Michael fallon seem to suggest it could be reworked, and that is what the doubters hope, that if he becomes pm, borisjohnson will be a very different figure prepared to cut some sort of deal, it is the nixon and china phenomenon, as an out and out brexiteer, perhaps he could deliver the type of compromise, albeit a souped up one, that mrs may could not. Realistically there is only one deal breaking issue, the Northern Ireland backstop . There is no way around that, the eu have made it absolutely clear, not much about kinds of agreement you have, what kinds of agreement you have, what kind of whistle technology, they wa nt to kind of whistle technology, they want to backstop, an insurance policy in case it goes wrong to ensure there are no border checks, and that is the bottom line. If you are to avoid no deal, there will have to be some sort of movement around the backstop. Borisjohnson has said it is dead, could some reformulation be resuscitated, could there be some wording to perhaps make the british exit route from the backstop a lot clearer . Dont know, but that might be an avenue to pursue to pursue. But there is an avenue between borisjohnson and whatever caught the brexit pragmatist, like Michael Fallon who suggest there could be a deal, and the brexiteer is to say it is impossible, there can be no compromise on the backstop. And at the moment we do not quite know who has really got the decisive say with borisjohnson. Has really got the decisive say with Boris Johnson. The Trump Administration is introducing a new fast track deportation process that will bypass immigration courts. Under the new rules, any undocumented migrants whove been in the us for less than two years, could be deported immediately. For more details, heres our north american correspondent, peter bowes. Well, this is definitely a widening of the net. So far, this fast track deportation policy has applied only to people who had been in this country for less than two weeks and were detained within 160 kilometres of the us southern border, the border with mexico. From today people could be detained anywhere in the United States. They would have to prove that they had been in the country for more than two years to avoid that. And critics are saying that could potentially be a very difficult thing for people to do, that they wouldnt necessarily have the paperwork to prove that theyd been in the United States for that length of time. The civil rights organisations are saying they will sue the us government. This is something, of course, that has happened repeatedly in terms of Trump Administration policy on immigration. So it looks like this will be played out in the courts. The administration will argue that this policy allows them to round up Illegal Immigrants in large numbers. They will also argue that it will ease the pressure on the immigration courts because these people will not have to go in front ofjudges. And that is one of the problems at the moment, that there is such a backlog of cases its taking a long time to go through the normal legal process. Critics are saying, though, that it could result in people being deported with less due process than someone accused of a traffic violation. They say this could potentially be very serious for people in those immigrant communities, it could strike fear into them and could result in miscarriages ofjustice. In our Central London studio is kate andrews, a former spokesperson for republicans overseas, now working for the right leaning, free market thinktank, the institute for economic affairs. Thank you for speaking to us. Expedited removal is, the process already exists, so what are the key changes concerning you . The key changes concerning you . The key changes are things that already concerns me about pre existing policy, they are planning on expanding it across america, meaning that at the moment if you are an immigrant falling under certain kinds of rules, for example if you came over three c as opposed to an airport, if you are within 100 came over three c as opposed to an airport, if you are within100 miles roughly of the southern border, you could be stopped and they could ask to see your details about your immigration status, and if you cannot provide them, in theory you cannot provide them, in theory you can be kicked out of the country within a matter of hours. Rolling this across the country means more people will suffer from what i think is quite an inhumane and potentially legally problematic policy. Think about what it would mean to have to prove your status as a citizen, a resident or otherwise, in a matter of hours. It is bringing in it cuts, essentially, specifically for immigrants, which you would need new at all times. Let it is bringing in it cards. Technically the Us Constitution is meant to support those who are not citizens. There is a 1996 law that already allows for expedited removals without the restrictions currently in place now. Why has it never been applied . think many of the reasons is it obviously seems like a very inhumane policy that could be carried out in ways that disproportionately affect those following the law. If you have to prove in a matter of hours that you have a right to stay in the us, maybe you are travelling or visiting family or do not have residency documentation on you at the time, your entire life could be overhauled and you could lose everything, you could be deported to a place you do not recognise as home. It is very important to point out that chapecoenses immigration policy is very much off kilter with previous republican and democratic president s. If you look at ronald reagan, george hw bush, george w bush, bill clinton, barack obama, they democrat and republican alike, they democrat and republican alike, they are quite sympathetic to immigration, especially those who wa nt to immigration, especially those who want to come across the border to work. President s we had seen since 1996 did not have a desire to get deportation figures up. One of the arguments for the process put in place so very quickly, the Trump Administration say they had to deal with this huge logjam. You point out the policy is inhumane, they also say the logjam