President trump nominated Amy Coney Barrett to the Supreme Court on saturday, calling her one of our nations most brilliant and gifted legal minds. An expedited confirmation hearing comes next, expected the week after next. For an expert perspective, we welcome professor tara leigh grove of the university of alabama law school. Thank you for joining us. The president describes her as a first rate mind. There is not much in the record that would disqualify her from doing the job. She does have a very distinguished career. No question judge barrett is qualified to be on the Supreme Court. David that throws the democrats into talking about what to she do specific cases. We have already heard from the democrats raising questions about the Affordable Care act, and it is may be unusual because that case has been scheduled for a week from now. It is coming up for the court, and she has spoken out criticizing chief Justice Roberts for his position on the Affordable Care act. Tara it is important when we think about the Supreme Court changes to think about shortterm versus longterm. I do not think we will see very much in the short term. I think there are a lot of jurisdictional or procedural issues to the Affordable Care act challenge which may make the court gun shy about taking this case and invalidating the entire Affordable Care act. I understand a lot of people are concerned about that statute. With or without the Justice Barrett on the Supreme Court, the court is unlikely to strike down the entire Affordable Care act. It is hard to predict what the justices will do in any case, but i think it is unlikely. When judge barrett criticized chief Justice Roberts opinion, she was focusing on his interpretation of the statute, not so much the constitutional analysis. Ame folks have taken that little bit out of context. It is not clear what judge barrett will think about the Affordable Care act constitutional challenge. With or without a Justice Barrett, the court is unlikely to strike down the act. David one of the things that has been raised is whether it would be appropriate for a Justice Barrett to rule on any challenge to this election. This will be a very fraught election, as we head into thousand. We had a 54 vote in the Supreme Court. As we had in 2000. Is there any question about her voting on a challenge that might come up in november . Tara it is hard to see how there is an ethical issue with a justice ruling on election, even after having been confirmed right before the election. I do not think there would be an ethical issue. It is not clear what the challenges will be to the election. I suspect therell be some litigation surrounding it. There already is some surrounding it. I do not think there is any ethical problem participating. David what about the larger question of the increased politicization, at least people talk about that with the Supreme Court. It is not just this one appointment. It has been happening gradually. This is one more step. There is talk of war being diplomacy by other means. As the Supreme Court becoming politics by other means . Tara the appointments process has become very ugly in recent years, of course since 2016 when judge garland was not given a hearing, the appointment process is becoming worse from the 1980s on at both the Supreme Court and the lower federal court levels. Political actors want to get justices on the Supreme Court who rule in ways the political actors on either side prefer. Yet whether the Supreme Court will hit in that direction. , bute faith they will not i think in the short term what we will see is a Supreme Court that is nervous about major doctrinal change in the face of a lot of attacks. Talk aboutal attacks attacking the Supreme Court, possible term limits as opposed to a lifetime tenure, these are things that were not even talked about, particularly Court Packing, until very recently. Historically, when the u. S. Supreme court faces these kinds of political attacks, the justices pullback, and they are unlikely to make major changes. I think we may not see Something Like Court Packing, but we arent likely to see a somewhat chastened court in the near term. David youre probably referring to the days of fdr and the Court Packing proposal at the proposed stitch in time saves nine, adjustment on the court and they did not go forward. At the same time, you have a range of views on the Supreme Court about how quickly they are willing to move. Chief Justice Roberts is generally perceived as being an institutionalist. Clarence thomas is in a different position most of the time. We have any sense of where Justice Barrett would be on how slow to go as opposed to if it is the right answer, lets get there . Tara we do not know for sure. We do not know about Justice Kavanaugh or Justice Gorsuch either on the institutional point. I do not think we have seen enough from either of those justices. I think judge barrett will be a careful justice, whether it is a question of constitutional law or statutory interpretation. I think that would be her modus operandi regardless of external attacks. Doctrinal work from her as a justice. In terms of whether any of the new members of the Supreme Court will be concerned about the attacks, it is hard to say, but it is also hard to be part of institution and not concerned about attacks on the power of that institution, particulate when the attack is on Something Like the length of ones own tenure. David when we talk about the Supreme Court, is a mistake to overlook the courts of appeals. There been a lot of republican appointments. Ot of the work does gun gets done. Are we seeing a major doctrinal shift in the law in a more conservative direction given how many court of appeals judges have been appointed in the last four years . Tara i love this question. I have a paper coming out in the spring on the lower courts, focusing more on the lower courts. I think this is where a lot of the action will be. My guess is the Supreme Court will not change the law dramatically in some of the hot button areas people are talking about, but that means things will get shifted to the lower courts. Right now we still have a divided federal judiciary made up of democratic appointees and republican appointees. President trump has shifted things in a direction of a more conservative bench, but there still plenty of democratic appointees on the lower courts. I want to say this does not matter for most issues. Lower federal court judges are not ideological on the vast majority of cases that go before them, but one can see differences on some of the hot button issues, things like abortion and gun rights. I think that is where more of the focus should be come on what is happening in the lower federal court. The appointments process there