again, what i say, you know, in response to these polls, we have a whole year to go. we have work to do. let's roll our sleeves up. let's listen to congresswoman dingell. and i think we'll be in a good position. >> maria, i know you're watching virginia very carefully here. this may be, s.e., the state where democrats are more worried than in other states today. if things go well for republicans, do you see governor youngkin jumping into the 2024 race? >> it would be very tight to do that right now. i know he has presidential ambitions. we all know that. he's made that pretty clear. i would imagine this go-round would be pretty tough. but listen, that's not to say -- anything can happen. trump is certainly leading the pack, but maybe glenn youngkin doesn't see anyone able to come up and catch him. but i'm not sure i would take virginia's successes tonight if there are some for republicans as a complete mandate for glenn youngkin ignited israel's war in gaza. the 1,400 lives taken remembered today in tel aviv with candles and prayers. and israeli prime minister benjamin netanyahu is now hinting of what is in the future for gaza, which israel has bombarded with thousands of strikes since october 7th. more than 10,000 people have been killed in gaza since israel launched its offensive according to officials. the hamas-controlled health ministry in gaza putting those figures up. netanyahu told abc news yesterday that israel will keep, quote, overall security responsibility for gaza after the war ends. and the prime minister said this just a short time ago. >> translator: a month ago a war was forced on us by an extremely cruel enemy, an enemy who wanted to massacre us. this enemy is going to be hit. it's going to be eliminated. we are going to eliminate its capabilities. gaza is not going to be a threat on israel anymore. >> cnn international diplomatic editor nic robertson is live for us in sderot, israel. and nic, when netanyahu talks about israel having overall security responsibility for gaza for an indefinite period, there's a strong connotation there. >> reporter: there is. which means going back to the days before israel relinquished security control in gaza. and the advice from the united states is not to go down that route again. the prime minister still seems to be speaking from a position that assumes that he can make good on the military tactics on the ground, that they can -- the idf can completely crush hamas. and while the operations in some ways are going well for idf, the casualty toll is not too high so far, it's not -- doesn't indicate that hamas is even close to being crushed, that they are even close to taking out all the tunnel complexes and all the political and military leadership. so the prime minister sort of postulating something here that actually hasn't come to pass. but it would be a huge burden on israel if it was going to assume the security responsibility and a responsibility for the gaza strip until another and the prime minister didn't give an indication of what another sort of palestinian leadership could be stood up to fill that vacuum. so at the moment that's sort of looking a long ways over the horizon, not close to that horizon. and i think one of the interesting things that we heard from the prime minister speaking just a couple of minutes ago is he said we're working around the clock on the diplomatic front to give the idf enough time to be able to complete their missions. i think this indicates that prime minister netanyahu knows he's under a time pressure here from the united states and other countries that is going to preclude him and irlds from being able to crush hamas completely. because there isn't a lot of time available. the high civilian death toll is causing the pressure and request for a humanitarian pause which he seems to be perhaps hinting he is getting closer to. but that diplomatic front to give the idf enough time to do the job, that's really indicative of the prime minister hinting that time is limited. >> nic robertson, thank you so much for that analysis. back here in the united states at the supreme court justices heard an argument on a gun case that could have a ripple effect across many other second amendment laws. we'll explain how in just a moment. in a crisis caused by a terrorist massacre. warning civilians to clear out, while hamas forces them back. allowing in food and water, which hamas steals. justices hearing oral arguments today in a case that's going to test the conservative majority's view on gun rights. the case involves a texas man named zack irahimi. he's challenging his conviction under a federal law that bars people who are subject to domestic violence restraining orders from possessing firearms. rahimi was issued a restraining order back in 2020 after a violent altercation with his girlfriend. let's bring in cnn's senior supreme court analyst joan biskupic. what can you tell us about today's arguments, how the justices are responding? >> sure. it was a very spirited set of arguments. remember, this is the first time that they're looking at the second amendment gun rights and what kind of regulations governments can enact since their june 2022 decision that greatly expanded individual gun rights and said that any kind of regulation that's being challenged has to be able to be traced to an analog back to the 18th century when the second amendment was ratified. so it's been a very confusing ruling for lower court judges, who aren't historians to say what should be upheld and what shouldn't be. and in this case mr. rahimi's lawyer had a very hard time pressing his case. what he essentially said was that there should be some sort of match here in the words of the government lawyer, a dead ringer. and the justices were having none of that. i don't imagine that they're really going to back away from the 2022 case that said that you need to look to history and tradition from the 18th century, but they are not going to require a real match. there are key questions here about whether, you know, judges can look at not just what regulations existed back in the 18th century but what other kinds of context were there. and in this case very important. domestic violence was not even an issue two centuries ago. so you know, there was never going to be a match. and what the solicitor general of the united states said defending this law was all you have to do is look back and see laws in which people who were found to be dangerous were forbidden from having weapons, firearms. and that seemed to resonates with justices. now, again, it's a little bit tough to get them to refine their decision from 2022 by this conservative majority, to pull back, on the reading involving history and tradition. but i think we're definitely going to see some clarification and i think what they'll do is open the door to ensuring that a wide swath of gun regulations are upheld down the road. >> yeah. there was a really interesting moment, to your point, where the attorney for rahimi had to acknowledge that he was a dangerous person. >> yes, the chief justice, chief justice john roberts at one point said is there any question here that your client isn't dangerous? and he, you know, fudged a bit but had to acknowledge it. but he also said, you know, that that might not be the issue here if you don't look at dangerousness, rather you look at is there, as i said, as the lawyer was arguing, a better match. in fact, at one point a line from his written brief got thrown at him in court. he had said there's not a similar ban that the government can look to from the time that the founders walked the earth. and justice elena kagan said we have to use that as our standard? looking back to see what was the understanding of the second amendment when the founders were walking the earth? rather than more broadly thinking about comparisons here. >> yeah. joan biskupic, thanks so much for the update. appreciate it. >> sure. >> so it is election day in america, and cnn is on the campaign trail. these are
