A federal courthouse in d. C. Becomes the center of the legal and illegal universe today. What is about to unfold in the courthouse, and we will have it for you. The socalled fake elector scheme which is so crucial to the Special Counsel case, and why this is going to create some of the greatest legal peril for donald trump. A brandnew cnn poll shows that 70 of the Republican Voters believe that joe biden did not legitimately win the 2020 election. Im john berman with kate bolduan, and this is cnn news central. Last hour, our cameras spotted Special Counsel jack smiths motorcade entering federal courthouse in d. C. Former President Donald Trump is going to be arriving in that same courthouse in hours to face a judge and to be arraigned for charges related to his attempts to overturn the results of the 2020 election, and efforts that prosecutors said that would lead to the insurrection, and this is just in, cnn caught up with President Joe Biden while on a bike ride this morning. Listen to this. Mr. President , will you be following arraignment today, sir . No. That is from President Biden today. We have Team Coverage for you today, and Katelyn Polantz and Shimon Prokupiez outside of the courthouse, and katelyn, first to you, what are you hearing is going to happen today . Donald trump is going to be brought in close to the time of the arraignment which is expected to be quite a short proceeding where there is not any photos or videos taken of donald trump, but he is going to be observed by a number of people outside of the courthouse, and inside of the courtroom where he is going to be facing charges for the 2020 election actions for the first time. And there are judges here going about their business as usual, and there are other criminal defendants who are having appearances today before judges including a January 6th Rioter at his sentencing where he remarks that nothing that happens today will have any bearing on what that sentencing is going to be. It is a mood that the court has so much to do with the january 6 rioters with many of them donald Trump Supporters come through the courthouse, and taking a pause to make sure that there is security in place, and protocol around the former president coming into the courthouse for the very first time to make his appearance. We havent seen any other really boldfaced names around here other than a few people from the Special Counsels office trickling into the courthouse so far, but there have been a few people related to donald trump out there already this morning talking about what is happening inside of the courthouse, and including the ongoing investigations, and one of them is John Eastmans Attorneys Hahwho was speaking to poppy harlow. We are preparing a memorandum to send to the Attorney General of the United States to send next week laying out the facts of the law and arguing that our client acted as an attorney advising a client and that the advice was lawful and that eastman should not be indicted. We are further going to say that if indicted, he is going the trial. If convicted, he will appeal. This is not a case where theres any Plea Bargaining in the future. Reporter so with this case with donald trump in the system, there are conspirators uncharged including his elections attorney john eastman, and if there were charges to material oize. We dont have other names in this case or future cases, and it is a long road to the trial, and we expect donald trump to plead not guilty and get the case started today to head toward trial. We can hear also the commotion that is building up around, and for more of that and the fpreparations for security, we go to Shimon Prokupiez, and you can hear people gathering around katelyn, and some of that has to do with the Security Preparations under way, and what are you hearing from Law Enforcement . Yeah, there are a few of the supporters of the former president in here, and it is early, and yet, we are not seeing many of the supporters out here, and not many people against the former president or necessarily the people who are in favor of the former president , and not seeing the crowds yet. You could argue it is early, but by this point in all of the other arraignments we had seen a fair number of people gather, but a lot of the security or the attention is focused on the back side of the courthouse. The back side from where katelyn was reporting, and the backside here, because we belief he is going to drive along 3rd street with the motorcade, and bring him back here into the courthouse. There are u. S. Marshals here. We have seen the members officers from obviously the washington, d. C. , police, and the secret Service Agents and Law Enforcement out here, and what they have also done here, kate, they have put the snowplows here as an extra layer of security here to essentially prevent anyone from trying to cross the Metal Barriers. We dont know if they will stay here once the motorcade gets here or move the trucks, but it is an added layer that we did not see in florida. We saw some of this in new york city, but we did not see this much security in florida. So here in washington, d. C. , they are not taking any chances, and they have ramped up some of the security, and all across here along the courthouse here, this is one of the entrances that they have set up Metal Barriers or letting the people come in this way, and the streets are mostly open right now, and we will see if that is going to change as the day is going on, but this is sort of the security here, Metal Barriers, and the snowplows, and the Law Enforcement