And today mrjohnson confirmed it. The reality of brexit, he said, means that there must be customs checks of some description in Northern Ireland, after the uk leaves the eu. The Prime Minister has rejected briefings from the irish side that that will effectively mean a hard border, in the form of a series of customs posts some five or 10 miles back from the real border. He says more detailed plans will be unveiled later in the week. The Prime Minister has been speaking this afternoon to our Political Editor laura kuensberg. This is about whether or not the government can can come up with a deal with the European Union to protect the economy, to protect peoples jobs and livelihoods. This is not about telling people to cheer up. It couldnt be more serious. I know, but it is also a question of getting brexit done by october the slst and doing it in a way that protects the unity and integrity of the united kingdom. And we are entitled to protect our Customs Union and we are entitled to exit as a sovereign state, and we can do it in such a way as to preserve the, as i said, all those benefits that ireland has so with Great Respect to all those who are currently anxious, particularly in ireland, i do think our proposals are good and creative but i accept also, laura, that there may be hard yards ahead. There are definitely some people who are worried about new proposals for the future of the irish border and we will speak to one of them soon but first. Lets spell out where we are at the moment and what we might be moving to. The irish backstop is the mechanism to avoid a hard border in ireland. As things stand, the uk and ireland are both eu member states, so goods can cross the border without the need for checks. After brexit, the 310 mile border between Northern Ireland and the republic will be the only land border, between the uk and the eu. A failure to reach a trade agreement, would mean Northern Ireland would end up with different rules and standards, to the republic of ireland. The backstop is the insurance policy that keeps the border open, until alternative arrangements, in the form of a new trade deal, and or a combination of customs and regulatory checks, can be found. The backstop has been rejected by the Unionist Community in Northern Ireland and by the British Parliament 3 times. Joining us now to discuss the border issue further is Neale Richmond who chairs the irish senates brexit committee. Good evening, thank you for being with us. I dont know if you heard the Prime Minister speaking to laura but he says we are entitled to protect our customs territory as a sovereign customs country. Your reaction to that . I recognise that fa ct reaction to that . I recognise that fact but i think what is quite clear if you go back to the joint declaration, the British Government and the European Commission agreed to no additional infrastructure or checks on the island of ireland or the border. In talks of the ideas dismissed from the leaks last night are disappointing and go against thatjoint declaration. We want are disappointing and go against that joint declaration. We want to work with the British Government to allow them to leave the eu if that is what they want to do but leaving the eu they need to maintain their responsibilities, first and foremost, the integrity of the good friday agreement and putting in the discussion of future customs checks orany discussion of future customs checks or any other infrastructure on the border is a retrograde step that brings us back to a sad time in our history that we all thought we left behind. Unless you consider the 2017 agreement was flawed in the first place because no government, the government of theresa may included, signed up to the Customs Union or the single market. Their new relationship must surely include custom checks of some description, otherwise how do you get out of the backstop unless it is a trap . Far from it. Firstly, the 2017joint declaration and the 2018 withdrawal agreement, it is important not to confuse the two. The overall line of both the british and european side is no additional infrastructure on the border of ireland in order to maintain the integrity of the good friday agreement. We want to move towards the second phase of brexit negotiations, to negotiate that deep and meaningful trade customs and regular trade deal, that will mean there is no need for that. If that cannot be achieved of course we remain open to suggested alternative arrangements and none have been suggested so far. Finally, we need that insurance policy of the backstop, a temporary measure that would allow for rigatoni alignment for ireland and a Customs Union between the uk as a whole and the eu. It is a temporary insurance policy. We need the legal guarantees and talking about additional structures goes against the spirit of negotiations that have been held before andy keogh and a key desire of all people, including borisjohnson when desire of all people, including Boris Johnson when he was desire of all people, including borisjohnson when he was home secretary who backs that declaration. What would you accept because if britain wants to go ahead and negotiate its own tariffs and free trade deals, that is going to be some kind of check in some shape oi be some kind of check in some shape orform . What we said in the european side and they have been consistent, we want to negotiate that new relationship and we are open to any suggestions from the British Government but it