is leading to a tearing crisis, so this is the best way around it . One of the issues at the border is parents and children are being separated from their families, essentially kept as detainees in camps that are not fit for purpose. I think there are major questions about whether we could remove people from those camps and allow them to visit court on their own time when they are called to court, thinks the Trump Administration could do to make it easier and simpler for migrants administration could do to make it easier and simplerfor migrants if it was not so obsessed with the idea of getting deportation figures higher and getting more people out of the country. We had to be honest about the context, we are coming up to 2020, one of the presents major policies has not been delivered, which was building the border wall. He wants to show he has been tough on immigration, but the queues at the border and the detainee centres and at the courts when once more migrants are asking questions about their immigration status, this is because the federal government is bringing ina because the federal government is bringing in a policy which is making it harderfor people bringing in a policy which is making it harder for people to come to the us. There are major questions about the ethics and morals of what is happening at the border, and to expand this across the country so all migrants could theoretically be kicked out of the country within hours if they do not have documentation on them, i think its really. I willjump on quickly and get to the final point, obviously with those concerns there is a legal challenge that will be vented. I believe these rates will be started within the next 2a, 48 hours. How do you vision the legal challenge working when the raids will be started so quickly . This is the concern, legal challenges take time and people could be kicked out of the country within hours, so the reality is, i think, there may be a reality is, i think, there may be a real situation where some people do not get the justice they deserve if they are removed to the country and it has not gone through the Court Process yet, it will be very hard to target them and bring them back. While many european nations offer 20 checks or more, in britain babies are screened for only nine conditions, while in Northern Ireland, screening is limited to five. It is recommended all newborn babies in the uk have a free heel prick or blood spot test but a charity, Genetic Alliance uk, says these blood samples, taken in the babys first week after birth, could be used to detect many more conditions than those currently screened for. The charity says the uk lags behind many other european countries, as well as the us, which checks newborns for more than 50 different illnesses. One of these is a condition called adrenoleukodystrophy, or ald. Mother of two, sara hunt, is a healthy carrier of this genetic condition. Her eldest son, alex, died from ald when he was 19. She believes screening could have potentially saved his life. Because ald is a treatable disorder, there is a treatment for it but you cannot access that treatment unless you have been monitored and you know that you carry the gene. It just makes perfect sense for a condition such as this to be added to the newborn Screening Programme. Its the job of the uk National Screening committee to recommend which diseases are included in the newborn blood spot test. But the benefit of any screening needs to bejudged against any possible harms, including the risk of giving anxious families false or inconclusive results. Public Health England said decisions were made based on best international evidence, expert advice and public consultations. The Screening Committee is considering whether to add any diseases to the newborn blood spot Screening Programme and will make its recommendations later this year. Experts say while most babies will not have any of the conditions they are screened for, for those that do, early identification and treatment can prevent severe complications, disability and even death. With me now is the conservative mp nigel evans. We are all going to look rather foolish if it is in borisjohnson. It has happened over the last three yea rs it has happened over the last three years and its cost another Prime Minister herjob. The problem for whoever becomes the next Prime Minister is essentially the problems havent gone away and the numbers are the same. Yet. The first thing boris will have to do is pull some of those knives out of his back. How many are there . Probably about half a dozen. Even before he starts he has problems. As you know, we had a resignation yesterday, alan duncan, even alan wanting an emergency debate in parliament about the next Prime Minister. Would he have got backing for that or was it a one off . It was a oneoff and i think rather bizarre, what today is about is about the culmination of 160,000 conservative Party Members voting leader of the tory party and alan is a conservative association member, his members would have voted as well. They are equal. And to try and trip him up before he gets across the door is bizarre. You are a former deputy speaker, when john bercow looks at this proposal and there are those telling him that would place the queen in a rather difficult position. I think it was out of scope of everything yesterday. I thought the speaker used hisjudgement yesterday. I thought the speaker used his judgement wisely insane, no, this is not going to happen. He doesnt need to explain why, he just looks at it and all sorts of considerations would have gone through his mind but i think he made the right decision. Well be working in our constituencies as well but the Prime Minister, he aint having a recess, he will be working tirelessly, visiting european capitals, ive read that he intends to go to the north of england to start to talk to some of the seats where they voted leave and to reassure them that is what is going to happen. And the important thing and for him is to establish good contact with donald trump, he will be talking to him as Prime Minister of this country, we already know donald wants to do a good trade deal with the United