has become far uglier since the 1980s than it had been in the previous couple of centuries because lower courts matter so much more, and i think the general public is not focused on them nearly enough. David finally, in a world in which the Supreme Court does not take as many cases they do not take nearly as many as they did 20 years ago and they leave it up to lower courts, is there risk of division. Could we have a division in the federal judiciary so the law that applies to you depends on what part of the country you live in . Tara i think we already do, and i think we may see more of that in the coming years as the Supreme Court, at least my guess is the Supreme Court will not move leaf are in a lot of the hot button areas people were talking about. This means the law will be decided by the lower court. It does not matter in a lot of areas, but it does in button areas. I think the lower courts will be making the law, and you will see different regulations accepted or rejected in different parts of the country. That makes it hard for a federal law that is supposed to be uniform. David thank you so much. Great for me to have a true student of the federal judiciary. Jeanne i think it will be added to the list of key issues they address in the debate, but it is something the president has addressed already. We remember 2016. I think he is prepared to address it. I think it is not what he wants to be talking about. The republicans were on the verge of a wonderful point of potentially taking over the Supreme Court, and to pivot and talk about this is not what they wanted. On the other hand, we only have about 5 of the electorate to say the debate tomorrow night could change their view. Both sides are speaking to a small number of potential swing voters. David we are all trying to figure out what that small number of voters will care about, maybe not his taxes, maybe not his financial support, but what about the Supreme Court nomination . Jeanne i think the Supreme Court nomination is important but not as important to the swing voters as what remains and has been for most of the election cycle the number one issue, which is the economy. On that, the president still wins. The president needs to and one step focus on the economy and economy focus on the and the fact he has moved the judiciary in areas conservatives want to see. Other areas like deregulation, we will see from joe biden a lot of focus on the pandemic, a lot of focus on the fact we have 200,000 people dead and he will express empathy for those people , something the president is not as inclined to do. I do think he will try to bring up the tax issue, but i am not sure it will stick with the swing voters as much as it does with d. C. Insiders. David we have seen the former Vice President trying to link up as a premium Court Nomination with health care because of the Affordable Care at. From joe bidens point of view, he is ahead in the polls by seven or eight points. Is his main goal to make sure we are only talking october 19, if that is his goal to things like the Supreme Court nomination and even the tax returns, is that a distraction that takes away from what he needs to be talking about . Jeanne i think they do. He has to stay on point and not let the president get him offkilter by talking about things like his son or his family members. There is fear amongst the democrats that is what the president will do, the Vice President will be inclined to respond. He has to stay on message. Pandemic be covid, the , health care, and the economy. He has to stick with that comment also show how empathetic he is and that he is a different type of leader than President Trump. That is who is going to appeal to those swing voters. David when we take a look at the plans for the two people going into that debate tomorrow, do they have different chores . President trump has been behind in the polls fairly consistently, even in some key battleground states he is behind somewhat. He has to change minds. Joe biden does not have to change minds, he just has to persuade people he can do the job. Jeanne he has to persuade people he can do the job. He has benefited by the fact the president keeps talking about the fact he is unable to speak publicly. He will have to make no errors, no major errors for joe biden will be a success. The president does need to have a very good night. The first debate is traditionally the most watched, and by the second debate any of those voters in the key swing states will already cast their ballots. This is the night they both have to hit. Why does ohio pick the president . For a little while no state better reflected the National Voting patterns. They have also voted for the winning electoral candidate going back to 1896. Beentate is had demographically reflective of the nation. Voted prettystate sharply to the right of the nation because the president did better with white voters in ohio. There are some signs that trump is eroding with that group this time. David explain that. President trump won ohio, but what is the situation this time . If he is eroding, why . Kyle we have seen across the country in polling the reason that biden is doing better than Hillary Clinton per armed is nonwhite voters generally breaking 31 to the democrats, similar to Hillary Clinton. There are some signs that biden is doing worse with some nonwhite voters, including latinos. Voters with and theret a college degree, are a lot of signs that biden is doing significantly better with that group. That has consequences for states that are wider than the national average, like ohio. The thing for trump is that if ohio is a coin flip, it probably means other states in the midwest that are typically more democratic, michigan, pennsylvania, are places where biden is leading. David what should we be looking at in ohio specifically . Is it the suburbs of cleveland and columbus, cincinnati to see where the women are going . Has been a lot of reporting, indications on both sides that the president s numbers in suburban areas are a lot weaker than four years ago, which is something that you hear about, see in polling in other states. That is important. Won the state by eight points, so you have to make up a lot of ground to flip the state if you are biden. It will also be important for him not to get blown out so badly in the appalachian part of ohio, the eastern parts of the state. Also curious to see what happens in the youngstown area which was historically bluecollar democratic, but the president did well therefore a republican. Is there some erosion there . I think biden need some erosion to make the math work statewide. Thed a lot of people said Supreme Court pick may not affect the election all that affectt might it some of those republican voters, could