must be respectful of the backstop and be aware of the two key pillars of the European Union on protecting the integrity of a european single market, but equally making sure the good friday agreement is maintained and kept secure. That is a responsibility of the British Government as a cool guarantor of that International Peace treaty. Something that has far more eminence over any brexit discussions must be the key aim of where we are at. When you get is planned later in the week, when you engage with them honestly and properly . There is a lot of anger in the Unionist Community as well, that again rte have been briefed on non paper is that the uk government has supplied. It must be coming from the irish side because it is common of rte that he is getting hold of these papers. That is a terrible remark to make because tony is one of the best journalists. He is, but he is coming from the irish side. That is a gross accusation to make with no evidence. That is the allegation the Unionist Community are making today, they say it is an attempt to sabotage the negotiation. It is not only the Unionist Community that are opposed to it. We have to be careful with their language at the moment and accusations being made by the Unionist Community or anyone in relation to the journalists integrity in the role of the Irish Government should not be done willy nilly. The committees have said any delay in providing them with the documentation they need, they will go after that and see that as a form of obstruction ofjustice. How the whistle blower is treated in this whole situation is almost as important as the underlying conduct because we placed so much emphasis oii because we placed so much emphasis on the fact that there is a right way to raise concerns and that is what this person did. This person did not reach, they did not spell classified information, he or she is the proper channels and raised their concerns. The idea that they are going to be threatened or misconstrued as to what he or she knows, i applaud the Inspector General because that is what we should be doing, respecting the whistle blower should be doing, respecting the whistle blower processing and encouraging people to come forward. Theres been a lot of focus on governance, the austrian and italian governments, bill barr, he is within his rights to look up the origins of the russian investigation. In his role as attorney general, can you do that without raising concerns . Yes, we know there is an active investigation about the other members of the Justice Department in the origins of the Mueller Probe. That seems legitimate and reasonable to look into. Anti government protestors were out in force today defying a ban from holding protests. From hong kong, Rupert Wingfield hayes reports. This was hong kongs birthday present to china. They had been told to stay home, that any protest today would be illegal. Any hope the protests would pass peacefully were quickly dashed. This was Central Hong Kong this afternoon. And this, police and protesters fighting running street battles. In the middle of one such battle, this happened. As a young protester tries to strike a policeman with a metal bar, the officer shoots at almost point blank range. The 18 year old protester is expected to survive. But news of his shooting only increased their fury on the streets. We are not afraid. We will get angrier and angrier. We are not afraid of them. We have to, especially us, we have to stay in the front line and protect more people, to save the future for hong kong. As night fell the streets of hong kong began to burn. Protesters began targeting Chinese State owned banks with molotov cocktails. But as Police Reinforcements arrived, the protesters decided it was time to retreat. This is the middle of causeway bay on Hong Kong Island and you can see, here come the riot police and the water cannon. They are going to start clearing this street. This is only one of at least six different protests taking place, here. With the water cannon speeding after them and the riot police close behind, the protesters fled into the back streets. And so, began a game of cat and mouse. On a Street Corner we found this group of angry local residents cursing the police. Up above, they had a suspected protester cornered. As the police marched him away, the crowd screamed at them, gangsters, we curse your whole family this is how deep the divisions have now become, here. This is now the new normal. Were joined now by mei fong, director of strategy at the centre for public integrity. Thank you for coming on the programme. No, not at all, this was exactly what the protesters wanted to happen. On one hand you have the pomp and ceremony in beijing on down south was writing. I guess, the lesson is they have taken to heart and remembered what happened in tenements where all those years ago. There was more violence than seen ago. There was more violence than seen before but some restraint, would you say . The problem is there does not appear to be any leadership of this. It is spiralling out of control, that is the square there but as with this choir, the protesters had no recourse but to show a demonstration so they can indicate what they want. This is where they are showing what they want. Howd you get to break in this, does someone like carrie lam have to go for things to move forward or is she dug in and we carry on like this . It doesnt seem as if there is any way out. What happened with hong kong is that