patrolling the area, and Bomb Sniffing dogs and other officials here on bikes preparing and waiting for the former president to make his appearance, and for the most part like i said earlier, we have not seen the level or the numbers of supporters that we have previously seen for the former president. We will see what happens as the day goes, but the one thing for Law Enforcement here with january 6th, this is where it happened. The capitol is just across the street, and no one is taking any chances here, kate. Absolutely not taking any chances. And i was talking to andy mccabe here earlier, looking at the shots that you had, and it is about the seen and unseen in terms of the layers of security in what they have to prepare for today as well. Reporter yeah, a whole lot of things going on and a whole joint Operation Center with the fbi, the secret service, local marshalls, the washington, d. C. , police, the federal protective services, and everyone is working together and monitoring the social media, and looking to see what people are saying it, and who is saying they are coming here to cause any kind of disturbance or violence. That is what they are worried about mostly here, and this is why they have set up these security measures, kate. Great to see you, and great to have you there, shimon, and a lot will be happening there in the next couple of hours. John . And so much of this is surrounding the fake elector scheme. It is that the donald trump and the administration tried to use this slate of fake electors, and joining us now is the our analyst eli honig, and this is very important of the scheme to the indictment which has been charged. Yes, naccording to the indictment, this is a scheme that was to disrupt the electoral vote in seven key states that voted for joe biden, and they focused on georgia, pennsylvania, michigan, wisconsin, new mexico, arizona and nevada. Now, as to who was involved here. The players according to the indictment, and we knew from reporting that Rudy Giuliani was a centerpiece here, and he has been mentioned in the indictment as coconspirator two, and the doj is saying that donald trump, himself, he was directly involved in the effort, and other people who helped it along is john eastman, and Rudy Giuliani was one, and eastman, two, and three was chesebro, and saying that you are electors for donald trump, and so that is the core of the conduct. And so it is important, because as jack smith and the team lay out, it is not about speech. Donald trump can say what he said, this was about actions. Stuff that was done. Yeah, so take a look at what system of the actual documents look like. Each of these, and for each of the seven states, the documents were similar. This is arizona, and talking about the action, and what was done. They sent the documents in to who . The u. S. Senate, the archivist, and the chief of the federal court, and speech is one thing, but action is the sending in of the documents. And this is what the documents say, and we wont read all of this, but it says that we are the duly elected electors for donald trump and mike pence, and these are the states that did vote for joe biden, and then the actual elector sign these certificates saying yes, this is us, the people, and they sent in the documents to all of the official authorities. And these were, again, actions taken on things that donald trump and the coconspirators said, and we are notable to say this, this was intended according to the document to not necessarily flatout overthrow the election, and not because they thought they were real, but to obstruct it, and just to slow it down. And that is important. This is a crucial nuance of the indictment, and the part of not wanting to fool it, and everybody could turn on cnn and see that Joe Biden Won those states, but to disrupt the confusion and create a delay, and that mike pence in their plan and he did not do that, and say, we have confusion about these states, and we dont know, and then kick it over to the House Of Representatives according to the plans, to submit it. And then submit the fake electors and then send it back to the House Of Representatives and more people are involved and then it becomes a conspiracy. This is not going to go undefended by donald trump. It is going to charge materiality, and if you are going to it is a fraud, you have to show that it is a defrauding somebody, and it is a trick. Everybody is going to say that everybody knew that donald trump did not win, but it is another reason, and these were offered by us as not replacement e leks or the, but alternate electors, and if we won for any ongoing speech, anded this is to register discontent, but this is complicated by the allegation that the point here was not the trick people, but the point was to create chaos, and then let Everything Else play out. It is interesting to see how the indictment pieces this together. Elie honig, we will talk about this more later on. The federal indictment just hand dn by Special Counsel jack smith is not only the most important indictment by far of former President Donald Trump, but it is perhaps the most important indictment ever handed Down The Safeguard American Democracy and the rule of law in any u. S. Court against any one. And Professor Hassen joining us, and that is a high bar, rick, to say that this is the most important case ever to protect democracy and why do you say that . Well, i dont use those words lightly, and i didnt say anything about that with the documented case which is quite serious, and also, the hush money records case which is