it shore him up there . Kyle the actual timing of the confirmation vote matters here. If the justice is already confirmed by election day, then the battle is over, and i dont know if it necessarily impacts things. The people who care the most about the court are probably likely to be people that already follow politics closely. We know from studies that people who follow politics most closely also tend to be more partisan. Pushes softurt pick partisan back to their respective camps, but the folks may be there anyway. I have not seen anything to suggest that race has changed since the death of Justice Ginsburg. David finally give us a sense of the voting process in ohio. Aboute been talking absentee ballots, the likelihood that there would be a delay in results. What is the situation in ohio . Kyle it is already pretty easy to vote by mail or in person early. The typical early votes are democratic, so when those results come in, youll see more of a democratic lean to the results. Then historically in the rural, smaller counties come in, then waiting for cleveland to come in, see if the democrats can catch up. This time, like in many other states, mailin ballots, many more people voting by mail, and it seemed like there will be a democratic skew to those votes. Those may be counted last or later. Goody be that trump looks in ohio election night, but if you go beneath the surface and realize how many ballots are out there, biden may still be able to win the state. It is about returning us to the rule of law and not the rule of impulse and insult, which is largely what we have had. And about investing in the things that enable opportunity in education, in innovation, and in every corner of the country. Polls we all know that are not infallible by any means but over time, President Trump has had an edge when it comes to the economy. On the other hand, former Vice President biden has the edge in dealing with covid19. How do you focus the debate so that there are one or two issues rather than eight or 10 . Kyle one thing i will say about the debate, at this moment, covid19 and the economy are deeply connected. We are not going to get a high functioning and growing economy unless we have a comprehensive solution to covid19. That is not going to come from the vaccine alone, although that will be a part of it. Testing, rapided response to that testing, it is following the cdc guidelines on washingienic practices, hands, wear masks, social distancing. And it is a uniformity that we are all working together to beat this. It is not about pitting red states and blue states against each other, as we have seen. Underlying all of that will be the importance of telling the American People the truth, the whole truth, which biden will do, and trump has not. David how does Vice President biden get that message across . He could spend the whole debate trying to fact check the president and im not sure that wins for him. A lot of people have questioned the things that President Trump have asserted, but what do you do when you are on a debate stage was Something Like that . Deval if it were me and i had my druthers, i probably would not even debate President Trump. He has no agenda, he has no accomplishments, he has no interest in anything other than himself. Orrything else is lies exaggerations. I hope that joe biden does not try, tempted as he will be, to try and correct every mistake or even follow what is certain to ofan illogical path reasoning, and instead comes in with the points that he wants to make sure he gets across to the American People. Seeing that is about everyone, serving everyone, not just the people who vote for you, trying to build an economy where peoples economic mobility is enhanced, where they can move up and forward. We can address through that income inequality. He has ideas about reversing the Climate Crisis and doing so in a way that brings us to a clean energy future, millions of jobs along the way, something that i have experienced on a different scale in massachusetts. And about dealing with divisions of all kinds, including Racial Division and injustice that has been with us chronically in this country but are within our capacity to solve. I think joe biden is the right leader to help us reach that. David does Vice President biden go into the debate with a cup 11 vantages . The president lowering expectations, saying that he is not sure that he can even stay awake. Also, all the polls have been pretty stubborn with Vice President biden having the advantage. Does President Trump have to persuade some people to change their mind, to come over to his side . Deval i think President Trump has shown us who he is. It is about impulse, showmanship, exaggeration or outright lying. We are seeing a lot of initiatives come out in the last week or so because he is on the people of elections, but what has he been doing for the last four years . He wakes up every day trying to divide us. Joe biden has to not spend all this time talking about what is wrong with President Trump and the administration but to focus instead on what is right with the vision of joe biden and Kamala Harris and the administration he wants to run. That has everything to do with social and Economic Justice and fairness, opportunity for everybody, everywhere. We have an unusual and i think notoric opportunity, to just save our democracy, but to reassert the character of our country, as one that is truly dedicated to equality, opportunity, fair play for everyone, and to work to close the gap between our reality and our ideals. Now when you look at it, joe biden has done an incredible job of getting the message out, being about the people. Each day, something new comes out about this president that does not surprise many of us, but when we look at ohio, when we look at my congressional district, many of the polls are telling us that joe biden is doing better than hillary was doing at the same time in ohio. That is good for us. Of trumps are tired endless tweets, his uneven temper, all of his fake news. But here is the good thing, that is not what joe biden is talking about. Joe biden is talking about what he can deliver. He is talking about health care, quality and affordable education. People right now in this pandemic, they need a president who can lead to, someone who can take command of the country. Joe biden has an incredible background in foreign affairs. Beatty i think it is definitely health care and covid19, but it is also for sure people are thinking about the pandemic, health care, the economy, and social justice. Time where weas a decided on Supreme Court justices based on their qualifications. Most agree that judge barrett is qualified for the job. Has it evolved to where we think they will vote on some issues .
