It is an interesting indictment because part of the indictment is based on words spoken by the conspirators and the actions that the people undertook, the breach of the voting machines, the harassment of the workers, the filing of false documents. All of those acts cannot be defended that this was political speech or First Amendment protected. It is those things that will be the hardest to defend against. In a rico indictment of this sort, all they need to prove is that two or more of these acts took place by the conspirators, if so, theyre all legally liable. I think it will be a difficult defense for the trump team to make here. The defense has brought successful rico cases. She knows how no do this. It is complex. It took two and a half years. I think theyll they will try to sever and separate the cases. Were not there yet. The reality is that some defendants may say take priorities. There is one person, donald john trump. That may be much more of a priority. But this indictment is the fourth. And that means there are others, the two federal indictments and then the one in manhattan here in new york. Well see what gets tried first and if anything comes to the other, if jack smith calls and says let me try my cases first. But this will take a significant amount of time to try, for sure. The defense from trumps supporters and some legal officials that are tide to his operation has been, you can not prove that he meant to familiarsly to falsely find fake votes or ment to find legitimate votes. Is that viable . It is viable you can make in the court of law without it being called frivolous. I think what they will say is that he did not undertake these phone calls with criminal intent or wilfulness because he was doing this in good faith because he honestly believed that he won the election and it was stolen from him. That is the nature of their defense. This indictment as we talked about, other things beyond that phone call, that are not speech protected. I assumed he was cooperating with the federal prosecutors and the state prosecutors. So we dont know i guess who the identity of Indicted Conspirator jack smith. Is mark meadows . But if these cooperating in the federal indicate and not the state case, that creates problems for both sets of prosecutors. He cannot take the stand in a federal case that could be against him in the state case. They have to get this in line so jack smith doesnt hurt them in both. Did they talk about mark meadows role in all of this stuff . I think so. In the federal state investigations that i was involved in when i was a prosecutor, we always coordinated with the state people when we were bringing our federal cases forward. I would be surprised if there wasnt this federal state cooperation in this case. But this indictment contained mark meadows and the federal indictment that doesnt, raises questions if there was some slippage between these two prosecutor teams and thats to be resolved now. That is such a great point. But it dominated the story, ask this question to fani willis last night. I think it was a week or ten days ago and fani willis asked if she had been working with the Special Counsel office. She said that she would not recognize him if she saw him in the Grocery Store and she said no. This is what she said last night. Have you had contact with the Special Contact with the overlap of these two cases and do you intend to try all of these defendants together .