pretty minor one, but what makes this particular indictment unique is that it involves an attempt to try to subvert the results of the 2020 election, to try to overthrow american democracy to turn the election loser into the election winner. So far, trump has not been held accountable for thashg and he was not convicted in the senate, and he was not facing any civil liability, and this is the only chance to have the deterrence of trump and others like him who might try to steal an election going forward. I want to get your take, and i have questions for you, but also in hearing from the former Attorney General bill barr in reacting to the indictment, he called behavior that he read about in the indictment nauseating behavior, and he gets to what you are speaking about right here, and listen to bill barr. You read through the indictment and his behavior in that indictment. It is nauseating, and it is despicable behavior and whether it is krcriminal or not, and someone who behaved in that bullying for our system and selfgovernment should not be anywhere near the oval office. Rick, bill barr said a whole lot more in that conversation with kaitlan collins, and what did you think of that . Well, i was more taken about what he said at the end of the interview, and i was on with kaitlan right after, and bill barr said that he still didnt know if he would vote for him if he were the 2024 nominee, and after saying that he was despicable or nauseating and saying that he was not like this with a dispute of the liberals or the conservatives, but it is the republicans and there is a line that you cant cross regardless of the party, and it is not where the party is right now, and hope that the trial if it does happen before the election can bring people focused on the issue, and see what kind of danger it is when american democracy is undermined. One of issues here, Professor S People want to go to the document, and say the constitution or Something Like it, and say s ah, this statutory language to make clear that the behavior was criminal. And bill barr in the statement there, he said whether it is criminal or not, he doesnt think that trump should be anywhere near the oval office, but that whether it is criminal or not is critical, because what happens if the jury decides it is not criminal. Well, i am not convinced that we will get to a jury, because it is a very complex case unlike the documented case, and it is involving many witnesses, and we may not see a witness before 2024, and if it does, and the jury reaches the verdict then we have to accept that verdict, but there is an Education Function that is going to happen when the public can see the evidence, and more to the point about, is this a crime, there is specific elements that have to be proven that donald trump for example corruptly obstructed the counting of the electoral votes by what he did, and elements of what he did and you wont find it in the constitution, but no person is above the law, and if donald trump can be proven Beyond A Reasonable Doubt to have committed crimes, he should be punished in the same way that any other person who committed the crimes should be punished and that is what the constitution is talking about under equal justice under the law. In terms of people wanting to look at the paint by numbers and the boundaries of what you do and where to break glass, the way that van jones is talking to john and i about it is the fact that transfer of power is not really going into extra innings before in this way. And it did this way, and this is what happened. So, what, what, what what, you are talking about the education piece, but how much gray area is there and how much more difficult does it make the case . I go back to Bush Versus Gore in the hard fought election and many bad feelings on both sides, and the case went to the Supreme Court which resolved the dispute in a controversial way, and al gore got up, and he said, i dont agree with the Supreme Court, but i accept the result. And when george w. Bush left office and barack obama came in, nobody accepted that he wouldnt leave the white house, and we are in a different realm now, and he had over 60 lawsuits to prove fraud and succeeded nowhere to raise irregularities and succeeded nowhere to show that there were irregular results, and Show Complaints of illegal schemes to come up with the fake electors and undermine the peaceful transition of power. And so it the actions of donald trump were unprecedented as well. And if he is found not guilty or never goes the trial, does it open the door for this type of behavior in the future . Well, you may remember when the senate did not convict donald trump after the house had impeached him for the actions. Mitch mcconnell of the Senate Minority leader of the republicans said that it is civil or criminal liability that is going to hold donald trump respo responsible, and now we are taking a gamble if the criminal process is going to work and work in time, and there was a chance to politically deal with this which is what the senate should have done and it did not happen then, and i am worried about the democracy, but we have to leave these questions to the courts and to the juries to make their best determination based on the evidence that will be presented. I wanted to ask you about the polling today, but today is a historic day in the arraignment in washington, d. C. , and what does today mean for donald trump in your view . Well, im proud that it affirms the rule of law, and it affirms a lot of the work that the house, and the January 6th Committee