Kingdom and that itself could be used as leverage with the European Union when we start to talk about future trading relations. Really, you think the eu will care . L future trading relations. Really, you think the eu will care . A good trade deal with the United States of america something the European Union has failed to achieve themselves. The European Union still want to flog us their cars, wine, cheese. We still want to buy it. And therefore, doing a good trade deal with the European Union are something thats going to be essential but having the trade deal with america, there is going to be great leverage. You want to go and visit the United States of america, i imagine at some stage as well. Ive got a feeling of deja vu about this, you said exactly the same back in november and december, it was a lot colder here, it has to be said. Weve seen all the seasons during this brexit crisis and hopefully we wont see any more. Will be a little bit in towards autumn by the time weve left but for boris, its cost David Cameron hisjob, europe, its cost theresa may herjob. Really weve got to get out by october the 31st, we got hammered in the local elections, the European Union elections, weve got to make absolutely certain that he keeps to his word and we leave in october the 31st. I would imagine reflective, some of those who sit around the table will be there for the last time, rory stewart has said and confirmed he will not serve under borisjohnson, we confirmed he will not serve under Boris Johnson, we know confirmed he will not serve under borisjohnson, we know Philip Hammond and david gauke, they are departing. I would think other prominent remainers, greg clark, David Liddington who was very much the points man of theresa may, i think they too might find there are no longer required because Boris Johnson has got to create some space in the cabinet to reward his supporters, bring in the people he wa nts to supporters, bring in the people he wants to refresh, shake up and change the feel of this government so change the feel of this government soi change the feel of this government so i imagine theres going to be a pretty significant clear ad. That carries with it huge risks because of course there are going to be people who are bruised by this process , people who are bruised by this process, there are people who are going to be disappointed and there are people who are going to feel they havent got what they deserve and you know, its a basic rule of Cabinet Reshuffle is as they always end in tears somewhere. Thats going to bea end in tears somewhere. Thats going to be a difficult one for Boris Johnson, particularly because hes not a man who you know, is that adept at dishing out tough medicine and being pretty forthright with people, thats not really his style but hes going to have to do that and the signs are that hes going to wa nt to and the signs are that hes going to want to put brexiteers in the main posts, the big posts, but elsewhere in the cabinet, i think you will see a fairly strong representation of all wings of the party really, because he knows hes got to try and bind and hold the party together. So there will be places for some form at remainers, interesting to see what happens to jeremy at remainers, interesting to see what happens tojeremy hunt. Theres an argument to say he should stay at the Foreign Office because we are in the Foreign Office because we are in the middle of a crisis with iran, personally, i think borisjohnson rather bruised by some of the fairly aggressive tone of mr hun s campaign, accusing him of being a coward, accusing him of being fine asa coward, accusing him of being fine as a newspaper columnist but not fine is a Prime Minister, im not sure hell be in the mood to say that sort by gone and forgotten. I think mr hunt might find hes going down the ladder a little bit but thats an interesting one which will have to be handled with some care. Of course it will depend on mr hunt does, is if he runs borisjohnson close it might be enough a lot harder to boot him to the margins of the cabinet. If on the other hand, its a crushing majority for mr johnson, then it much easier to move him sideways. Quite interesting watching of these arrivals at downing street this morning, how theresa may will respond as many of these people are just a couple of weeks ago were saying what was wrong with tory policy so far are going to be sitting around her not getting what they want to become its going to bea what they want to become its going to be a bit awkward, isnt it . And you know, its always, sort of, quite galling i imagine for an outgoing leader, when people have spent who knows, the best part of a year trying to bring you down and undermine new and briefjournalists against you, once its all over, start saying what a wonderful Prime Minister youve been and you did your best and no one could have done better and how sorry they are to see you go. But hey, thats politics. It was always thus, it is a rough game, if you go into it you have to be prepared for that. I think one of the striking things about mrs may s departure, its been rather long list of this leadership contest has been going on for quite a long time. At the way in which she has carried on, she could havejust headed off to chequers, got out the sun lounger and sat around having a dry martini, but she hasnt. Shes been back here, grafting away, day in and day out, albeit some people have said, shes just trying to shore up her legacy with a load of proposals on the environment, housing policy, tuition fees or whatever. But even in the sort of nitty gritty nuts and bolts of downing street she still been Holding Meetings with her business council, the last cabinet i am told was business as usual. So shes still been carrying on very much as the Prime Minister in situ. I guess for other cabinet ministers, there must be a slightly unreal feel to it because you know, anything you say or do is going to be superseded within a few days by any Prime Minister with a new team and an entirely different agenda. Just picking up very quickly while youre there, with nigel evans, you and i have stood in snow, wind, rain, every possible combination during