the population is becoming increasingly polarised. When i was covering hong kong ten years ago for the wall streetjournal, people are still willing to say, i am hong kong but hong kong is proud of china. Now we are people saying we are hong kong, we do not want to be part of china. We see protesters throwing molotov cocktails, there are vandalism, windows are being smashed. It is much more confrontational, almost a new generation of protesters since the umbrella movement, who have got much more serious about this. That is right, what we are seeing is an escalation. He is an escalation. It used to be people with umbrellas with children peacefully protesting on the streets but now we are seeing tear gas. We have heard about live rounds being fired, i can only see escalation going ahead. We are going to have to leave it there but very quickly before we go, we havent talked about china and this display of military might. Xi jinping has made it very clear he wants china to remain united and so it is unlikely that he is going to take what is going on in hong kong and allowed them the freedoms they have asked for. As the message for more, for america in this, for example . think if there is anything to be said what is going on there and america wants to retain its position as global leader, now is the time to say something. However, that number did start to fall through the course of the day. But i am pleased to say, if youre fed up of all this rain, that midweek it is looking drier with some sunshine. This evening and overnight, the showers and thunderstorms will clear away from central and southern england and wales, and we will start to see a cooler and drier air mass moving south with largely clear skies. A few showers will still affect northern scotland where it will be windy, but a cold night to come with a touch of frost for Northern England and central and southern scotland. That is because we are importing our air all the way down from the north. Not far from the artic, in fact. You can see the blue hue right across the uk so it means it is going to be a really chilly start to wednesday. In fact, the coldest start we have had of the season so far. However, there will be plenty of sunshine around and for many it will stay dry and sunny all day. Quite a keen wind blowing across northern and eastern scotland down the eastern side of england, that will feed in a few showers here, but elsewhere it should be dry. Top temperature around 1a or 15 degrees but generally in the low teens for most. Now, just want to draw your attention to Hurricane Lorenzo which was a major storm a couple of days ago. It is now continuing to weaken fairly rapidly as it is moving closer towards our shores. There has been a bit of uncertainty as to where it would end up but it is now looking like it will arrive across western parts of ireland through thursday to bring some gales and heavy rain. And then push across the British Isles and also introduce much milder air right across the board, you can see those blue colours being pushed back northwards. This is how thursday is shaping up. It looks like it will be a dry start, plenty of sunshine across much of the country but heavy rain and gales across ireland will push into Northern Ireland and into irish sea coasts, into western parts of britain by the end of the day. Those temperatures will be creeping up slowly from the south. It still could be quite a cool one across the north east. It looks like the remnants of Hurricane Lorenzo continue to ease down. In fact, it fizzles out quite quickly as it pushes across the uk during friday. Well start off with some fairly strong winds and outbreaks of rain which will tend to ease away southwards, many places becoming drier and the winds also becoming lighter as well. And the runaway catering cart that causes chaos at one of the us busiest airports. Watch out. The Brexit Debate once again is centreing around the issue of the irish border. After brexit day, it will be the only land border between the uk and the eu. At the minute the border is invisible after the troubles in Northern Ireland ended, customs check points between the two countries were abolished. Brexit would mean Northern Ireland and the republic of ireland would both adhere to potentially different rules, different regulations and different taxes on goods. Borisjohnson has said checks will be necessary but hasnt revealed how they would be done. 0ur ireland correspondent emma vardy is answering some of the key questions. How does the border work now . Well, that is easy. It doesnt look like a border at all, just a bump on the tarmac. And its an open border, because the rules on either side are the same. So there are cars and lorries passing here all the time without the need to stop for any checks. But it wasnt always like this, though. During the 30 years of conflict here, the border had militarised checkpoints which often came under attack and because a large part of the population believed that the island of ireland as a whole should be one country, ending the violence meant removing any physical sign of a border, at all. What might the border look like in the future . Thats the key question thats been holding up brexit. And causing uncertainty for thousands of businesses here, north and south. Anything entering the eu has to meet its rules, so after brexit, goods will have to be checked somewhere. But the idea of customs posts are hated by many people who want the border to continue to