did. The reality is that there was an elaborate plot that the Trump Administration had to try to overturn a legitimate election, and we in this country need to hold elections sacred, and we cant have politicians after the fact trying to nullify what the voters say. So im glad that the rule of law will be upheld. Donald trumps defense team is preparing a Defense Saying that his words and actions around the january 6th is protected by the first amendment, and you dont agree with that, i know, but are you concerned that is going to be a tough case for prosecutors to prove Beyond A Reasonable Doubt . Well, this is not about his free speech. I mean, if he wants to go out the give a speech, and Cast Dispersions on the validity of an election, it is unfortunate and leading to the polling that you cited, but it is not what is criminal. What the allegation is that he was interfering with the justice department, interfering with white house personnel to plot the overthrowing of the legitimately elected electors and trying to subvert that process using government resources, and this not donald trump just making speeches, and this is distinction. I wanted to ask you about the poll number, and some others, and nearly 7 in 10 republicans still in this poll with the new cnn poll still say that joe biden did not legitimately win the 2020 election, and that number is tickk back up, and it is higher than earlier this year, and higher than we saw through the last poll, and why is that . Well, it is unfortunate and not surprising, because as we head to another president ial election, this country is deeply polarized and people are getting into the part san isan camps, a is donald trump leading in the polls, and likely to be the republican nominee, and that the election was stolen, and this is why it is a decisive election, and it is a rematch of President Biden and President Trump and the American People will weigh in whether we count the votes and it is okay if you lose the election and try to subvert the process, and that is what is at stake. Another part of the poll that is important to talk about is joe bidens approvalatg. Overall, the Approval Rating is 41 , and this is not great. His approval on handling the economy is even lower than the overall Approval Rating, and handling the economy is 37 , congressman, and this is where the number sits when you have a series of good reports coming in about the economy, and if that is where it is sitting when you are getting good news on the economy, and how do you make the sense that joe biden is doing okay . Well, we have to talk about what the president has achieved and what he will achieve. He inherited a tough situation. He came in towards the end of covid, and that was an economy that was hurting because of the unemployment. We had to have spending to bring the Unemployment Rate down, and that hurt with the inflation, and so he inherited a tough situation. But what did he do . We have construction going on around the country because of the infrastructure belt, and we are bringing manufacturing home with the semiconductors and the fundamental technologies of the future with batteries and electric vehicles, and as the results are more evidence to the American People, as we talked about the consequential has been, the numbers will improve. That is the case that we make with august of 23, and that is the case that has been being made for months now with the biden economics, if it is, are you okay if that ithe Approval Rating of the economy is still sitting at 37 head into 24. This morning, police are looking for possible additional victims after a harrowing escape in oregon. A woman broke out of Makeshift Cinder Block dungeon after being assaulted. And now, police are fearing there are more victims in other states. Sasha natasha chen has more details. Reporter this is extremely disturbing, because this man picked up the victim in seattle and pretended to be a police officer, and after a brief sexual encounter, he handcuffed her and put leg irons on her, and putter in er iher in the cad that he was taking her to the substation, but he drove her across the line and then she realized that she was being kidnapped when it was hours to the destination which was his homement then he put her in a sinne cinderblock cell, and she later was able to break out, and contacted police. The police are crediting her bravery and will to survive and potentially flagging other victims across the country. This is what they said. While the alleged perpetrator is in federal custody, the disturbing evidence uncovered points to the individuals ongoing and escalating pattern of violence targeting women in multiple states throughout the country. We believe there may be more victims. Victims may know him by the name zakema and may have used several methods to get the victims including drugging the drinks and impersonating a Law Enforcement officer. Reporter and the police found this handwritten note in that home with the title Operation Takeover saying to leave his phone at home and to find victims with not a lot of people in their lives, because he didnt want any type of investigation. Well, now that investigation is spanning several states. If you are looking at the map, he lived in ten states in the last decade and they believe more victims out there, and asking the people to come forward with the information. I spoke with a person with knowledge of the investigation saying that he was new to the fbi and not known to the fbi before this incident, and now he has been indicted by a grand jury for kidnapping, john.