this whole brexit process. Its just nice to be out in the sunshine, isnt it . Nice to be out in the sunshine, isnt it . Well, if youre Boris Johnson, and part of your pitch is you want to bring a bit of mojo and self confidence and optimism back to british politics, while, what a backdrop . She spoke to bbc breakfast earlier and begins here by explaining how she would put a stop to brexit. We think that having a peoples vote is the best way to stop brexit, and so we are continuing to work with other mps in parliament who agree with that, and that cross Party Working right across the house of commons. Because this is the way out of the brexit gridlock and impasse that we are in, and we know from the governments own analysis how damaging brexit will be for our economy, our national security, for our Public Services like the nhs, and thats why its so important that we secure and win a peoples vote. Many people will say, of course, and you will have dealt with this question before, there has already been a vote. Indeed. But that was on departure. There was not the specifics of a deal. And now that we have that level of detail, i think it is sensible that people are able to have their say on whether that brexit deal is what they want or not. And i think, given that it is very far removed from what people were promised back in 2016, there is strong reason to believe that people may well choose, in the knowledge of what they now have in terms of the details of what brexit looks like, that were better off with a deal we have as members of the European Union. And it should be up to the people to have the final say. Youve obviously been part of the coalition government, youve mentioned in this interview about working with other people. Does that include, for example, Boris Johnson orjeremy hunt, whoever becomes leader of conservative party . Both of those people are brexiteers, they are advocating a course of action that will be catastrophic for our country and so, no, it does not include them. I am working cross party on the peoples vote campaign, with mps from all different parties, or most different parties, who share that goal. And i think that collaboration, that working together, is important to securing the right future for our country. And i will continue to do that. But obviously on brexit, i have a fundamental disagreement with Boris Johnson, jeremy hunt, and, for that matter, jeremy corbyn. The Information Commissioners Office has expressed concern about the so called digital strip searching of victims of crime thats when phones and mobile devices are examined for evidence relevant to an investigation. Under the policy, the Police Routinely ask victims, including rape complainants, to hand over their devices. The Campaign Group big brother watch says the system needs urgent reform. Following a series of failures by police and prosecutors to disclose digital evidence to defendants, including liam allen who was wrongly accused of rape, police in england and wales introduced forms asking alleged victims for permission to view data on their mobile devices, including messages, photographs, e mails and social media accounts. If they dont comply, prosecutions can be halted. Courtney, not her real name, reported a Sexual Assault to police. The choice they gave me was that i should give my cellphone to them to be downloaded in its entirety, all the personal material that is on that phone will be seen potentially by officers and my attacker or i can refuse and my case will be dropped. I chose the latter and its deeply upsetting because i feel like at this time that im not able to getjustice for that crime. In a new report, big brother watch claims the searches are highly likely to infringe a victims privacy and Data Protection rights and delay investigations. And the Information Commissioners Office which is shortly to report on the issue says it has serious concerns about the policys impact on peoples privacy rights. The National Police Chiefs Council says it believes that consent forms are the best way of Meeting Police obligations to search for relevant material, but recognises the concerns and will carefully consider both reports. Clive coleman, bbc news. After more than two days, firefighters are still battling a huge wildfire in central portugal. Despite reports of progress, the authorities have requested two water bombing planes as strong winds have fanned the flames even further. So far, more than 30 people have been injured and hundreds have been evacuated. Laura westbrook has the latest. Smoke engulfs the sky as the wildfires in central portugal continue to burn. Authorities say they are making progress but for these residents, its too late. People here can only look on as their homes are consumed by flames. Translation yes, its not the firefighters fault. The people who govern and those who let the fire burn are the ones to blame. Translation we had no assistance no firefighters, no police. Yesterday i was at my brothers house to help. The house burned, no one showed up, we were alone. Around 1,000 firefighters have been deployed to the region along with planes and helicopters. Much of this area is covered in forests of eucalyptus trees which are particularly flammable. The hilly terrain makes fighting these fires especially tough. Firefighters say sudden changes in wind direction is whats continuing to fan the flames. Its not yet known what caused these latest wildfires but because the fires broke out in areas very close to each other, authorities are looking into whether they were started deliberately. Thursday we are expecting to see the peak of the heat. Thats where the temperatures across mainland europe, getting up into the 40s, and that heat is transferring its way towards the uk. One or two showers perhaps in northern and Western Areas during thursday, but its going to be all about the heat, temperatures in scotland and Northern Ireland getting into the mid to high 20s, for england and wales again, into the 30s. But its in the south east of england where it reaches 37 celsius during thursday afternoon, not only the hottest day of the year but it could well break the hottestjuly day on record in the uk.