look and feel invisible, as it is today. The Prime Minister, though, believes technology can help, such as using gps to track goods but the eu doesnt believe that technology is quite ready, yet. Are there any solutions . There is one idea when it comes to farming and food. These cows in Northern Ireland, well, they could all be treated as irish cows. Following the same food standards and regulations across the island of ireland. That would mean no need for checks on beef products crossing the irish border, but this kind of idea doesnt work for all products, so another option is moving that irish border into the irish sea, having the whole island of ireland following the same eu rules and regulations across all products. But this would be deeply unpopular with unionists, who dont want to see any differences between Northern Ireland and Great Britain when it comes to doing business. Joining us now from the tory Party Conference in manchester is Mike Cherry National chairman of the federation of Small Businesses. He has been looking at this issue quite closely. Somebody on twitter just said to me quite rightly that there is no homogenous Unionist Community i Northern Ireland. Different parts of the community when different things. What do you think is a solution that would suit them all . Clearly as far as fsb members are concerned, they need to retain that frictionless border, because lets not forget, we have many more Small Businesses in Northern Ireland and the whole of the Large Business community and the Public Sector combined. Therefore whether it be our employees going across the border to work in the south or the north, whether it is witnesses who are producing items, Farm Products in the north, and then tra nsfer Farm Products in the north, and then transfer their produce to be processed at the south, or vice versa, processed at the south, or vice versa , many processed at the south, or vice versa, many of those businesses are transferring across the border, many times a day. And i think we have to reflect that on how frictionless it must be to retain the trade to retrain the economics between both north and south. So there would be some of the Unionist Community who would be full square behind the backstop would be full square behind the ba cksto p to would be full square behind the backstop to keep the border open and the status quote. Whereas there are other parts of the community that are deeply opposed to it. Status quo. You have to ask the Union Community that particular question. Clearly, fsb in Northern Ireland are very supportive of the original withdrawal agreement, we will certainly hope that they proposals that were leaked out last night do not materialize because they would add complexity and cost and will be unworkable to the business community. And we hope that the uk government and the Prime Minister will suddenly come forward with something that is not only workable, but keeps that frictionless border open for trade and for our businesses to continue doing that trade for our employees to go from job tojob from trade for our employees to go from job to job from business to business as they do at the moment. That is the conundrum. Everybody is facing that. It is a frictionless border compatible with what borisjohnson may try and pursue, which is possibly a free trade agreement, the ability to set its own tariffs . Clearly, at the present time, you have got to resolve this problem, that you have a good friday agreement that has to be respected, but also you have to accommodate the frictionless border that Business Needs and if we can come up with some sort of technology that accommodates that, then that is all well and good. We very much look forward to seeing what the government proposals will be in detail, we do understand that there are obviously ongoing negotiations, and we have to reflect how business operates over there. If these customs post that we have talked about last night, that will be set back from the border, if they were pa rt back from the border, if they were part of the solution, would Jordan Smiler members be able to use Something Like that or would be purely therefore large angry businesses . Your smaller businesses. That is something you have to ask the government about those particular issues. Clearly, it is not be the room is a possibility that some sort of technology can be brought forward, that the digitalization of customs checks and things like that are some of the a nswe rs things like that are some of the a nswers to things like that are some of the answers to these problems, but you have to reflect how business actually crosses that border, several times a day, employees process to the producers and vice ve rsa process to the producers and vice versa to continue doing their trade in goods and services. However, that number did start to fall through the course of the day. But i am pleased to say, if youre fed up of all this rain, that midweek it is looking drier with some sunshine. This evening and overnight, the showers and thunderstorms will clear away from central and southern england and wales, and we will start to see a cooler and drier air mass moving south with largely clear skies. A few showers will still affect northern scotland where it will be windy, but a cold night to come with a touch of frost for Northern England and central and southern scotland. That is because we are importing our air all the way down from the north. Not far from the artic, in fact.
